Being aggrieved by the same, the<br \/>\n\tpetitioners preferred Reference (LCS) No.144 of 2000, which<br \/>\n\tultimately came to be rejected by the Labour Court, Surendranagar.\n<\/p>\n<p>It<br \/>\n\tis further the case of the petitioners that the Labour Court ought<br \/>\n\tnot to have  strictly applied the provisions of the Indian Evidence<br \/>\n\tAct  to the proceedings under Section 10 of the Industrial Disputes<br \/>\n\tAct, 1947 (hereinafter referred to as &#8216;the Act&#8217;). It is submitted<br \/>\n\tthat the case of the petitioners is covered under sub-sections (1)<br \/>\n\tof Section 25(B) of the Act. However, the Labour Court has not<br \/>\n\tconsidered the said aspects and, therefore, the present petition.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned advocate for the<br \/>\n\tpetitioners, the averments made in the petition as well as the<br \/>\n\tdocumentary evidence produced on record, it transpires that the<br \/>\n\tpetitioners  did not produce any evidence, except the evidence<br \/>\n\tproduced on behalf of the respondent and they have admitted the said<br \/>\n\trecord to be proper. Further, they have stated that they do not have<br \/>\n\tany record except the record produced by the respondent. It is<br \/>\n\tcategorically admitted by the petitioners that the they did not have<br \/>\n\tany enmity with the then engineer of the respondent.  The<br \/>\n\tpetitioners have admitted that they have not produced any<br \/>\n\tinformation as to for how many days they have worked with the<br \/>\n\trespondent in a particular year. It is pertinent to note that as per<br \/>\n\tthe case of the petitioners, the service of the petitioners were<br \/>\n\tterminated with effect from 01st January 1996. The<br \/>\n\tpetitioners are required to discharge 240 days of service in each<br \/>\n\tyear and as per the law, prior to one year from the date of their<br \/>\n\ttermination i.e. one year prior to 01st January 1996, the<br \/>\n\tpetitioners have not discharged 240 days&#8217; service with the<br \/>\n\trespondent.  Further, no new daily wagers are also appointed by the<br \/>\n\trespondent and, therefore, it cannot be said that there is any<br \/>\n\tbreach of provisions of Sections 25(G) and 25(H) of the Act. Thus,<br \/>\n\tthere is no evidence on record to show that there was any relation<br \/>\n\tof master and servant between the parties. The petitioners have<br \/>\n\tthoroughly failed to establish their case before the Labour Court<br \/>\n\tand even before this Court.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid facts and circumstances of the case as well as the<br \/>\n\treasons assigned by the Labour Court, I am of the opinion that the<br \/>\n\tview taken by the Labour Court is just and proper. The Labour Court<br \/>\n\thas assigned cogent and convincing reasons for arriving at the<br \/>\n\tconclusion. I do not find any illegality much less any perversity in<br \/>\n\tthe findings recorded by the Labour Court. No case is made out to<br \/>\n\tinterfere with the findings arrived at by the Labour Court.
