            Writ   petitioner   was   the   Honorary   Secretary   of<\/p>\n
the   second   respondent,   bank,   from   22.1.1996.     However,<\/p>\n
he was made a Paid Secretary from 9.3.1998.  There were<\/p>\n
financial   irregularities   and   it   was   alleged   that   he   had<\/p>\n
released   an   amount   of   Rs.50,000\/-,   without   securing   the<\/p>\n
loan,   to   his   wife.     On   9.10.2001,     an   enquiry   was<\/p>\n
conducted   and   finding   irregularities,     he   was   kept   under<\/p>\n
suspension.       Ext.P1   charge   memo   was     issued   on<\/p>\n
10.10.2001.\n<\/p>\n<\/p>\n
      2.    It   is   submitted   by   the   second   respondent   that<\/p>\n
an  amount of Rs.89,043\/-  was found  due to the  bank and<\/p>\n
under   Ext.R2(a),   the   writ   petitioner   had   remitted   an<\/p>\n
amount   of   Rs.70,000\/-   undertaking   to   pay   the   balance<\/p>\n
amount, thereafter.\n<\/p>\n<\/p>\n
      3.    The   second   respondent   had   appointed   an<\/p>\n
advocate as an Enquiry Officer, after ordering a domestic<\/p>\n
W.P.(C).21408\/2004<\/p>\n
                                    2<\/span><\/p>\n
enquiry,       on   27.2.2002.     The   petitioner   had   filed   a<\/p>\n
written   statement   against   the   charge,   on   12.4.2002.<\/p>\n
Enquiry stood for consideration   on various dates.   Then<\/p>\n
Secretary-in-charge   was   examined   on   15.5.2002.<\/p>\n
Accordingly,   enquiry   report   was   submitted   to   the   bank<\/p>\n
on   4.6.2002.     According   to   the   learned   counsel   for   the<\/p>\n
second   respondent,   the   same   was   communicated   to   the<\/p>\n
writ petitioner, terminating him from service, as could be<\/p>\n
seen  from Ext.R2(d)  dated 28.11.2006.   Ext.R2(e)  is the<\/p>\n
acknowledgment card dated 10.12.2002.<\/p>\n
      4.     While   the   learned   counsel   for   the   writ<\/p>\n
petitioner   submit   that   there   was   no   hearing   of   the<\/p>\n
petitioner,   showing   cause,   why   a   major   punishment   of<\/p>\n
termination   of   service   was   not   to   be   imposed   on   the<\/p>\n
petitioner.        The   learned   counsel   for   the   second<\/p>\n
respondent, on the other hand, submit relying of Ext.R2<\/p>\n
(e),   that   all   the   required   procedures   had   been   followed<\/p>\n
and   the   writ   petitioner   had   received   the   report   of   the<\/p>\n
enquiry officer on 4.6.2002.\n<\/p>\n<\/p>\n
      5.     Ext.P6   is   the   decision   dated   1.6.2004   of   the<\/p>\n
W.P.(C).21408\/2004<\/p>\n

first respondent disposing of the complaint, preferred by<\/p>\n
the writ petitioner, and accepting the termination of his<\/p>\n
service.     However,   the   writ   petitioner   now   challenges<\/p>\n
that there was no proper procedure followed, before the<\/p>\n
termination   of   the   petitioner,     as   required     under   Rule<\/p>\n
198(2) of the Kerala Co-operative Societies Rules, 1969,<\/p>\n
in   short   ‘the   Rules’.     The   learned   counsel   for   the<\/p>\n
petitioner also submit that the first respondent, the Joint<\/p>\n
Registrar, may be directed to consider the entire matter<\/p>\n
including the procedures that had been followed, before<\/p>\n
the imposition of a major punishment of terminating the<\/p>\n
petitioner   from   the   service   of   the   second   respondent,<\/p>\n
bank.\n<\/p>\n<\/p>\n
      6.     The   counsel   for   the   second   respondent<\/p>\n
however,   submit   that   the   appointment   of   the   petitioner<\/p>\n
as Paid Secretary was not approved by the Registrar and,<\/p>\n
therefore,   even   an   enquiry   was   not   warranted.     The<\/p>\n
procedure   required  to   be   followed   had   been   completely<\/p>\n
complied with.  Therefore, the petition may be dismissed,<\/p>\n
submits the counsel.\n<\/p>\n

      7.     Records   are   not   before   me.     In   the   counter,<\/p>\n
the   second   respondent   had   stated   that     the   enquiry<\/p>\n
report   dated   4.6.2002   was   communicated   to   the<\/p>\n
petitioner,   Ext.R2(e)   being   the   acknowledgment   card.<\/p>\n
However, the learned  counsel for the petitioner submits<\/p>\n
that   through   Ext.R2(e),   the   second   respondent   had<\/p>\n
communicated   a   matter,   in   relation   to   another<\/p>\n
communication and not relating to the enquiry report of<\/p>\n
the   Enquiry   Officer   as   well   as   the   show   cause   notice.<\/p>\n
This fact requires further evidence for entering a finding.<\/p>\n
      8.     I   am   not   entering   into   any   discussion   on   the<\/p>\n
merit  of the  matter.   The  first respondent had accepted<\/p>\n
the   decision   of   the   second   respondent,   bank,   after<\/p>\n
examining   the   records   that   had   been   produced   before<\/p>\n
him.  However,  Ext.P6 does not show,  whether the first<\/p>\n
respondent   had   examined   the   complaints   of   the     non-<\/p>\n
compliance of the procedure, as required under Rule 198<\/p>\n
(2) of the Rules.\n<\/p>\n<\/p>\n
      9.     I   cannot   accept,   at   this   stage,   that   the<\/p>\n
appointment   of   the   writ     petitioner   as     Paid   Secretary<\/p>\n

was   not   approved   by   the   Registrar   and   hence   no<\/p>\n
domestic   enquiry       even   need   to   be   conducted.     The<\/p>\n
second   respondent   had     opted   to   conduct   an   enquiry<\/p>\n
through an Enquiry Officer.  I find from the records   that<\/p>\n
almost all the procedures for conducting an enquiry had<\/p>\n
been followed.\n<\/p>\n<\/p>\n
        10.    In the above facts situation, I set aside Ext.P6<\/p>\n
order of the first respondent, Joint Registrar.  I direct the<\/p>\n
first respondent to call for the  entire  records leading to<\/p>\n
the dismissal of the writ petitioner from  service and pass<\/p>\n
orders afresh, after examining the same under Rule 176<\/p>\n
of   the   Rules.     Before   passing   final   orders,     the   first<\/p>\n
respondent   shall   hear   both   the   second   respondent   and<\/p>\n
the writ petitioner  and consider all their contentions.<\/p>\n
        11.    The above exercise shall  be completed within<\/p>\n
one month from the date of production of a copy of this<\/p>\n
judgment.\n<\/p>\n<\/p>\n
               The writ petition is disposed of as above.<\/p>\n
