\nBasheer, J:\n<\/p>\n
        Appellants who participated in the written test held<\/p>\n
by the Cochin University of Science and Technology on<\/p>\n
August 14, 2010 for selection to the post of Sweeper-Cum-<\/p>\n
Cleaner pursuant to Ext.P1 notification, have filed the writ<\/p>\n
petition alleging that the question paper of the said written<\/p>\n
test had leaked even before the test had commenced.<\/p>\n
Appellants pressed into service Ext.P4 which is stated to be<\/p>\n
a portion of the question paper, and contended that the<\/p>\n
entire process of selection had been vitiated because of the<\/p>\n
above malpractice.          Therefore they prayed before the<\/p>\n
learned single Judge that the written test be declared as<\/p>\n
null and void. The above contention was repelled by the<\/p>\n
learned single Judge and the writ petition was dismissed.<\/p>\n
Hence this appeal.\n<\/p>\n
         2.    It may at once be noticed that appellants<\/p>\n
primarily banked on Ext.P4, to which we have already<\/p>\n
referred to, in support of their contention that the question<\/p>\n
paper had leaked even before the commencement of the<\/p>\n
test. The other material on which the appellants placed<\/p>\n
reliance was on the           “flash news” that was reportedly<\/p>\n
beamed by several channels on electronic media at the time<\/p>\n

\nwhen the test was being held indicating that the question<\/p>\n
paper for the test had already leaked out. Appellants also<\/p>\n
placed reliance on certain newspaper clippings which, of<\/p>\n
course, appeared on the next day after the examination was<\/p>\n
held.\n<\/p>\n
         3. As regards Ext.P4 it may be noticed that it is<\/p>\n
admittedly an excerpt from a text book. The candidates<\/p>\n
were asked to read the passage and answer question Nos.<\/p>\n
21 to 30 in the question booklet. A perusal of the question-<\/p>\n
answer booklet which was produced by the University<\/p>\n
before us would reveal that the candidates were supposed<\/p>\n
to answer 100 questions. Even assuming that Ext.P4, which<\/p>\n
is a truncated portion of the question paper,    had leaked<\/p>\n
out, no significance or importance can be attached to the<\/p>\n
said piece of paper if we may term it as such. As rightly<\/p>\n
noticed by the learned single Judge, the print,  font etc. of<\/p>\n
Ext.P4 did not have any similarity or resemblance to the<\/p>\n
question paper which was produced before the learned<\/p>\n
single Judge.\n<\/p>\n
         4.   We have also perused the question paper<\/p>\n
booklet which is made available for our perusal. If in fact<\/p>\n
the question paper had leaked as alleged by the appellants, it<\/p>\n
would have been available with somebody.           Anyhow<\/p>\n
appellants have not produced the leaked question paper<\/p>\n

\nbefore us. The only material that they have produced is an<\/p>\n
excerpt from a text book which incidentally happens to be a<\/p>\n
passage quoted in the question paper booklet, from which<\/p>\n
the candidates were supposed to answer 10 questions.<\/p>\n
Nothing more nothing less.\n<\/p>\n
         5. Having carefully perused the entire materials<\/p>\n
available on record, we do not find any substance in the<\/p>\n
allegations made by the appellant. We do not deem it<\/p>\n
necessary to refer to the other facile allegations and<\/p>\n
accusations made by the appellants in the writ petition<\/p>\n
which, in our view, do not even warrant any reference,<\/p>\n
leave alone any discussion or consideration. The writ<\/p>\n
petition is totally devoid any merit and it is liable to be<\/p>\n
dismissed with cost. We do so.\n<\/p>\n
          Appellant shall pay a sum of Rs.5,000\/- as cost to<\/p>\n
the University within one month from to day.<\/p>\n
