03.   17.09.2010             Lower Court Records has been received.<\/p>\n
                             The appellant, Rama Roy has been convicted for<\/p>\n
                   the offence, punishable under section 302 of the IPC. The<\/p>\n
                   occurrence is of the year 1992.\n<\/p>\n
                             Counsel for the appellant submits that out of<\/p>\n
                   thee witnesses, examined by the prosecution, the evidence<\/p>\n
                   of all three witnesses on the manner of occurrence, place<\/p>\n
                   of occurrence and the assailant of the deceased is<\/p>\n
                   different. None of them has corroborated the evidence of<\/p>\n
                   others.\n<\/p>\n
                             Considering this fact and also the fact that the<\/p>\n
                   appellant has remained in custody for four years and some<\/p>\n
                   months, the prayer for bail on behalf of the appellant,<\/p>\n
                   namely, Rama Roy is allowed. During pendency of the<\/p>\n
                   appeal, the above-named appellant is directed to be<\/p>\n
                   released on bail on furnishing bail bond of Rs. 10,000\/-<\/p>\n
                   (ten thousand) with two sureties of the like amount each to<\/p>\n
                   the   satisfaction   of   2nd   Additional   Sessions   Judge,<\/p>\n
                   Darbhanga in Sessions Trial No. 163A of 1993 \/ G. R. No.<\/p>\n
                   249 of 1992.<\/p>\n
