A  rlxiespoildent — Bangalore Development Authority, for short<\/p>\n
    formation of J.P.Nagar 9111 Stage layout.<\/p>\n
 Whereafterwards, BDA secured possession’ of the land on<\/p>\n
26.5.1998. The Land Acquisition Oi\ufb01cer having drawn up<\/p>\n
an award, referred the matter to the Civil Court for<\/p>\n

\njudgment when carried in W.A.No.3i0O\/2003 by the<\/p>\n
Bangalore Development Authority, a Division Bench of this
\nCourt by order dated 18.7.2005, Anr1exure–D. dismissed the<\/p>\n
appeal on the premise that in the absence of mate1?ial..to<\/p>\n
establish that the writ petitioners in response togthej <\/p>\n
under Section 9 of the Land Acquisition,_Act.’l’_had*l  9 <\/p>\n
resisted the act of taking over possession <\/p>\n

    facts of the instant petitions, there is no<\/p>\n
A”inate\ufb02ai=to._estabiish that the petitioners were put on notice<\/p>\n
under sgacua\ufb01is of the Land Acquisition Act, 1894. or that<\/p>\n
 VVp”the.ppetitioners resisted the act of taking over possession by<\/p>\n
 _ it  Even otherwise, the BDA having taken possession<\/p>\n
%   ..o.f;the land has formed the layout of sites. in that View of the<\/p>\n
it matter. it cannot be said that the petitioners had resisted<\/p>\n
dispossession from their lands.\n<\/p>\n
