Justice J.M.JAMES\n\n Dated :12\/09\/2006\n\n O R D E R\n                           J.M.JAMES, J.\n\n                              --------------\n\n                          B.A. 5381\/2006\n\n                            ------------------\n\n DATED THIS THE 12TH DAY OF SEPTEMBER, 2006\n\n\n\n\n                              O R D E R\n<\/pre>\n<p>             The   petitioner   is   before   this     Court,   under<\/p>\n<p>Section   439   Cr.P.C.,   as   the   fourteenth   accused   in   crime<\/p>\n<p>No.167\/2006   of   Iritty   Police   Station,   for   the   offence<\/p>\n<p>punishable under Sections 143, 147, 148 and 302 IPC read<\/p>\n<p>with Section 149 IPC and also under Section 3 and 5 of the<\/p>\n<p>Explosive Substance Act and 27(1) of the Indian Arms Act.<\/p>\n<p>      2.     On   two   occasions,     the   petitioner   was   granted<\/p>\n<p>bail,   as per the order dated 19.7.2006 and 16.8.2006,   in<\/p>\n<p>connection with the cremation of his father as well as the<\/p>\n<p>40th day obituary ceremonies connected with the demise of<\/p>\n<p>his   father.     He   was   arrested   on   3.7.2006.     Except   those<\/p>\n<p>nineteen   days,   when   he   was   on   bail,     he   is   in   judicial<\/p>\n<p>custody for the last 52 days.\n<\/p>\n<\/p>\n<p>      3.     The   learned   counsel   submitted   that   the<\/p>\n<p>petitioner is under police protection because of the order<\/p>\n<p>of   the   Government,     as   he   had   been   the   worker   of   the<\/p>\n<p>B.A.5381\/2006<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>R.S.S   and   the   Hindu   Iykya   Vedi.     The   offence   alleged<\/p>\n<p>against him is more so under Section 120B IPC,  despite<\/p>\n<p>the   other   sections   of   the   offence.     It   is   also   submitted<\/p>\n<p>that the petitioner is a person, who is running a parallel<\/p>\n<p>college at Iritty.\n<\/p>\n<\/p>\n<p>       4.     The   learned   Public   Prosecutor,       however,<\/p>\n<p>submitted that there  is  a tension  in  the  locality  and  the<\/p>\n<p>petitioner being an important person  in the organisation<\/p>\n<p>of R.S.S., as well as Hindu Iykya Vedi, the release of the<\/p>\n<p>petitioner   may   adversely   affect   the   situation     in   the<\/p>\n<p>locality.     The   prosecution   further   submitted   that   the<\/p>\n<p>petitioner   may   not   be   allowed   to   enter   the   Sessions<\/p>\n<p>division of Kannur   for sometime.<\/p>\n<p>       5.     After   hearing     the   submissions,   in   detail,<\/p>\n<p>made     by   either   side,       I   grant   bail     and   release   the<\/p>\n<p>petitioner from jail, subject to the following conditions:-<\/p>\n<blockquote><p>             (a).    The   petitioner   shall   execute   a  bond<\/p>\n<p>             for Rs.25,000\/-, with two solvent sureties,<\/p>\n<p>             each   for  the   like   sum,  to  the   satisfaction<\/p>\n<p>             of   the   Judicial   Magistrate   of   First   Class,<\/p>\n<p>             Mattannur.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>B.A.5381\/2006<\/p>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>           (b).    Immediately          on         release,         the<\/p>\n<p>           petitioner   shall   report   before   the<\/p>\n<p>           Investigating   Officer   of   Iritty   police<\/p>\n<p>           Station,        who   is   investigating   crime<\/p>\n<p>           No.167\/2006, and from there  he  shall  go<\/p>\n<p>           out of the sessions division of Kannur.<\/p>\n<p>           (c).    The   petitioner   shall   not   enter   the<\/p>\n<p>           sessions division of Kannur,   for a period<\/p>\n<p>           of three months.\n<\/p>\n<\/p>\n<p>           (d).    The   petitioner   shall   furnish   the<\/p>\n<p>           address   of   his   residence   to   the<\/p>\n<p>           Investigating Officer of the nearest police<\/p>\n<p>           station,     within   which   limit   he   would<\/p>\n<p>           reside   for   the   above   period   of   three<\/p>\n<p>           months.\n<\/p>\n<\/p>\n<p>           (e).    The   petitioner   shall   report   before<\/p>\n<p>           the S.H.O of the police station,  where he<\/p>\n<p>           would  reside for the above said period.<\/p>\n<p>           (f).
