SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/02\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>RULE.\n<\/p>\n<p>\tMr.Nikunt Raval, learned Assistant<br \/>\n\tGovernment Pleader waives the service of notice of rule on<br \/>\n\tbehalf of the respondents.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocates appearing on behalf of the<br \/>\n\trespective parties and in the facts and circumstances of the case,<br \/>\n\tpresent application is taken up for final hearing today.\n<\/p>\n<p>Present<br \/>\n\tapplication has been preferred by the applicants  &#8211; original<br \/>\n\tpetitioners<br \/>\n\tto restore the main Special Civil Application which<br \/>\n\tcame to be dismissed for non-prosecution on non-removal of the<br \/>\n\toffice objections.\n<\/p>\n<p>Mr.Apurva<br \/>\n\tDave, learned advocate appearing on behalf of the applicants has<br \/>\n\tsubmitted that the office objections shall be removed on or before<br \/>\n\t15\/2\/2010.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, present application is<br \/>\n\tallowed and the main Special<br \/>\n\tCivil Application is restored to file. The applicants<br \/>\n\tare granted time upto 15\/2\/2010 to remove the office objections. If<br \/>\n\tby 15\/2\/2010  office objections are not removed, the main Special<br \/>\n\tCivil Application  shall again be dismissed for<br \/>\n\tnon-prosecution without referring the matter to the Court. On<br \/>\n\tremoval of the office objections on or before 15\/2\/2010,the registry<br \/>\n\tis directed to notify main Special<br \/>\n\tCivil Application on 17\/2\/2010.
