It was found that while on duty the respondent had punched<br \/>\nthe tickets in such a way that the same can be reissued. He was<br \/>\nchargesheeted, departmental proceedings were initiated and ultimately<br \/>\nhis services were dismissed. The respondent raised a dispute which<br \/>\nculminated into the aforesaid reference and the Labour Court passed<br \/>\nthe judgement and award as stated hereinabove.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned Advocates for the respective parties and perused the<br \/>\nrelevant documents on record. The main contention raised by the<br \/>\npetitioner is that  looking to the past conduct the Labour Court<br \/>\nought not to have reinstated the workman in service and in any case<br \/>\nthe penalty imposed is on the lower side.\n<\/p>\n<p>4.\tHaving<br \/>\nheard the parties, I am of the view that the judgement of the Labour<br \/>\nCourt is justified for reinstating the respondent workman as<br \/>\ndismissal from service is a penalty too harsh. However, looking to<br \/>\nthe 31 defaults committed by the respondent, the penalty of stoppage<br \/>\nof three increments is on the lower side.  Looking to the overall<br \/>\nfacts and circumstances of the case, especially looking to the 31<br \/>\ndefaults, I am of the view that interest of justice would be met by<br \/>\nimposing a penalty of  stoppage of five increments with future<br \/>\neffect.\n<\/p>\n<p>5.\tAccordingly<br \/>\nthe penalty of stoppage of three increments is converted into five<br \/>\nincrements with future effect. The rest of the award is not<br \/>\ndisturbed.
