Mr.P.S.Sethuraman\n\t\t     S.C for E.P.F\n\n:ORDER\n<\/pre>\n<p>\tThe petitioner has approached this Court with a prayer for issuance of a<br \/>\nWrit in the nature of Certiorari, to quash the recovery proceedings  of the<br \/>\ndamages  assessed under Section 14-B of the Employees Provident Fund Act.\n<\/p>\n<p>\t2.  The Assistant Provident Fund Commissioner vide order dated 10.07.2008,<br \/>\nimposed damages to the tune of Rs.93,847\/-(Rupees Ninety three thousand eight<br \/>\nhundred and fourty seven only) under Section 14-B of the Employment Provident<br \/>\nFund Act. The petitioner being aggrieved by the order passed by the Assistant<br \/>\nProvident Fund Commissioner filed an appeal before the Employees Provident Fund<br \/>\nAppellate Tribunal, New Delhi on 05.09.2008, which is said to be pending, along<br \/>\nwith application for stay of impugned order. The petitioner therefore approached<br \/>\nthis Court to challenge the recovery proceedings pending the appeal, on the<br \/>\nground that in case, the recovery proceedings are not stayed and coercive<br \/>\nmethods are allowed to effect recovery, the very object of filing an appeal<br \/>\nwould be lost.\n<\/p>\n<p>\t3. It is the contention of the learned counsel for the petitioner, that<br \/>\ninspite of the fact that an appeal was filed in the year 2008, till date no<br \/>\ndecision on the stay petition has not been taken by the  learned Employees&#8217;<br \/>\nProvident Fund Appellate Tribunal, New Delhi.\n<\/p>\n<p>\t4. This Court on 08.09.2007 passed  the following order:\n<\/p>\n<p>\t&#8220;Interim stay, subject to the condition that the petitioner deposits a sum<br \/>\nof Rs.20,000\/-(Rupees twenty thousand only) to the credit of the first<br \/>\nrespondent within a period of four weeks, failing which the interim stay granted<br \/>\nshall stand automatically vacated, without any further reference to this Court.<br \/>\nNotice.\n<\/p>\n<p>\tMr.Sethuraman, learned Standing Counsel for EPF takes notice on behalf of<br \/>\nthe respondents.&#8221;\n<\/p>\n<p>\t5. After hearing the learned counsel for the petitioner, and keeping in<br \/>\nview the fact that the application for stay is pending before the Employees&#8217;<br \/>\nProvident Fund Appellate Tribunal, New Delhi, this Writ Petition is disposed of,<br \/>\nby directing the Employees&#8217; Provident Fund Appellate Tribunal, New Delhi to<br \/>\ndispose of the pending stay application, after giving an opportunity of hearing<br \/>\nto the petitioner, within two months of the date of receipt of a certified copy<br \/>\nof this order.  Till the disposal of the pending stay application by the learned<br \/>\nEmployees&#8217; Provident Fund Appellate Tribunal, New Delhi, stay already granted<br \/>\nshall continue.\n<\/p>\n<p>\t6.
