This Court thereafter granted the interim<\/p>\n<p>protection to the petitioners subject to their joining the investigation<br \/>\n<span class=\"hidden_text\"> Crl.Misc.No.M-5488 of 2008 (O&amp;M)                 -2-<\/span><\/p>\n<p>and also directed them to join the investigation on 15.3.2008 at 10<\/p>\n<p>a.m.\n<\/p>\n<p>            It transpires from the record that despite the orders of this<\/p>\n<p>Court the petitioners had been arrested by SI Gurmit Singh<\/p>\n<p>whereupon this Court was constrained to order an inquiry into the<\/p>\n<p>matter    which was conducted by Chief Judicial Magistrate,<\/p>\n<p>Gurdaspur, who concluded that the petitioners had been arrested in<\/p>\n<p>breach of the order granted by this Court.\n<\/p>\n<p>            On 3.9.2009 the matter was referred to a Division Bench<\/p>\n<p>as the Court was convinced that prima facie SI Gurmit Singh had<\/p>\n<p>committed a criminal contempt and he was liable to be proceeded<\/p>\n<p>under Section 18(1) of the Contempt of Courts Act, 1971.<\/p>\n<p>            Learned counsel for the petitioners contended that in so<\/p>\n<p>far as the prayer under Section 438 Cr.P.C. is concerned that may be<\/p>\n<p>answered in favour of the petitioners for the reason that they have<\/p>\n<p>joined the investigation to the satisfaction of the Investigating Officer<\/p>\n<p>which fact has not been controverted by the learned counsel for the<\/p>\n<p>State on instructions from HC Balwinder Singh.<\/p>\n<p>            Having regard to the aforesaid when the petitioners have<\/p>\n<p>joined the investigation to the satisfaction of the Investigating Officer<\/p>\n<p>and noticing the contentions which have been raised by the learned<\/p>\n<p>counsel for the petitioners that initially they had been granted the<\/p>\n<p>concession of bail but subsequently on the addition of offence under<\/p>\n<p>Section 308 IPC to the already existing offences arrayed against the<\/p>\n<p>them and which concession the petitioners have not abused, I am of<\/p>\n<p>the considered opinion that the present petition deserves to be<br \/>\n<span class=\"hidden_text\"> Crl.Misc.No.M-5488 of 2008 (O&amp;M)                -3-<\/span><\/p>\n<p>accepted.\n<\/p>\n<p>             Consequently, the interim directions dated 4.3.2008 are<\/p>\n<p>hereby made absolute till the filing of the challan subject to the<\/p>\n<p>condition that the petitioners continue to comply with the provisions<\/p>\n<p>of Section 438(2) Cr.P.C.\n<\/p>\n<p>             In so far as the matter regarding initiation of proceedings<\/p>\n<p>under the Contempt of Courts Act are concerned, the office is directed<\/p>\n<p>to number the petition as Criminal Contempt Petition and post the<\/p>\n<p>matter before the Division Bench for appropriate proceedings.<\/p>\n<p>             Disposed of.\n<\/p>\n<p>             Pending Crl.Misc. also stand disposed of.\n<\/p>\n<\/p>\n<pre>14.12.2009                                 (MAHESH GROVER)\n                                              JUDGE\ndss\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Amrik Singh And Others vs State Of Punjab on 14 December, 2009 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Crl.Misc.No.M-5488 of 2008 (O&amp;M) Date of decision : 14.12.2009 Amrik Singh and others &#8230;.Petitioners Versus State of Punjab &#8230;Respondent CORAM : HON&#8217;BLE MR.JUSTICE MAHESH GROVER &#8230;.
