1.         In case F.I.R. No. 75 dated 13.08.1998, Police Station<\/p>\n
Sangat, three persons (Jagsir Singh son of Joginder Singh son of<\/p>\n
Prem Singh, Kaur Singh son of Ujaggar Singh and Malkiat Singh son<\/p>\n
of Dan Singh son of Prem Singh) were tried on a charge of having<\/p>\n
committed the murder of deceased Harbans Singh. Out of them,<\/p>\n
Jagsir Singh and Malkiat Singh earned acquittal. It is only appellant<\/p>\n
– Kaur Singh who suffered conviction for the offence under Section<\/p>\n
302 of the Indian Penal Code and was sentenced by the learned Trial<\/p>\n
Judge to undergo imprisonment for life and to pay a fine of
\n Crl. Appeal No. 460-DB of 2007                                   2<\/span><\/p>\n
Rs.10,000\/-.    In default of the payment of fine, the appellant was<\/p>\n
directed to undergo further rigorous imprisonment for four months.<\/p>\n
2.           As apparent from the substantive evidence (in the<\/p>\n
statements of PW2 – Kartar Kaur and PW3 – Amandeep Kaur,<\/p>\n
mother and daughter respectively of the deceased), none witnessed<\/p>\n
the commission of the crime. All that PW2 – Kartar Kaur testified at<\/p>\n
the trial was that “Panna Singh told me that Harbans Singh was lying<\/p>\n
near house of Kaur Singh.” She proceeded to state that “Harbans<\/p>\n
Singh was lying near the place of Mata Rani and drag marks were up<\/p>\n
to that place from house of Kaur Singh. Amandeep arranged for the<\/p>\n
water and Harbans Singh was made to sit. He was offered water and<\/p>\n
thereafter I asked Harbans Singh what is the matter. Harbans Singh<\/p>\n
disclosed that Kaur Singh and his wife Harbans Kaur has given me<\/p>\n
injuries.”   Her statement to that effect is fully in accord with the<\/p>\n
statement made by PW3 – Amandeep Kaur who testified that “Panna<\/p>\n
Singh came to our house that Harbans Singh is lying near house of<\/p>\n
Master Kaur Singh and be brought home. Myself, my grand mother<\/p>\n
and Panna went near the house of Kaur Singh on a bullock-cart.<\/p>\n
Harbans Singh was lying near the small gate of house of Kaur<\/p>\n
Singh……. Harbans Singh was given water after arranging same<\/p>\n
from neighbour.      He was made to sit.    My grand mother asked<\/p>\n
Harbans Singh what has happened with him, on which he replied that<\/p>\n
Master Kaur Singh, his wife Harbans Kaur alias Banto, Jagsir and<\/p>\n
Malkeet and Leela alias Kabal Singh have inflicted injuries on him.”<\/p>\n
3.           As would be apparent from the perusal of the above
\n Crl. Appeal No. 460-DB of 2007                                    3<\/span><\/p>\n
quoted statements made by PW2 – Kartar Kaur and PW3 –<\/p>\n
Amandeep Kaur, they claimed to have been informed by Harbans<\/p>\n
Singh himself that injuries had been caused by appellant – Kaur<\/p>\n
Singh and his non-appellant wife Harbans Kaur.      That presentation<\/p>\n
is not born out by Ex.PD which is the earliest presentation made by<\/p>\n
PW2 – Kartar Kaur to this Court on the administrative side. In the<\/p>\n
course thereof, there is a precise averment that “At that time, the<\/p>\n
applicant tried to ask my injured son about the whole incident, but he<\/p>\n
was unable to speak anything except the wording `Kaur Singh’.”<\/p>\n
4.           Furthermore, PW2 – Kartar Kaur attributed to Harbans<\/p>\n
Singh, a statement that Kaur Singh – appellant and his wife Harbans<\/p>\n
Kaur had caused injuries to him. As against it, PW3 – Amandeep<\/p>\n
Kaur testified at the trial that her father informed PW2 – Kartar Kaur<\/p>\n
that appellant – Kaur Singh, his wife Harbans Kaur alias Banto,<\/p>\n
Jagsir, Malkeet and Leela alias Kabal Singh had inflicted injuries<\/p>\n
upon him. The three additional names (Jagsir, Malkeet and Leela)<\/p>\n
do not find mention in the deposition on oath of PW2 – Kartar Kaur.<\/p>\n
5.           A conjunctive perusal of the testimony on oath of PW2 –<\/p>\n
Kartar Kaur and PW3 – Amandeep Kaur would make it amply clear<\/p>\n
that both are not in tandem with each other. If Harbans Singh had<\/p>\n
actually informed PW2 – Kartar Kaur in the presence of PW3 –<\/p>\n
Amandeep Kaur that appellant – Kaur Singh and his wife Harbans<\/p>\n
Kaur had caused injuries to him, there is no understandable reason<\/p>\n
why this fact would not have found mention in Ex.PD. It may be<\/p>\n
noticed here that PW2 – Kartar Kaur had to address Ex.PD to the
\n Crl. Appeal No. 460-DB of 2007                                   4<\/span><\/p>\n
Chief Justice of this Court as she found that the police of Police<\/p>\n
Station Sangat, had not registered an FIR in the context.<\/p>\n
6.           Panna Singh, who had allegedly furnished the information<\/p>\n
to PW2 – Kartar Kaur in the presence of PW3 – Amandeep Kaur,<\/p>\n
was not examined at the trial.\n<\/p>\n
7.           The statement made by PW2 – Kartar Kaur that the dead<\/p>\n
body of Harbans Singh was lying near the place of Mata Devi and<\/p>\n
drag marks were upto that place from house of Kaur Singh does not<\/p>\n
inspire confidence. She testified at the trial that she had mentioned<\/p>\n
the drag marks aforementioned in Ex.PD. She was confronted with<\/p>\n
Ex.PD where this fact is not recorded. She also claimed to have<\/p>\n
averred in Ex.PD that Harbans Singh informed her that Kaur Singh –<\/p>\n
appellant and his wife Harbans Kaur had caused injuries upon him<\/p>\n
and that Leela was standing over there at that time. She was<\/p>\n
confronted Ex.PD where these facts do not stand recorded.        She<\/p>\n
stated at the trial that her statement in the context of the present<\/p>\n
case was recorded by the Police after about 2-1\/2 years of the<\/p>\n
impugned occurrence and that she had thumb marked that<\/p>\n
statement. The defence counsel called upon the prosecution to<\/p>\n
supply to him a copy of that statement but the State counsel informed<\/p>\n
the Trial Court that no statement bearing thumb impression of PW2 –<\/p>\n
Kartar Kaur was available on record. This fact stand noticed by the<\/p>\n
learned Trial Court in the course of the statement of this witness.<\/p>\n
Likewise, similar fact-based note appears in the testimony of PW3 –<\/p>\n
Amandeep Kaur.\n<\/p>\n

8.            Even otherwise, if Kartar Kaur had a grievance against<\/p>\n
the police inaction in the matter of murder of her son, she could have<\/p>\n
filed a private complaint in the Court. There is not even an averment<\/p>\n
that any such complaint had been filed in the Court. Both these PWs<\/p>\n
i.e. PW2 – Kartar Kaur and PW3 – Amandeep Kaur conceded that<\/p>\n
their statements were recorded for the first time after 2-1\/2 years of<\/p>\n
the impugned occurrence.\n<\/p>\n
9.            We would also like to notice here that though PW3 –<\/p>\n
Amandeep Kaur testified at the trial that Gurjant Singh, Sarpanch, did<\/p>\n
turn up in the morning and that she (PW3) accompanied Harbans<\/p>\n
Singh, Paharha Singh, Tek Singh and son of Gurjant Singh<\/p>\n
aforementioned in the tractor-trolley by which Harbans Singh was<\/p>\n
taken to a Hospital, she had to concede that the details of the<\/p>\n
occurrence were neither disclosed to Paharha Singh and Tek Singh<\/p>\n
nor to Dr. Gurmail Singh who examined Harbans Singh at the<\/p>\n
Hospital. That would appear to represent an unnatural conduct on<\/p>\n
their part.    Normally, one would have expected the mother and<\/p>\n
daughter of the deceased to share the details of the occurrence with<\/p>\n
those who were helping them out by taking Harbans Singh to the<\/p>\n
hospital in a tractor-trolley or whilst he was under treatment at the<\/p>\n
hands of Dr. Gurmail Singh.\n<\/p>\n
10.           In the light of foregoing discussion, the finding of<\/p>\n
conviction recorded by the learned Trial Judge cannot be sustained.<\/p>\n
(There are a number of tell-tale circumstances which indicate that the<\/p>\n
prosecution had not been able to make a doubt free presentation.)

The appeal shall stand allowed. The appellant shall stand acquitted<\/p>\n
of the charge.<\/p>\n
