 Coeporation has entered appearance and has \ufb02ied<\/p>\n

themselves are whotiy responsible for the accident inasmuch<\/p>\n

as they were coming in a rash and negligence manner.
\nHence, the negligtmce cannot be attributed tojhthe
\nCorporation. They would also contend
\nrespondent before the Tribunal was not the  u V’

  .\u00ab _\u00a3jie:1ee, the rash and negligence cannot be attributed to the<\/p>\n

Tribunal has grossly erred in awarding compensation under \ufb02<\/p>\n

submits that evidence on record    u ” u

\n\ufb01xed albeit with a delay ‘\u00a323.58    VA<\/p>\n
6. We-.1iaveV ‘ ..judgment and awarci passed by<\/p>\n
the  ‘\u00a73:1_ ‘V\u00a3.hc–._  instance, we are required to<\/p>\n
 \u00ab–.exa\u00a3n__C1f.1e_..fd’1e actii\u00e9ni-;!:.>–ie negligence inasmuch as that was<\/p>\n
  by the Coxpora\ufb01on. Indeed it has to be<\/p>\n
n\u00e9ticed the statement of objectimas, the Corpora\ufb01on<\/p>\n
‘ehhas  that the bu\ufb02eck cart was going ahead of the<\/p>\n
  driver was examine\u00e9 as RW-} and he states that<\/p>\n
‘  fcguar perstms were coming on four motor bikes in the<\/p>\n

‘   This takes us to the determination of compensation in<\/p>\n
 M.F’.A.No.1SO8\/1998. Indeed, Mr.K}1annur is right in<\/p>\n
submitting that the Tzibunal was not justi\ufb01eci in aWam <\/p>\n
compensation for paia and su\ufb02ering for each iZI1_]-1}.I”y;,”:.’!”T.h{“:<\/p>\n
total amount awazded for pain and su\ufb01ering is  <\/p>\n
We are eonstrajned to note that the learned    <\/p>\n
Tribunal has not awanie\u00e9 any sii3\u00a7teiint._  of<\/p>\n
amenities. Thus, even we are ‘of “the  that the <\/p>\n

circumstances   jiiet and proper. We are of the View<\/p>\n

 _ 9. Tixiis. takes us to the cmss objections \ufb01led by the<\/p>\n
  M.F.A.No.i2519\/2000. Since we are of the View<\/p>\n
  ‘thVai’ \ufb01ie compensa\ufb01on is just anti proper, there is no gcope<\/p>\n
  .fef any further enhancement. We also note that there is<\/p>\n
 inordinate delay of more than 800 (33378 ix: \ufb01ling the cross<\/p>\n
abjection. In\u00e9eed, the courts can be iiberal in cases of
\n\/<\/p>\n
