MAJMUDAR\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\tTHE 23RD DAY OF APRIL, 1996<br \/>\nPresent:\n<\/p>\n<blockquote><p>\t      Hon&#8217;ble Mr. Justice K.Ramaswamy<br \/>\n\t      Hon&#8217;ble Mr. Justice B.L.Hansaria<br \/>\n\t      Hon&#8217;ble Mr. Justice S.B.Majmudar<br \/>\nR.C.Pathak, Ravinder Bagai, R.K.Gupta,<br \/>\nMs.Prerna  Tandon   and\t Ms.Naresh  Bakshi,  Advs.  for\t the<br \/>\nappellant<br \/>\nR.P.Bansal, Sr.\t Adv., Pramod  Dayal, Ajay K.Jain and Shashi<br \/>\nBhushan, Advs., with him for the Respondent<br \/>\n\t\t\t O R D E R<br \/>\n     The following order of the Court was delivered:<\/p><\/blockquote>\n<p>     This appeal  arises against  to the  order of the Delhi<br \/>\nHigh Court  made 26.5.1995 in Election Petition No.6\/94. The<br \/>\nappellant is  an unsuccessful candidate in respect of one of<br \/>\nthe Assembly  Constituency known  as No.64,  Sadar Bazar, to<br \/>\nthe  National  Capital\tTerritory  of  Delhi  Assembly.\t The<br \/>\nelections were\theld on\t 6th November,\t1993. The respondent<br \/>\nsecured 27216 votes while the appellant secured 25786 votes.<br \/>\nThe latter  filed an  election petition\t on diverse  grounds<br \/>\nincluding  corrupt   practices\tunder  Section\t123  of\t the<br \/>\nRepresentation of  the People  Act,  1951.  The\t High  Court<br \/>\ndismissed his  election petition under Section 86 of the Act<br \/>\non its\tfindings on  four issues  framed in that case. While<br \/>\nupholding the  findings in favour of the appellant on issued<br \/>\nNos.1 to 3, it held that the requisite number of true copies<br \/>\nof  the\t  election,  petition\twere  not  supplied  to\t the<br \/>\nrespondent in  compliance with\tSection 81(3)  of  the\tAct.<br \/>\nReasons in support thereof are some grave mistakes including<br \/>\nomission to  supply full  text of page No.18 of the election<br \/>\npetition. Another  contention raised  by the  respondent was<br \/>\nthat the  affidavit is\tnot a  true of copy of the affidavit<br \/>\nwhich was  filed  in  the  Court  along\t with  the  election<br \/>\npetition. Though it was rejected by the High Court as one of<br \/>\nthe grounds  against the rejection of the election petition,<br \/>\nthe respondent has filed cross objections.\n<\/p>\n<p>     It is  not necessary  for us  to go into the grounds on<br \/>\nwhich the election petition was dismissed by the High Court.<br \/>\nSuffice it  to state  that  the\t objections  raised  by\t the<br \/>\nrespondent regarding  non-supply of  the true  copy  of\t the<br \/>\naffidavit is a formidable objections which merits acceptance<br \/>\nin view\t of the\t recent judgment of this Court in Dr. (Smt.)<br \/>\nShipra etc.etc. vs. Shantilal Khoiwal etc. etc. [JI 1996 (4)<br \/>\nSC 67].\t Therein the  copy of  the affidavit supplied to the<br \/>\nrespondent was\tnot attested  by the Oath Commissioner. This<br \/>\nCourt, after  considering the entire case law, held that the<br \/>\naffirmation before the prescribed authority in the affidavit<br \/>\nand the\t supply of  its true  copy is  mandatory so that the<br \/>\nreturned candidates could not be misled in his understanding<br \/>\nthat imputation\t of the\t corrupt  practices  ere  prescribed<br \/>\nauthority. For\tthat purposes, Form 25 prescribed by Section<br \/>\n83 requires  verification before  prescribed authority.\t The<br \/>\nconcept of substantial compliance has no application in such<br \/>\na case.\t It is\tseen that the copy of the affidavit supplied<br \/>\nto the\trespondent does\t not contain  the affirmation by the<br \/>\nOath Commissioner.  Under these circumstances, the defect is<br \/>\nnot a  curable\tdefect.\t Therefore,  the  dismissal  of\t the<br \/>\nelection petition on this ground is sustainable in law.\n<\/p>\n<p>     Learned counsel for the appellant placed reliance on an<br \/>\norder of  this Court  C.A. No.\t925 of 1995 (boots Singh vs.<br \/>\nSher Singh  &amp; Ors.)  decided on March, 13, 1996. It would be<br \/>\nseen that  a Bench  of two  Judges of  this  Court  has\t not<br \/>\nexpressed any  conclusive opinion on the controversy. On the<br \/>\nother hand, this Court remitted the matter to the High Court<br \/>\nfor reconsideration  in accordance  with  law.\tUnder  these<br \/>\ncircumstances, the  ratio therein is of no assistance to the<br \/>\nappellant.\n<\/p>\n<p>     The appeal\t is dismissed.\tBut, in\t the  circumstances,<br \/>\nwithout costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sh.Harcharan Singh Josh vs Sh.Hari Kishan on 23 April, 1996 Bench: K.
