LTD. - Appellant(s)\n \n\nVersus\n \n\nBHARATBHAI\nNATHABHAI BALDHA THROUGH LEGAL HEIRS DAXABEN &amp; 4 - Defendant(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nAJAY R MEHTA for\nAppellant(s) : 1, \nNone for Defendant(s) : 1 -\n5. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/05\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p> Order<br \/>\nin the Appeal:-\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Ajay Mehta submitted that the learned Tribunal has taken<br \/>\ninto account the future\/prospective income in a claim petition<br \/>\npreferred under Section-163A in which an account of absence of any<br \/>\nevidence regarding income the Tribunal ought to have proceeded on the<br \/>\nbasis of notional income.  He submitted that even after deciding to<br \/>\nproceed on the basis of notional income the Tribunal has also taken<br \/>\ninto account future\/prospective income.  He also submitted that the<br \/>\nTribunal has further committed error while determining the monthly<br \/>\nincome in as much as at one stage the Tribunal held that notional<br \/>\nincome should be treated as Rs.2,500\/- per month whereas subsequently<br \/>\nthe Tribunal has taken into account monthly pay at Rs.4,500\/-.\n<\/p>\n<p>\tThe<br \/>\nsubstance of the appellant&#8217;s objection brings about a situation that<br \/>\nat least so far as determination of notional income at Rs.2,500\/- is<br \/>\nconcerned there is no dispute on side of the appellant and to that<br \/>\nextent the award is not disputed.  On that basis, the undisputed<br \/>\namount would come to about Rs.3,10,000\/-.  Therefore, the challenge<br \/>\nin the appeal is restricted to the balance amount i.e. Rs.4,62,833\/-<br \/>\nminus Rs.3,10,000\/- i.e. Rs.1,52,833\/-.\n<\/p>\n<p>\tIn<br \/>\nthis view of the matter, learned advocate Mr. Mehta seeks leave to<br \/>\namend the appeal memo particularly details regarding the Court fees<br \/>\nand jurisdiction and also to amend the details in the appeal memo<br \/>\nwherever correction may be necessary to clarify that the challenge is<br \/>\nlimited to Rs.1,52,833\/-.\n<\/p>\n<p>\tLeave<br \/>\nto amend the memo of the appeal is granted.\n<\/p>\n<p>\tConsidering<br \/>\nthe aforesaid submissions and objections, Admit.\n<\/p>\n<p> Order<br \/>\nin the Civil Application:-\n<\/p>\n<p>\tRule<br \/>\nreturnable on 23\/6\/2010.  Until then ad interim relief in terms of<br \/>\npara-6(i) on the condition that the applicant-appellant shall deposit<br \/>\nentire awarded amount together with interest and cost on or before<br \/>\n5\/6\/2010.  After the deposit is made, taking into account that sum of<br \/>\nRs.3,10,000\/- with proportionate interest and cost is undisputed<br \/>\namount, learned Tribunal shall allow the claimant no.1 i.e. the widow<br \/>\nof the deceased to withdraw 50% of her share with proportionate cost<br \/>\nand interest as per the apportionment determined in the award i.e.<br \/>\n50% of awarded (undisputed part) amount in her favour and the balance<br \/>\n50% amount shall be invested in fixed deposit with any nationlised<br \/>\nbank in name of claimant no.1 widow of the deceased, however, the<br \/>\nreceipt of the fixed deposit shall be maintained with the Tribunal.<br \/>\nThe said balance amount shall be invested for a period of three years<br \/>\nand interest shall be allowed to be paid to the claimant.  If by the<br \/>\nexpiry of three years period the appeal is not decided, it will be<br \/>\nopen to the claimant to move appropriate application to withdraw<br \/>\nbalance 50% amount.  The release of the invested amount in favour of<br \/>\nthe claimant no.1 widow would be subject to the orders that may be<br \/>\npassed by the Court.\n<\/p>\n<p>\tSo<br \/>\nfar as claimant no.3 i.e. mother of the deceased is concerned, she<br \/>\nhas been awarded 30% of the awarded amount.  The claimant no.3 i.e.<br \/>\nmother of the deceased is also permitted to withdraw 50% of her share<br \/>\nwith appropriate interest and cost awarded to her i.e. 50% of 30% of<br \/>\nthe total awarded (undisputed part) amount.  The balance 50% amount<br \/>\nof her share also shall be invested in fixed deposit with any<br \/>\nnationlised bank in name of claimant no.3 mother of the deceased,<br \/>\nhowever, the receipt of the fixed deposit shall be maintained with<br \/>\nthe Tribunal.  The said balance amount shall be invested for a period<br \/>\nof three years and interest shall be allowed to be paid to the said<br \/>\nclaimant.  If by the expiry of three years period the appeal is not<br \/>\ndecided, it will be open to the said claimant to move appropriate<br \/>\napplication to withdraw said balance 50% amount.  The release of the<br \/>\ninvested amount in favour of the claimant no.3 mother of the deceased<br \/>\nwould be subject to the orders that may be passed by the Court.\n<\/p>\n<p>\tThe<br \/>\nentire amount\/share awarded to the minor claimant shall be invested<br \/>\nin fixed deposit in the name of Nazir of the Court.  The said fixed<br \/>\ndeposit shall be made initially for a period of five years and shall<br \/>\nbe continued to be renewed until he becomes major.
