 road at Bgugatahalli village to purchase some articles at<\/p>\n
that time a jeep bearing registration N0.KA–04P.79<\/p>\n

came from Malavalli side in a rash and negligent
\nmanner and dashed against her. as a result, she fell<\/p>\n
down and sustained injuries. Hence. she \ufb01ledj’a.:’cl_aim<\/p>\n

 perusing the:i:a.W:ard of the Tribunal. I am of the<\/p>\n
” that the”co%npensation awarded by the Tribunal is<\/p>\n
andfproper, it is on the lower side and therefore<\/p>\n

7. As per wound certi\ufb01cate EX. P 4 the claimant has<\/p>\n
sustained the following injuries :<\/p>\n
i] Abrasion over the left ankle 5 x 3 helf<\/p>\n
3x 2 ems<\/p>\n
ii} Swelling and tenderness\u00ab .\n<\/p>\n
lower 1\/5 leg p _ 9<\/p>\n
iii] Blackened [L] greatei-.toe <\/p>\n
iv] Abrasionowar  13cm<\/p>\n

There’     0 wound certi\ufb01cate
\nthat JSS  gag low 1\/3 L leg. The
\ndoctor   above injuries No. 1, 3<\/span>
\nand 4A’are:’ sirrlpl\u00e9mjril and injury no.2 is grievous<\/p>\n
in nature. 0 \ufb02ed was treated as inpatient in JSS Hospital,<\/p>\n
  days. PW 2 Dr. C.S. Rupa Kurpar has<\/p>\n
 stated:0\u00b0that.;'”claimant was operated on 22.11.2004,<\/p>\n
whereipcalcaneal traction was applied. She was treated<\/p>\n
 00 withvvlskeletal traction and she was discharged on<\/p>\n
 15.12.2004. He again examined the claimant on<\/p>\n
H 30.8.2008 and taken X ray and found the following<\/p>\n
permanent physical disabilities:
\n%\/_<\/p>\n
1) Malunion of fracture both bone of left leg at
\nlower 1\/ 4411;\n<\/p>\n
2) Severe stiffness of left ankie joint;<\/p>\n
3) Moderate stiffness of left sub talar   is f <\/p>\n
4) Moderate stiffness of left mid t–arsa1: _<\/p>\n
He has stated that there is iteheaieft  ‘:<\/p>\n
lower limb.\n<\/p>\n
8. Considering ‘lt””}i.’.P.J” nathtefeleffin3ur1ee’;’ R’s.25,ooo\/–
\nawarded by the Tribuiial  suffering is<\/p>\n
on the low-ertlside aT_1d:it~’is”des–erved:fto be enhanced by<\/p>\n
anotherwRs.,j’iO:;OCG,\/ttgfnd 1 award Rs.35,000\/_<\/p>\n
under theeea.\n<\/p>\n
97;’ ” T1’hexc-1airn’ant’ has produced medical bills for Rs.<\/p>\n
 “and the Tribunal holding that there is no<\/p>\n
 ._ ‘C’ol1Ae’Ctfonu  tax on the medical bills has awarded<\/p>\n
 towards medical expenses which is<\/p>\n
if * irnproper. Considering the nature of injuries it is just<\/p>\n
 proper to award RS.12,300\/– towards medical<\/p>\n
“expenses. as against Rs.3,000\/– awarded by the<\/p>\n
Tribunal. \ufb01g<\/p>\n
10. Considering the nature of injuries and duration
\nof treatment I award Rs.15,000\/– towards incidental<\/p>\n
expenses such conveyance, nourishment and __attendant<\/p>\n
charges as against Rs.3.000\/– awarded by’t-he  <\/p>\n
11. Claimant claims to be a <\/p>\n
vending business and her :incorn’e Could  .assessed*at’g<\/p>\n
Rs.3,000\/- p.rn. Nature oi”esl\u00a7f1;t1:iesi”s\ufb01gg\u00e9sra that she
\nmust have been   restvatfleast for a
\nperiod of three  Rs.9,000\/– is
\nawarded losgspof laid up period.<\/p>\n
12.  stated by the doctor
\nand an  and unhappiness she has<\/p>\n
topurrdergo her iuttire life, Rs.15,000\/\u00ab~ is awarded<\/p>\n
C’ \u00abtowards loss of amenities.\n<\/p>\n
   ‘  is also present before Court and seen by<\/p>\n
the Colurttfas well as learned Counsel appearing for the<\/p>\n
 xinsureri’ She walks with the help of a ‘walker’ and an<\/p>\n
it gatte-‘ndant. Considering the same, disability stated by<\/p>\n
 ” ~ the doctor to the limb at 65% based on medical records,<\/p>\n

appears to be just and proper. 1\/ 3″ of the disability
\ncaused to limb has to be taken as disability caused to<\/p>\n
the whole body. It comes to 21.66%. Claimantlti.s_”a:ged<\/p>\n
about 48 years as evident from medical_.ifeeor_ds__f.a~2fi_dy_v<\/p>\n
identity card. Multiplier applieable to _.her’ . <\/p>\n

it a total compensation of Rs.1,89,260\/– as against<\/p>\n
Rs.3l,00O\/—- awarded by the Tribunal with interest at<\/p>\n
