                                  2. The writ petitioners are belonging to both<\/p>\n
                      the groups, some are from the family of land oustees,
\n                      7<\/span><\/p>\n
that is, those whose lands were acquired by the State<\/p>\n
for National Thermal Power Corporation Limited<\/p>\n
(NTPC for brevity) for establishing Kahalgaon<\/p>\n
Thermal Power project, and some are outsiders. They<\/p>\n
are aggrieved by selection and appointment of 101<\/p>\n
persons in W\/3 grade posts.\n<\/p>\n
           3.      The writ court has interfered with<\/p>\n
selection and appointment on two grounds. Firstly, on<\/p>\n
the ground that the method for calling applications was<\/p>\n
only through employment exchange which in the<\/p>\n
opinion of the writ court was not sufficiently fair and<\/p>\n
should have been through newspaper advertisement<\/p>\n
also. Secondly, the plea of the writ petitioners that<\/p>\n
there should not have been 100 % reservation in favour<\/p>\n
of land oustees has also found favour with the writ<\/p>\n
court.\n<\/p>\n
           4. Learned counsel for the NTPC submitted<\/p>\n
that pursuant to policy for accommodating land oustees<\/p>\n
framed in the year 1986, earlier recruitment was made<\/p>\n
through employment exchange only and hence, the<\/p>\n
impugned        selection   process   was   also   through
\n                    8<\/span><\/p>\n
employment exchange. It was further submitted that<\/p>\n
policy itself permits filling up posts of settlees through<\/p>\n
employment exchange also. Same stand has been taken<\/p>\n
on behalf of the appointees whose appointments have<\/p>\n
been challenged by the writ petitioners.\n<\/p>\n
          5.   Learned counsels for the NTPC as well<\/p>\n
as the appointees have also questioned the decision of<\/p>\n
the writ court on the ground of reservation up to 100 %<\/p>\n
as not being permissible. It has been submitted that the<\/p>\n
posts available in the present instance have been<\/p>\n
earmarked      only    for   land    oustees    on    the<\/p>\n
recommendation of a Committee of Parliament by way<\/p>\n
of special drive so that the local people whose lands<\/p>\n
were acquired may not feel dissatisfied and may not<\/p>\n
unnecessarily attempt to interrupt the work of the<\/p>\n
NTPC. It was pointed out that 100% reservation or any<\/p>\n
reservation beyond 50% is not permitted on account of<\/p>\n
judgements of the Supreme Court which have clarified<\/p>\n
that under Article 16 (4) of the Constitution of India<\/p>\n
inadequacy of representation can be a good ground for<\/p>\n
providing reservation only up to 50%. In the present
\n                     9<\/span><\/p>\n
case, it was pointed out that the issue of reservation<\/p>\n
under Article 16 is not involved at all and the only<\/p>\n
issue to be seen is whether the land oustees constitute a<\/p>\n
special class for whom special policy can be envisaged<\/p>\n
and implemented.\n<\/p>\n
            6. Learned counsels for the writ petitioners<\/p>\n
have supported the judgement of the writ court on both<\/p>\n
the aforesaid issues.\n<\/p>\n
            7. Having considered the rival submissions<\/p>\n
as well as the main issue involved in these cases, we<\/p>\n
are of the considered view that the writ court has<\/p>\n
correctly    held   that   in   absence   of   newspaper<\/p>\n
advertisement, the requirement of notice to all eligible<\/p>\n
persons will not be fully satisfied. This view has been<\/p>\n
supported by the judgement of the Supreme Court in<\/p>\n
the case of Excise Superintendent, Malkapatnam Vs.<\/p>\n
K. B. N. Vishweshwara Rao (1996) 6 SCC 216. In<\/p>\n
that judgement the Supreme Court held that restricting<\/p>\n
the selection only to the candidates sponsored by<\/p>\n
employment exchange was not proper; in addition to<\/p>\n
requisitioning the names from employment exchange,
\n                      10<\/span><\/p>\n
names should also be called for by publication in<\/p>\n
newspapers or, if required, even by announcing on<\/p>\n
radio and television etc. The special category of land<\/p>\n
oustees, after a lapse of 25 years, may be scattered<\/p>\n
even outside the district of Bhagalpur and, hence, in<\/p>\n
our view, in the facts of the case, requisition only<\/p>\n
through employment exchange was not sufficient. The<\/p>\n
direction of the writ court to NTPC to give opportunity<\/p>\n
to   other    eligible    persons   by advertisement    in<\/p>\n
newspapers, in our view, is in accordance with<\/p>\n
requirements of Articles 14 and 16 of the Constitution<\/p>\n
of India. Hence, we uphold that part of the judgement<\/p>\n
of the writ court.\n<\/p>\n
             8. So far as issue of limiting the available<\/p>\n
101 vacancies only to 50 % for land oustees is<\/p>\n
concerned, we find sufficient merit in the submissions<\/p>\n
advanced on behalf of NTPC and the appointees that<\/p>\n
the policy decision to give opportunity of employment<\/p>\n
to eligible land oustees in respect of presently available<\/p>\n
101 vacancies does not amount to reservation in terms<\/p>\n
of Article 16 (4) of the Constitution of India. It is a
\n                   11<\/span><\/p>\n
policy decision in order to compensate for the loss<\/p>\n
which the land oustees have suffered and, hence, they<\/p>\n
are clearly a special class for which a special policy<\/p>\n
decision can be formulated. Such policy decision, in<\/p>\n
our view, cannot be treated as reservation on the lines<\/p>\n
of reservation provided to backward classes on account<\/p>\n
of non representation in a particular service. Hence, in<\/p>\n
our view, restriction of 50% by treating the policy to be<\/p>\n
a policy of reservation is not applicable and not<\/p>\n
justified. Hence, this decision of the writ court on this<\/p>\n
issue is set aside. As a result the NTPC will be entitled<\/p>\n
to issue further advertisement in newspapers so as to<\/p>\n
give opportunity of making applications to eligible<\/p>\n
land oustees for filling up 101 posts of W\/3 grade as<\/p>\n
per prevailing practice and policy meant for land<\/p>\n
oustees. This exercise should be done expeditiously,<\/p>\n
preferably, within four months. Cases of those who<\/p>\n
were earlier appointed but whose selection and<\/p>\n
appointments have been declared illegal, shall also be<\/p>\n
considered afresh in accordance with law along with<\/p>\n
those who may apply in response to newspaper
\n                           12<\/span><\/p>\n
        advertisements.\n<\/p>\n
                  The judgement and order under appeal is<\/p>\n
        modified to aforesaid extent. All the appeals are<\/p>\n
        disposed of accordingly.\n<\/p>\n
