(J)\n\nCITATION:\n 1994 SCC  Supl.  (2) 404\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t       ORDER\n<\/p>\n<p>1.   Special leave granted*.\n<\/p>\n<p>2.   The respondent, a Police Constable, was dismissed\tfrom<br \/>\nservice on certain charges.  He filed a writ petition in the<br \/>\nHigh  Court which was heard by a Division Bench of the\tHigh<br \/>\nCourt comprising two learned Judges.  The Division Bench  by<br \/>\nits  judgment and order dated 1-2-1989, dismissed  the\twrit<br \/>\npetition.   Against  that  the\tdelinquent  filed  a  review<br \/>\napplication   which  was  heard\t by  one  of   the   Judges,<br \/>\nconstituting  the  Division Bench,  presumably\tbecause\t the<br \/>\nsecond learned Judge was not available.\t In such a situation<br \/>\nunder  Rule 64 of the Rules of the High Court of  Judicature<br \/>\nfor Rajasthan, 1952, the proper procedure to be followed was<br \/>\nto lay the application before the learned Chief Justice, who<br \/>\nwith  due regard to the provisions of Rule 5 of Order 47  of<br \/>\nthe Code will constitute a Bench for hearing and disposal of<br \/>\nsuch  application.  In the instant case\t unfortunately\tthis<br \/>\nprocedure  was\tnot followed but one of the  learned  Judges<br \/>\nconstituting  the Division Bench which disposed of the\tmain<br \/>\npetition exercised power of review and reversed the  earlier<br \/>\norder.\tThe effect of this<br \/>\n*   Corrected on September 20 1993<br \/>\n<span class=\"hidden_text\">405<\/span><br \/>\norder  is  that\t a matter which would  ordinarily  go  to  a<br \/>\nDivision  Bench came to be disposed of by a  learned  Single<br \/>\nJudge.\t That clearly was not in keeping with a Rule  64  of<br \/>\nthe  Rules  of the High Court of Judicature  for  Rajasthan,<br \/>\n1952,  read  with  Rule\t 5 Order 47 of\tthe  Code  of  Civil<br \/>\nProcedure.\n<\/p>\n<p>3.   We, therefore, set aside the order in review and  remit<br \/>\nthe  matter  to the High Court.\t The papers will  be  placed<br \/>\nbefore the learned Chief Justice for constituting a Bench of<br \/>\ntwo learned Judges for disposal of the review petition.\t The<br \/>\nappeal is allowed accordingly with no order as to costs.\n<\/p>\n<p><span class=\"hidden_text\">407<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Rajasthan vs Gopal Singh on 17 September, 1993 Equivalent citations: 1994 SCC, Supl.
