Mr.H.L.\n<\/p>\n<p>\tJani, learned Additional Public Prosecutor, waives service of Rule<br \/>\n\ton behalf of the respondent-State.\n<\/p>\n<p>Heard Mr.Tejas Barot, learned<br \/>\n\tcounsel for the applicants and Mr.H.L. Jani, learned Additional<br \/>\n\tPublic Prosecutor for the respondent-State.\n<\/p>\n<p>Today this Court has admitted the<br \/>\n\tappeal filed by the applicants-original accused against the judgment<br \/>\n\tand order of conviction and sentence dated 30th December<br \/>\n\t2010 passed by the learned Special Judge, Anand, in Special (S.C. \/<br \/>\n\tS.T.) Case No.27 of 2009. The applicants-accused are on bail at<br \/>\n\tpresent. Amount of fine is already paid by the applicants-accused.<br \/>\n\tThe learned Judge by his judgment and order dated 30th<br \/>\n\tDecember 2010 convicted the applicants under Section 323 and 114 of<br \/>\n\tthe Indian Penal Code and ordered to undergo six months simple<br \/>\n\timprisonment and also imposed fine of Rs.500\/-, and in default of<br \/>\n\tpayment of fine, ordered to undergo simple imprisonment for a<br \/>\n\tfurther period of 15 days. The learned Judge has also convicted the<br \/>\n\tapplicant No.3 under Section 3(1)(10) of the Scheduled Castes and<br \/>\n\tScheduled Tribes (Prevention of Atrocities) Act and ordered to<br \/>\n\tundergo simple imprisonment for a period of one year and also<br \/>\n\timposed fine of Rs.500\/-, and in default of payment of fine, ordered<br \/>\n\tto undergo simple imprisonment for a further period of 15 days.\n<\/p>\n<p>In<br \/>\n\tview of above facts and circumstances of the case emerging from the<br \/>\n\trecord and in view of the fact that the applicants are on bail at<br \/>\n\tpresent and the applicants have paid the amount of fine, present<br \/>\n\tapplication is hereby allowed. The substantive sentence is hereby<br \/>\n\tplaced under suspension pending hearing and disposal of the main<br \/>\n\tappeal and the applicant-original accused are hereby ordered to be<br \/>\n\treleased on bail.\n<\/p>\n<p>Looking<br \/>\n\tto the facts of the case, I am of the opinion that this is a fit<br \/>\n\tcase to suspend the sentence awarded to the applicants. Hence, the<br \/>\n\tpresent application is hereby allowed. The substantive sentence is<br \/>\n\thereby placed under suspension pending hearing and disposal of the<br \/>\n\tmain appeal and the applicants-original accused are hereby ordered<br \/>\n\tto be released on bail on their furnishing surety of Rs.10,000\/-<br \/>\n\teach and a personal bond of the like amount on usual terms and<br \/>\n\tconditions. Rule is made absolute to the aforesaid extent.\n<\/p>\n<p>Direct<br \/>\n\t\t\tService is permitted.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
