Leave granted.\n<\/p>\n<p>      The appellant-U.P. Jal Nigam was formed under the U.P.<br \/>\nWater Supply  and Sewerage  Act, 1975.\tConsequentially, the<br \/>\npersons working\t in the\t Local Self  Government\t Engineering<br \/>\nDepartment of  U.P.  were  transferred\tto  the\t appellant&#8217;s<br \/>\nadministrative control.\t In exercise  of power under Section<br \/>\n97 of  the  Act,  U.P.Jal  Nigam  Engineers  (Public  Health<br \/>\nBranch)\t  Services    Regulations,    l978    (for    short,<br \/>\n&#8216;Regulations&#8217;)\twere  framed.  Rule  5\tof  the\t Regulations<br \/>\nenvisaged that :\n<\/p>\n<blockquote><p>     &#8220;5.  Keeping   into   consideration<br \/>\n     rules 6,  17  and\t18,  recruitment<br \/>\n     from the following sources:<br \/>\n     (1) Asstt. Engineer;<\/p><\/blockquote>\n<blockquote><p>     A. Direct\trecruitment on the basis<br \/>\n     of\t   result     of     competitive<br \/>\n     examination  or  as  prescribed  in<br \/>\n     part   5\t of   the    rules   for<br \/>\n     recruitment.\n<\/p><\/blockquote>\n<blockquote><p>     But in  case of emergency the Nigam<br \/>\n     can made  recruitment on  the basis<br \/>\n     of interview also.\n<\/p><\/blockquote>\n<blockquote><p>     Note:- Initial  recruitment to  the<br \/>\n     post of  Asstt.  Engineer\twill  be<br \/>\n     made   against    only    temporary<br \/>\n     vacancies.\n<\/p><\/blockquote>\n<blockquote><p>     (2) Junior\t Engineers and computers<br \/>\n     of\t the   former  Local  Self-Govt.<br \/>\n     Department and\/or in the service of<br \/>\n     Jal Nigam\tby  promotion  of  those<br \/>\n     candidates\t  who\t have\trendered<br \/>\n     continuous service\t of ten years in<br \/>\n     the former\t LSGD  and\/or  U.P.  Jal<br \/>\n     Nigam  or\t any  other  department.<br \/>\n     Temporary service\twill be\t counted<br \/>\n     for this  purpose.\t The  candidates<br \/>\n     fulfilling\t these\t conditions  and<br \/>\n     also fall\twithin the ambit of Rule<br \/>\n     16(3) will be considered.<br \/>\n     Note:- The\t details for recruitment<br \/>\n     to the  post of Junior Engineer and<br \/>\n     computer is  given in  condition 1.<br \/>\n     But recruitment  will  be\tdone  in<br \/>\n     such  a   way  that   25%\tof   the<br \/>\n     vacancies are  filled by  promotion<br \/>\n     and the rest by direct recruitment.<br \/>\n     Any relaxation  in this  percentage<br \/>\n     will   be\t permitted   only   when<br \/>\n     suitable\tcandidates    are    not<br \/>\n     available.<\/p><\/blockquote>\n<p>     Rule 10  prescribes that  no person  will be  recruited<br \/>\ndirect in  the civil  side unless he holds a degree in Civil<br \/>\nEngineering or\tits equivalent from recognized university or<br \/>\nhe has\tpassed part  A and  B of AMIE. Clause 6 thereof also<br \/>\nprovides that no person shall be recruited to the mechanical<br \/>\nside on similar conditions. The ratio for direct recruitment<br \/>\nis 75%\tand for\t promotes  25%\tand  while  calculating\t the<br \/>\nvacancies  the\t ratio\tof   25%  for\tpromotes  always  be<br \/>\nmaintained. Rule  10(3) which  is relevant  for the  purpose<br \/>\nenvisages that Computers and Junior Engineers in the service<br \/>\nof former LSGD or Jal Nigam will not be promoted to the post<br \/>\nof Asstt.  Engineering (Civil)\tor (Mechanical)\t under\trule<br \/>\n5(1)(ka)(two) unless  he has passed the condition prescribed<br \/>\nin Rule\t 10(1)\tand  10(2)  of\tthe  Regulations.  The\tnote<br \/>\nappended thereto given liver for relaxation of conditions of<br \/>\nrecruitment  and  can  adopt  any  other  criteria  for\t the<br \/>\nselection and promotion of Junior Engineers and Computers to<br \/>\nthe post  of Assistant\tEngineer. ln  other words,  the note<br \/>\nenabled them  only to relax the rules prescribed for passing<br \/>\nthe qualifying\texamination for\t selection to  the posts  of<br \/>\nAsstt. Engineers.  At this  juncture, we  would observe that<br \/>\nthe rule  runs contrary to the settled service jurisprudence<br \/>\nand the\t law laid  down by  this Court\tand  deleterious  to<br \/>\naugment efficacy  of service and would dry out the source to<br \/>\nimprove excellence  and honest\tservice. However, since note<br \/>\nis not the subject matter of attack, we need not observe any<br \/>\nfurther.\n<\/p>\n<p>     Rule 18 provides the right to promotion which envisages<br \/>\nthat &#8220;For  promotion  to  the  post  of\t executive  engineer<br \/>\nseniority will be the criteria and for promotion if the post<br \/>\nof  Asstt.   Engineer,\tSuperintending\tEngineer  and  Chief<br \/>\nEngineer, the  merit will be the criteria&#8221;. The Jal Nigam in<br \/>\nexercise of  the power of relaxation under the note passed a<br \/>\nresolution on  31.12.1983 that\tit  is\tnot  appropriate  to<br \/>\nchange the  criteria every  time and  it is not necessary to<br \/>\nchange\tthe   basis  on\t  which\t selection   has  been\tmade<br \/>\npreviously.  Therefore,\t the  procedure\t was  reiterated  as<br \/>\nunder:\n<\/p>\n<blockquote><p>     &#8220;The preceding  five  years  annual<br \/>\n     confidential   record    of    each<br \/>\n     candidate\tshall\tbe  perused.  If<br \/>\n     there  are\t  more\tthan  half  good<br \/>\n     entries or entries higher than that<br \/>\n     then   the\t  candidate   shall   be<br \/>\n     considered\t fit   for   selection&#8221;.<\/p><\/blockquote>\n<blockquote><p>     According to  the decision taken by<br \/>\n     the Jal  Nigam in its 62nd meeting,<br \/>\n     the  condition   of   passing   the<br \/>\n     qualifying\t    examination\t     for<br \/>\n     candidates eligible  upto\t31.12.83<br \/>\n     has been  relaxed and  instead  the<br \/>\n     condition of gradation on the basis<br \/>\n     of service\t records has  been  made<br \/>\n     the basis\tfor promotion.\tIn order<br \/>\n     to\t   determine\t merits,     the<br \/>\n     confidential  entries  of\tall  the<br \/>\n     candidates falling\t within the zone<br \/>\n     of\t consideration\t be  scrutinized<br \/>\n     even though their integrity has not<br \/>\n     been certified.&#8221;<\/p><\/blockquote>\n<p>     18 vacancies of Assistant Engineers have arisen and the<br \/>\nerstwhile officers  from LSGD  or those\t appointed under the<br \/>\nNigam have  been considered  for promotion  from  25%  quota<br \/>\nreserved for  inservice\t candidates.  Under  the  resolution<br \/>\nNo.502, dated  19.5.1983, it  was  resolved  that  10  years<br \/>\ncontinuous service  either in  the erstwhile  department  or<br \/>\nunder the Nigam is a pre-condition of which 5 years in Nigam<br \/>\nwas necessary for promotion. It was also resolved that 5% of<br \/>\n25% was\t reserved for graduate Engineers who should complete<br \/>\n5 years\t of  service  in  Jal  Nigam.  Following  the  above<br \/>\ncriteria, the  candidates were\tconsidered and\tselected. It<br \/>\nwould appear  that first selection on September 24, 1983 and<br \/>\nthe second selection in August 1984 were made.\n<\/p>\n<p>     The respondent  who was  appointed as a Junior Engineer<br \/>\nin  LSGD  on  April  12,  1973\thad  passed  his  BE  degree<br \/>\nqualifying examination on November 3, 1982. He had put in 10<br \/>\nyears of  service as  J.E. as  on 13.4.1983.  Since he was a<br \/>\ngraduate and was eligible for promotion in general 25% quota<br \/>\nas well as the graduates quota of 5%, but does not appear to<br \/>\nhave been  considered on  September 4,\t1983 for  selection.<br \/>\nAgain in  the second  selection held in August, 1984 also he<br \/>\nwas considered\tbut was\t not selected.\tAs a consequence, he<br \/>\nfiled the Writ Petition No.14229\/84.\n<\/p>\n<p>     The Allahabad  High  Court\t by  order  dated  17.1.1982<br \/>\nallowed the  Writ Petition and directed to consider the case<br \/>\nof the respondent in the 25% quota reserved for promotes for<br \/>\nthe relevant  year proceedings\tdated  20.2.1992  have\tbeen<br \/>\nplaced before us in which as per the directions of the Court<br \/>\nthe appellant had considered his cases an additional post<br \/>\nwas created  and he  was promoted  in 25% quota reserved for<br \/>\npromotes as a special case.\n<\/p>\n<p>     Shri K.  Madhava Reddy,  the learned senior counsel for<br \/>\nthe appellant  contended that  the note to the rule referred<br \/>\nto hereinbefore\t gives power  to  the  Board  to  relax\t the<br \/>\ncriteria; the  Board having  relaxed the criteria considered<br \/>\nall the\t persons  including  54\t persons  who  are  eligible<br \/>\naccording to  the norm\tlaid down;  the respondent  was\t not<br \/>\nconsidered since  he did  not come  up within  the  zone  of<br \/>\nconsideration. It  is also  contended that  out of  5% quota<br \/>\nreserved for  the graduates,  17  candidates  including\t the<br \/>\nrespondent  on\tSerial\tNo.13  were  considered.  Since\t the<br \/>\ncriteria being\tmerit and ability, the more meritorious were<br \/>\npromoted  and  the  respondents,  therefore,  could  not  be<br \/>\nselected. The  High Court  had proceeded on a wrong premise,<br \/>\nnamely, the  respondent was  not considered within 25% quota<br \/>\nand  he\t  was  alone  the  graduate  eligible  but  was\t not<br \/>\nconsidered for\tpromotion. It  is stated that in view of the<br \/>\nfact that  17 candidates, who are graduates, were considered<br \/>\nand merit  and ability\tbeing the  criteria, the  premise on<br \/>\nwhich the  High Court  proceeded is, therefore, not valid in<br \/>\nlaw.\n<\/p>\n<p>     Shri A.K.\tSrivastava, the\t learned Advocate General of<br \/>\nSikkim appearing  for the  respondent,\tcontended  that\t the<br \/>\nrespondent having duly qualified for promotion in April 1983<br \/>\nby which date the criteria of relaxation was not made, ought<br \/>\nto have\t considered but\t was not considered according to the<br \/>\nrules.\tEven   in  August  84  selection  also\the  was\t not<br \/>\nconsidered as  he was  fully  qualified\t to  be\t considered.<br \/>\nTherefore,  the\t  High\tCourt  was  right  in  granting\t the<br \/>\ndirection and,\ttherefore, there  is no merit in the case of<br \/>\nthe appellants.\n<\/p>\n<p>     It would  appear that  the appellant with a view to see<br \/>\nthat all  eligible persons  would come\twithin the  zone  of<br \/>\nconsideration  for  promotion  adopted\ta  general  rule  of<br \/>\nrelaxation and\tconsidered the cases of all the persons. But<br \/>\nfrom the  resolution, we are unhappy to note that even merit<br \/>\nor integrity have been sacrificed as mentioned that they are<br \/>\nnot relevant for consideration. It is settled law that merit<br \/>\nand integrity are the sole consideration for selecting posts<br \/>\nand seniority  would become  relevant only when merit of all<br \/>\ncandidates are\tapproximately equal. The Board seems to have<br \/>\ntaken a\t reverse gear,\tobviously to  facilitate persons who<br \/>\nare not\t having that much of integrity and ability. However,<br \/>\nsince the promotion given to the persons has not been put in<br \/>\nissues we  need not express any doubt on their selection but<br \/>\nwe are\tunhappy to  note the  way in  which the Jal Nigam is<br \/>\nfunctioning in\tconsidering the promotion of the officers to<br \/>\nimprove excellence or to inculcate efficiency, integrity and<br \/>\nhonesty in the officers to reach higher echelons of service.\n<\/p>\n<p>     It\t is   seen  that  since\t the  criteria\tof  zone  of<br \/>\nconsideration was  adopted  as\tper  the  resolution  an  54<br \/>\npersons were  considered and  the respondent did not come up<br \/>\nin the\tzone of consideration, we cannot find fault with the<br \/>\nnon-consideration  of\tthe  respondent\t  in  that  zone  of<br \/>\nconsideration of  54 candidates. ln the quota of 5% reserved<br \/>\nfor graduates,\tthough\tthe  respondent\t has  fulfilled\t the<br \/>\nqualifications and  was eligible  to be\t considered, he\t was<br \/>\nincluded in  the penal\tof the candidates, the selection was<br \/>\nmade by\t the  committee\t constituted  in  that\tbehalf.\t The<br \/>\ncommittee appears  to have proceeded on the premise of merit<br \/>\nand ability  and  evaluated  the  criteria  of\tall  the  17<br \/>\ncandidates and selected four candidates who were standing at<br \/>\nNo.1,2,6  and\t8.  In\t the  absence\tof  any\t  compelling<br \/>\ncircumstances  brought\tto  our\t notice\t to  show  that\t the<br \/>\nselected candidates  are not possessed of superior merit and<br \/>\nability than  that of  the respondents\twe do not think that<br \/>\nthe selection is beset with any illegality. However, in view<br \/>\nof the circumstances that pursuant to the direction given by<br \/>\nthe High Court, the claim of the respondent had already been<br \/>\nconsidered and\the has\tbeen promoted,\twe do not incline to<br \/>\ninterfere with the order of the High Court.\n<\/p>\n<p>     The appeal\t is accordingly\t dismissed  with  the  above<br \/>\ndeclaration of law and observations.
