The<br \/>\ncompromise pursis is produced at page Nos.7 and 8.\n<\/p>\n<p>2.\tThis Court (Coram:\n<\/p>\n<p>M.D. Shah, J.), on  09.03.2011, passed the following order:-\n<\/p>\n<p>&#8220;It is submitted<br \/>\nby Mr.Bhatt, learned Advocate appearing for the applicant &#8211;<br \/>\noriginal accused that matter is settled between the parties and<br \/>\nsettlement terms is placed on record. Original complainant is present<br \/>\nin the Court and is identified by Mr.Bhavik Pandya, learned Advocate<br \/>\nappearing for respondent no.2 &#8211; original complainant. It is<br \/>\nstated by the complainant that as per settlement, he has received the<br \/>\ndue amount from the petitioner as well as Tavera &#8211; Car.\n<\/p>\n<p>In view of above,  Rule<br \/>\nreturnable on 15.03.2011. Ms.C.M.Shah, learned APP waives service of<br \/>\nrule on behalf of respondent no.1. Mr.Bhavik Pandya, learned Advocate<br \/>\nwaives service of rule on behalf of respondent no.2.&#8221;\n<\/p>\n<p>3.\tIn view of the<br \/>\ncompromise pursis and looking to the nature of allegations, the Court<br \/>\nneed not elaborately dwell upon other aspects. Suffice it to say that<br \/>\nnon quashing of the complaint would not entail the desired result and<br \/>\nwould not serve end of justice in any manner. The compromise pursis<br \/>\nshows that the dispute is amicably resolved and, therefore, the<br \/>\ncomplaint impugned in this proceedings is required to be quashed in<br \/>\nthe interest of justice and is accordingly quashed.
