SHAH\n\t\t\n\t\n\n \n\nDate\n: 28\/06\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tLeave<br \/>\nto join State of Gujarat as party respondent No.3.\n<\/p>\n<p>\tShri<br \/>\nPatel, learned advocate appearing on behalf of the applicant has<br \/>\nsubmitted that in the main application under Section 125 of the Code<br \/>\nof Criminal Procedure, the original claimant has claimed maintenance<br \/>\nat the rate of Rs.6000\/- per month for herself and Rs.3000\/- per<br \/>\nmonth for the original applicant No.2 &#8211; minor i.e. in all<br \/>\nRs.9000\/- per month and therefore, the learned Family Court could not<br \/>\nhave awarded the interim maintenance at the rate of Rs.11000\/- per<br \/>\nmonth (Rs.7000 p.m. for the wife and Rs.4000 p.m. for minor<br \/>\ndaughter).  Hence, NOTICE returnable<br \/>\non 12th<br \/>\nJuly 2011.\n<\/p>\n<p>Shri K.P. Raval, learned Additional Public Prosecutor waives service<br \/>\nof Notice on behalf of respondent No.3.\n<\/p>\n<p>\tIn<br \/>\nthe meantime Ad-interim relief in<br \/>\nterms of paragraph 11(c) on condition that applicant shall deposit<br \/>\nthe interim maintenance with the learned Family Court at the rate of<br \/>\nRs.6000\/- p.m.<br \/>\nfrom the date of application on or before the returnable date and<br \/>\ncontinue to pay the same till further orders.
