No.121 of<br \/>\n1996 has approached this Court under Article 227 of the Constitution<br \/>\nof India, challenging the award impugned dated 28.1.2009 passed by<br \/>\nthe Presiding Officer, Labour Court, Junagadh, Camp at Porbandar<br \/>\nrejecting the said Reference for the reasons stated thereunder.\n<\/p>\n<p>2.<br \/>\nThe workman had to raise industrial  dispute as his services came to<br \/>\nbe terminated in the year 1986 without any rhyme or reason or without<br \/>\ncomplying with the provisions of the Industrial Disputes Act,1947.<br \/>\nHowever, he was reemployed on 17.11.1986 on daily wage basis and on<br \/>\n20.10.1995 his services were terminated without any due procedure of<br \/>\nlaw. This termination being illegal, the dispute was raised which was<br \/>\nreferred to the competent Court wherein it was marked as reference<br \/>\nstated hereinabove. The Court after recording the reasons with regard<br \/>\nto employee&#8217;s inability to establish that he had worked for 240 days,<br \/>\nrejected the same and being dissatisfied with the said judgment and<br \/>\naward, the present petitioner has approached this Court by filing<br \/>\nthis petition under Article 227 of the Constitution of India.\n<\/p>\n<p>3.\tMs.\n<\/p>\n<p>Trusha Mehta, learned advocate for the workman, relying upon the<br \/>\nprovisions of Sections 25B, 25F of the Industrial Disputes Act, 1947<br \/>\nand the decision of the Supreme Court in the case of <a href=\"\/doc\/794165\/\">Workmen of<br \/>\nAmerican Express International Banking Corporation vs. Management of<br \/>\nAmerican Express International Banking Corporation<\/a> reported in (1985)<br \/>\n4 SCC 71, especially in paras 2 and 5, contended that the operation<br \/>\nof law, as extended on the statute book, makes it incumbent upon the<br \/>\nauthorities to count the days on which the workman could not work on<br \/>\naccount of either it being public holiday or for any reason<br \/>\npreventing the workman from discharging his duty despite his desire<br \/>\nto work and if that is accepted, then looking to the Annexure-I, the<br \/>\nworkman is said have completed the period of 240 days to attract the<br \/>\nprovisions of Section 25F of the Industrial Disputes Act,1947 and<br \/>\nnon-compliance therewith would result into order of reinstatement<br \/>\nwith appropriate relief of backwages.\n<\/p>\n<p>4.\tShri Soni,<br \/>\nlearned Assistant Government Pleader submitted that even as the<br \/>\nformula suggested under Section 25 is taken into consideration, then<br \/>\nalso the workman has not completed 240 days as could be seen from the<br \/>\ndecision  of American Express International<br \/>\nBanking Corporation (Supra). In the peculiar facts and<br \/>\ncircumstances of the case, the fact remains to be noted that the law<br \/>\nwith regard to establishing the workman&#8217;s completion of 240 days is<br \/>\nnow clear. Initially, the burden of establishing<br \/>\ncompletion of 240 days is on the part of the workman. In<br \/>\nthe instant case, looking to the order impugned, it can well be said<br \/>\nthat the Labour Court has not committed any error in concluding that<br \/>\nif the foundation is not led in the pleadings for a particular<br \/>\nsubmission, then that submission, which has bearing upon the factual<br \/>\naspect, could not be examined even at the Court of first instance,<br \/>\nmuch less at the hearing of the petition filed before this Court<br \/>\nunder Article 227 of the Constitution of India. This Court needs to<br \/>\nbe mindful of the fact that the petition is filed under Article 227<br \/>\nof the Constitution of India and therefore, the same is to be viewed<br \/>\nfrom the restrictions inherent under the exercise of jurisdiction<br \/>\nunder Article 227 of the Constitution of India. Hence, the order<br \/>\nimpugned may not be interfered with, as in the instant case, the<br \/>\nfindings recorded is based upon the pleadings and material available.<br \/>\nThis Court would not like to enter into the merits of the case as the<br \/>\npetition being bereft of merits, deserves rejection and is<br \/>\naccordingly rejected.
