Gupta, vide his RTI application of 19\/01\/2009, sought information<br \/>\nthrough 18 points Annexure A enclosed herewith.\n<\/p>\n<p>2.     The CPIO provided information in response to points 1,2 &amp; 13 and denied information to<br \/>\nthe petitioner on all other points stating that they were not covered under the definition of<br \/>\ninformation under section 2(f) of the Act.\n<\/p>\n<p>3.     The appellant went in first appeal on 18\/02\/2009 which elicited an order of the first<br \/>\nAppellate Authority dated 18\/04\/2009 vide which he upheld the order of the CPIO.\n<\/p>\n<p>4.        The appellant has preferred second appeal before the Commission.\n<\/p>\n<p>5.     The matter was heard today. The appellant was not present. The respondent was present as<br \/>\nabove.\n<\/p>\n<p>                                            DECISION\n<\/p>\n<p>6.     Looking at the nature of the questions sought by the appellant, the Commission upholds the<br \/>\ndecision of the CPIO\/AA in respect of points 7,10,12,14,15,16 for denial of information since it<br \/>\nwas not covered under the definition of information as provided under u\/s 2(f) of the Act.\n<\/p>\n<p>7.     However, in respect of points 1,2,3,4,5,6,11,13,17&amp;18, it is observed that information<br \/>\nsought pertains to IRDA Regulations, file noting and progress of a complaint made by the<br \/>\nappellant, information regarding name and duties discharged by their receiving clerk, copy of<br \/>\nConduct Rules and copy of Schedule prescribed for attending to complaints.\n<\/p>\n<p>8.      It is observed that the CPIO has deliberately sought to deny the request for information and<br \/>\nhas also provided incomplete\/misleading information.\n<\/p>\n<p>9.      The first Appellate Authority has not only delayed in disposing of the matter beyond the<br \/>\ntime stipulated under the Act, he has also without any application of mind disposed of the case by<br \/>\nmechanically upholding the order of the CPIO.\n<\/p>\n<p><span class=\"hidden_text\">                                                      2<\/span><\/p>\n<p>     10.     Even on the points on which information has been provided, the CPIO has been evasive<br \/>\n     indicating his unwillingness to change his mental attitude in the light of the progressive regime<br \/>\n     rolled out under the Right to Information Act which redefines the relationship between public<br \/>\n     authorities and citizens in the discharge of their duties.\n<\/p>\n<p>     11.     The information as directed above may be provided to the appellant within 03 weeks of<br \/>\n     receipt of this order.\n<\/p>\n<p>     12.    The Commission directs the public authority to show cause why the appellant should not be<br \/>\n     compensated for the detriment caused to him by the acts of the CPIO and the first Appellate<br \/>\n     Authority as enumerated above by awarding compensation of Rs.5000\/-. An opportunity will be<br \/>\n     provided to the respondents for personal hearing before this Commission in the matter on<br \/>\n     23\/06\/2010 at 11.00 a.m. In case the appellant is not satisfied with the information provided, he<br \/>\n     may also present himself at this hearing.\n<\/p>\n<p>     13.    The Show Cause notice may be responded to within 03 weeks of receipt of this order.\n<\/p>\n<p>     14.
