The State Of Bihar.\n   2. The Secretary &amp; Commissioner, Urban Development Department, Government of Bihar,\n       Patna.\n   3. The Deputy Secretary, Urban Development Department, Government of Bihar, Patna.\n   4. The Patna Regional Development Authority, through its Vice Chairman, Patna.\n   5. The Vice Chairman, Patna Regional Development Authority, Patna.\n   6. The District Magistrate, Patna.\n   7. The Senior Superintendent of Police, Patna. ----- Respondents.\n                                            -----------\n<\/pre>\n<p>4      20.10.2011                  The     petitioner      is     aggrieved       by    the<\/p>\n<p>                        resolution       taken     by     the     Urban      Development<\/p>\n<p>                        Department on 12.7.2006 by which they have come<\/p>\n<p>                        to   a   prima     facie      finding     that    the     Madhuban<\/p>\n<p>                        Hotel cum Bar situated at Bailey Road, Patna<\/p>\n<p>                        and B.D. Public School situated in Budha Colony<\/p>\n<p>                        have encroached upon the Government land.<\/p>\n<p>                                   A proceeding was initiated for removal<\/p>\n<p>                        of the encroachment numbered as 119 of 1996.                      A<\/p>\n<p>                        show-cause       has    been    filed     on     behalf    of   the<\/p>\n<p>                        petitioner vide Annexure-6.\n<\/p>\n<p>                                   The apprehension of the petitioner is<\/p>\n<p>                        that     without       concluding       the    proceeding       and<\/p>\n<p>                        hearing the petitioner the demolition of the<\/p>\n<p>                        school building would be affected.<\/p>\n<p>                                   Counsel for the Municipal Corporation<\/p>\n<p>                        on   the   other       hand     submits       that   unless     the<\/p>\n<p>                        proceeding is concluded, there is no question<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>         that demolition would take place and as such<\/p>\n<p>         the   apprehension           of    the    petitioner      is      pre-<\/p>\n<p>         mature.\n<\/p>\n<p>                    In any event, this Court orders that<\/p>\n<p>         the Municipal Corporation should take steps for<\/p>\n<p>         removal of the encroachment on the Government<\/p>\n<p>         land in accordance with law after following all<\/p>\n<p>         the   procedures        under       the     P.M.C.     Act.        The<\/p>\n<p>         petitioner    should          be     given       opportunity       to<\/p>\n<p>         indicate    that       the    school       has   not   encroached<\/p>\n<p>         upon the Government land.\n<\/p>\n<p>                    This writ application is disposed of<\/p>\n<p>         with the aforesaid observation.<\/p>\n<pre>Sanjay                                             (Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
