Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :11\/06\/2009\n\n O R D E R\n               THOTTATHIL B RADHAKRISHNAN, J\n                  ...........................................\n                WP(C).NO. 16106                  OF 2009\n                  ............................................\n          DATED THIS THE           11th DAY OF JUNE, 2009\n\n                                JUDGMENT\n<\/pre>\n<p>     The petitioner claims that he is the registered owner of a<\/p>\n<p>vehicle, which was allegedly involved in an abkari offence and is<\/p>\n<p>presently being proceeded against for confiscation. He filed an<\/p>\n<p>application before the competent authority for interim custody of<\/p>\n<p>the vehicle. The rules provide for interim custody on the terms<\/p>\n<p>and conditions which are also statutorily regulated. There is no<\/p>\n<p>reason why the concerned officers do not consider the interim<\/p>\n<p>custody application, at least within one week of filing of such<\/p>\n<p>application. It is therefore directed that the petitioner&#8217;s<\/p>\n<p>application, which is stated to be lying with the competent<\/p>\n<p>authority for the last nearly two months shall be taken up,<\/p>\n<p>considered and disposed of within two weeks of the production of<\/p>\n<p>the copy of this judgment. The view of this court in this judgment<\/p>\n<p>that such applications should be finally disposed of within two<\/p>\n<p>weeks shall gain attention of all competent authorities, exercising<\/p>\n<p>the function of granting interim custody of vehicles, pending<\/p>\n<p><span class=\"hidden_text\">WP(C)16106\/2009               2<\/span><\/p>\n<p>confiscation proceedings.
