PATTANAIK (J)\n\nCITATION:\n JT 1996 (4)   288\t  1996 SCALE  (3)609\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This appeal  is treated as special leave petition under<br \/>\nArticle 136 of the Constitution.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     This appeal  arises from  the order  dated February 17,<br \/>\n1995 in\t FA NO.510  of 1992  of the  National  Consumer\t and<br \/>\nRedressal Commission,  New Delhi.  The respondent-Haribandnu<br \/>\nSetha filed  a claim  before the  State\t Commission,  Orissa<br \/>\nunder the  Consumer Protection\tAct, 1986  [for\t short,\t the<br \/>\n&#8216;Act&#8217;] for  damages. The  State Commission  awarded  damages<br \/>\nagainst the  first respondent-LIC.  In appeal, the appellant<br \/>\nwas impleaded  as party-respondent  and the  National  Forum<br \/>\nawarded damages against the State in a sum of Rs. 1,00,000\/-<br \/>\n[Rupees one  lakh only]\t and directed  to  pay\tcompensation<br \/>\nwithin a  period of  three  months.  Thus,  this  appeal  by<br \/>\nspecial leave.\n<\/p>\n<p>     The only  question is:  whether the appellant is liable<br \/>\nto pay\tcompensation to\t Haribandhu Setha  under the Act and<br \/>\nwhether the  claim is maintainable. Section 2 [1] (o) of the<br \/>\nAct defines &#8216;services&#8217; as under:\n<\/p>\n<blockquote><p>     &#8220;&#8216;services&#8217; means\tservice\t of  any<br \/>\n     description which is made available<br \/>\n     to potential users and includes the<br \/>\n     provision\t  of\tfacilities    in<br \/>\n     connection with banking, financing,<br \/>\n     insurance,\t transport,  processing,<br \/>\n     supply  of\t  electrical  or   other<br \/>\n     energy, board  of loading\tor  both<br \/>\n     housing construction entertainment,<br \/>\n     amusement or  the purveying of news<br \/>\n     or other  information, but does not<br \/>\n     include  the   rendering\tof   any<br \/>\n     service free  of charge  or under a<br \/>\n     contract of Personal service.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t\t     [emphasis supplied]<br \/>\n     A reading\tof the\tdefinition would  indicate that\t the<br \/>\nservices contemplated  thereunder  alone  are  the  services<br \/>\nwithin the  meaning of\tthe  Act  except  excluded  services<br \/>\nmentioned thereunder.  The excluded  services  are  &#8220;service<br \/>\nfree of charge or under a contract of personal service&#8221;. The<br \/>\nconcept of  contract of personal service was considered in a<br \/>\nrecent judgment\t of this Court in <a href=\"\/doc\/723973\/\">Indian Medical Association<br \/>\nv. V.P.\t Shantha &amp;  Ors.<\/a> [(1995)  6 SCC 651]. This Court had<br \/>\nheld therein  that the\texpression &#8220;personal  service&#8221; has a<br \/>\nwell known  legal connotation  and has been construed in the<br \/>\ncontext of  the right to seek enforcement of such a contract<br \/>\nunder the  Specific Relief Act. For that purpose, a contract<br \/>\nof personal  service has been held to cover a civil servant,<br \/>\nthe managing  agents of\t a company  and a  professor in\t the<br \/>\nUniversity. There  can be  a contract of personal service if<br \/>\nthere is relationship of master and servant between a doctor<br \/>\nand the\t availing of  his services  and in  that  event\t the<br \/>\nservices rendered  by the  doctor to  his employer  would be<br \/>\nexcluded from  the purview of the expression under Section 2<br \/>\n[1] (o)\t of the\t Act by virtue of the exclusionary clause in<br \/>\nthe said  definition. The  other excluded service is service<br \/>\nrendered free of charge.<\/p><\/blockquote>\n<p>     It\t is  not  in  dispute  that  the  respondent  was  a<br \/>\nGovernment servant  and,  therefore,  he  is  bound  by\t the<br \/>\nservice conditions and the State was rendering services free<br \/>\nof  charge   to\t the   contesting  respondent.\tUnder  those<br \/>\ncircumstances, the Government servant has been excluded from<br \/>\nthe purview  of the  Act to  claim any\tdamages against\t the<br \/>\nState under  the Act. Therefore, if any claim arises for the<br \/>\ncontesting respondent,\tit would be open to him to claim, in<br \/>\nany other  forum, but  not under  the Act.  If the  claim is<br \/>\nbarred\tby   limitation,  time\t taken\tduring\t the  entire<br \/>\nproceedings shall stand excluded.\n<\/p>\n<p>     The appeal is accordingly allowed.
