According to him<br \/>\nthere is no provision in Civil Procedure Court to consolidate the<br \/>\ndarkhast applications. He has placed reliance on the following<br \/>\ndecisions:\n<\/p>\n<p>\t(i)<br \/>\n Ganeshdas and anothers vs. Ramesh Chandra and another<br \/>\nreported in AIR 2002 Rajasthan 341.\n<\/p>\n<p>\t(ii)<br \/>\n M\/s.Anurag &amp; Co. and another vs. Addl. District Judge and others<br \/>\nreported in AIR 2006 Rajasthan 119.\n<\/p>\n<p>3.<br \/>\n It is an admitted fact that while deciding different land reference<br \/>\ncases preferred by different claimants, the Reference Court has<br \/>\nrecorded evidence in one reference case and passed a common award in<br \/>\nrespect of all different reference cases.  It is also pertinent to<br \/>\nnote that whenever the award is passed, the Court is duty bound to<br \/>\ndraw bill of costs as per each reference.  No decree is ever drawn<br \/>\nwhen award is passed by the Reference Court, and as per the provision<br \/>\nof Civil Procedure Code, bill of costs is only drawn when the award<br \/>\nis passed.\n<\/p>\n<p>4.<br \/>\n Learned advocate for the claimants preferred an application before<br \/>\nthe Executing Court for consolidating all the darkhast applications<br \/>\nas they are arising out of  common award passed by the Reference<br \/>\nCourt. The trial court, after giving an opportunity to both the<br \/>\nparties, passed the order  consolidating all the darkhast<br \/>\napplications  in view of the fact that the relief sought for in each<br \/>\nexecution petition is  also similar  and the parties are also same.<br \/>\nThere is no patent illegality or error of jurisdiction committed by<br \/>\nthe trial court while consolidating all the darkhast applications.<br \/>\nMoreover, the aforesaid decisions relied upon by the   learned<br \/>\nadvocate for the petitioner are also not helpful to the case of the<br \/>\npetitioner as facts of those reported cases are totally different<br \/>\nfrom the facts of the present case.  In view of the same, I do  no<br \/>\nfind any substance in the petition and hence  the petition is<br \/>\nsummarily dismissed with no order as to costs.
