      Challenge   is   to   Ext.P3   order   transferring   the<\/p>\n
petitioner   from   the   post   of   District   Supply   Officer,<\/p>\n
Thrissur     to   the   post   of   District   Supply   Officer,   Wayanad.\n<\/p>\n
The   substitute   posted   in   her   place   is   the   fourth<\/p>\n
respondent.     It   is   contended   that   the   transfer   is   not   in<\/p>\n
public interest.   Having regard to the ailments suffered by<\/p>\n
the   petitioner,   the   respondents   ought   not   to   have<\/p>\n
transferred   her   to   Wayanad.     There   remains   only   very   few<\/p>\n
months  for   her   to   retire   from   service.     The   petitioner   has<\/p>\n
worked in Thrissur only for a very short period.    Normally<\/p>\n
she   should   have   been   permitted   to   continue   as   District<\/p>\n
Supply   Officer   for   some   more   time.     The   abrupt   order   of<\/p>\n
transfer   will   visit   her   with   evil   consequences.     For   the<\/p>\n
above   reasons   advanced   by   the   petitioner,   Ext.P3   is<\/p>\n
impugned as arbitrary, discriminatory and malafide.\n<\/p>\n
      2.     Considering   the   grounds   urged   by   the   petitioner<\/p>\n
against   Ext.P3,   the   first   respondent   was   directed   to   file<\/p>\n
counter affidavit.\n<\/p>\n
      3.     The   averments   made   in   the   counter   affidavit   would<\/p>\n
show   that   the   first   respondent   had   received   complaints<\/p>\n
against   the   petitioner   from   the   members   of   the   public   and<\/p>\n

it   was   felt   that   it   may   not   be   proper   for   the   first<\/p>\n
respondent   to   permit   the   petitioner   to   hold   the   post   of<\/p>\n
District   Supply   Officer,   Thrissur   and   accordingly   she   was<\/p>\n
transferred as per Ext.P3.\n<\/p>\n
      4.        The   petitioner   has   filed   a   reply   affidavit.\n<\/p>\n
Considering   the   facts   stated   by   the   petitioner   in   the   writ<\/p>\n
petition   and   the   averments   made   by   the   first   respondent   in<\/p>\n
the   counter   affidavit   I   felt   that   the   relevant   files   shall<\/p>\n
be   called   for   and   perused   to   ascertain   the   truth   of   the<\/p>\n
rival   contentions   raised   by   the   petitioner   on   the   one   hand<\/p>\n
and the first respondent on the other.\n<\/p>\n
      5.   On a perusal of the relevant files it is seen that<\/p>\n
one C.T.Anto had filed a written complaint addressed to the<\/p>\n
Hon’ble   Minister   for   Food   and   Civil   Supplies   and   the   same<\/p>\n
was   received   in   the   office   of   the   Minister   on   20.10.2003.\n<\/p>\n
That   complaint   was   transmitted   to   the   concerned   Secretary<\/p>\n
which   was   further   transmitted   to   the   Director   of   Civil<\/p>\n
Supplies   for   urgent   report.     Similarly,   the   President   of<\/p>\n
Methala   Panchayat   had   sent   a   written     complaint   before   the<\/p>\n
Hon’ble Minister for Food and Civil Supplies on 15.11.2006.\n<\/p>\n
This   complaint   also   was   forwarded   to   the   Director   of   Civil<\/p>\n
Supplies   from   the   Government   Secretariat   for   immediate<\/p>\n
remarks.     Complaint   dated   15.11.2006   is   seen   signed   by   the<\/p>\n
President,   Vice   President   and   a   member   of   the   Panchayat<\/p>\n

apart from two members of the public.  A third complaint is<\/p>\n
seen   received   in   the   Government   Secretariat   which   is<\/p>\n
addressed   to   the   Vigilance   Director   requesting   to   take<\/p>\n
approprite action against one Mohammed who is the driver of<\/p>\n
the   District   Supply   Office,   Thrissur,   one   Shri.   Mohan   who<\/p>\n
was the former District Supply Officer and Smt. Gita who is<\/p>\n
the present District Supply Officer, the petitioner herein.\n<\/p>\n
On   28.11.2006   the   Director   of   Civil   Supplies   sent   a   report<\/p>\n
to the Private Secretary to the Minister for Food and Civil<\/p>\n
Supplies   pointing   out   that   certain   lapses   were   found<\/p>\n
committed during the tenure of office by the petitioner and<\/p>\n
stringent   action   should   be   taken   against   the   District<\/p>\n
Supply   Officer.     Based   on   the   above   report   the   impugned<\/p>\n
order was passed.\n<\/p>\n
      6.        Counsel   for   the   petitioner   submits   that   the<\/p>\n
petitioner   was   not   informed   of   the   allegations   against   her<\/p>\n
at   any   point   of   time,   and   therefore,   it   is   difficult   to<\/p>\n
believe   that   the   impugned   order   of   transfer   is   based   on<\/p>\n
genuine complaints made by aggrieved persons.\n<\/p>\n
      7.  On going through the files produced, I am unable to<\/p>\n
accept   the   above   contention.     The   complaints   were   received<\/p>\n
in the month of November, and as already found, due enquiry<\/p>\n
was   conducted   through   the   Director   of   Civil   Supplies   and<\/p>\n
only   after   getting   the   report   from   the   Director   of   Civil<\/p>\n

Supplies,   orders   were   passed   directing   to   transfer   the<\/p>\n
petitioner   from   the   present   station.     It   cannot   therefore<\/p>\n
be   contended   that   the   statements   made   in   the   counter<\/p>\n
affidavit   that   complaints   containing   allegations   against<\/p>\n
the   petitioner   were   received   have   no   factual   basis   or   that<\/p>\n
the order of transfer does not involve any public interest.\n<\/p>\n
The   relevant   files   very   clearly   show   that   public   interest<\/p>\n
has   been   given   due   importance   and   the   Government   have   done<\/p>\n
what   is   required   to   be   done   according   to   law.     I   find   no<\/p>\n
error   or   infirmity   in   the   impugned   order.     Writ   petition<\/p>\n
fails.  Dismissed.\n<\/p>\n
