Earlier, the petitioners were before this Court by way<br \/>\nof Special Civil Application No.2160 of 2008, which was disposed of<br \/>\nby this Court by an order dated 5th February 2008.  The<br \/>\nrelevant part of the order reads as under:\n<\/p>\n<p> 5.<br \/>\n       This petition is accordingly disposed of with a direction that<br \/>\nif the petitioners make a representation to the respondents No.2 and<br \/>\n3 and also to Essar Steel Limited within one week from today, the<br \/>\nrespondents shall not remove  the petitioners&#8217; cabins till 15th<br \/>\nMarch, 2008  in order to enable the petitioners to pursue their<br \/>\nrepresentations with Essar Steel Limited and the above-named<br \/>\nauthorities.\n<\/p>\n<p>\t\tDirect service is<br \/>\npermitted.\n<\/p>\n<p>2.\tAn affidavit is<br \/>\nfiled by one Mr.Dharmesh K. Patel, Mamlatdar, Chorasi,  wherein in<br \/>\npara 4(g) it is stated as under:\n<\/p>\n<p> That pursuant to<br \/>\nthe order dated 05.02.2008, passed by this Hon&#8217;ble Court, all the<br \/>\nrespondents had considered the representation made by the<br \/>\npetitioners.  It is submitted that on 12.02.2008 the management of<br \/>\nEssar Steel Ltd. had informed the petitioners that it could not give<br \/>\nalternative accommodation in the premises of the said company. Even<br \/>\nthe Deputy Executive Engineer, National Highway Authority had by its<br \/>\nletter dated 10.03.2008 informed the petitioners that the said matter<br \/>\nwas outside the purview of its authority.  Not only that, but the<br \/>\noffice of the Collector, Surat, had also initiated (sic.) the<br \/>\npetitioners, that  in absence of any policy of the state Govt to give<br \/>\nalternative accommodation to the encroachers, who had placed their<br \/>\ncabins in Highway margin, his office also could not give alternative<br \/>\naccommodation. Accordingly, representation dated 25.02.2008 was<br \/>\nrejected.  Annexed hereto and collectively marked Annexure R-III are<br \/>\nthe intimations rejecting representation made to the Essar Steel<br \/>\nLtd., National Highway Authority &amp; Collector, Surat<br \/>\nrespectively.\n<\/p>\n<p>3.\tLearned advocate<br \/>\nMr.S.P. Majmudar submitted that the representation made by the<br \/>\npetitioners is not rejected by the authorities in so many words by<br \/>\npassing any specific order and therefore, the respondents be<br \/>\nrestrained from removing the cabins of the petitioners. The authority<br \/>\nhas placed on record communications  dated 28th November<br \/>\n2006, 22nd February 2007,  and 12th March 2008.<br \/>\n The communication dated 12th March 2008 is<\/p>\n<p>from Essar Steel<br \/>\nLimited addressed to petitioner no.1.  The case of the petitioners is<br \/>\nthat the petitioners are catering to the needs of the employees of<br \/>\nMessrs Essar Steel Limited.  This is controverted by respondent no.4.\n<\/p>\n<p>4.\tMr.Sanjay<br \/>\nAgarwalla, Son of Mr.Jugalkishore Agarwalla, Legal Officer with<br \/>\nrespondent no.4-Messrs Essar Steel Limited has also filed an<br \/>\naffidavit and has stated as under:\n<\/p>\n<p> 5.\tI state that<br \/>\nthis Hon&#8217;ble Court in the said order has observed that if the<br \/>\npetitioners make a representation to the management of Essar Steel<br \/>\nLtd   respondent no.4 herein and also Deputy Executive Engineer,<br \/>\nNHAI, Sub-divisioin, Bardoli and Collector, Surat, so that respondent<br \/>\nno.4 and above named authorities can look into the matter and find<br \/>\nout a viable solution to the problem being faced by the petitioners<br \/>\non account of removal of this cabins.\n<\/p>\n<p>Messrs Essar Steel<br \/>\nLimited has rejected the representation of the petitioners by its<br \/>\ncommunication dated 12th March 2008.\n<\/p>\n<p>5.\tAt this juncture,<br \/>\nthe learned advocate for the petitioners submitted that while issuing<br \/>\nnotice on 14th March 2008 in the present petition, the<br \/>\nCourt restrained the respondents from removing the petitioners&#8217; cabin<br \/>\ntill the returnable date, i.e. 15th April 2008.  The<br \/>\nlearned advocate submitted that interim relief is continuing till<br \/>\ndate and same can be continued for some reasonable time.  Having<br \/>\nfound no substance in the petition, the request cannot be acceded to<br \/>\nand the same is declined.\n<\/p>\n<p>6.\tThe petition having<br \/>\nfound no substance is not entertained and the same is dismissed.<br \/>\nNotice is discharged.
