Acharya for the petitioner and learned<br \/>\n\tAssistant Government Pleader Mr. Nirag Pathak for the respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>\tThis<br \/>\n\tpetition under Article 226 of the Constitution of India is filed by<br \/>\n\tthe petitioner to declare him as eligible for second higher payscale<br \/>\n\tavailable under G.R. dated 16.08.1994 on completion of 24 years of<br \/>\n\tservice.\n<\/p>\n<p>\tAs<br \/>\n\tcontended by learned Advocate for the petitioner, the petitioner<br \/>\n\tjoined the service of respondent authority initially on 17.07.1984<br \/>\n\tas a film operator and by this time, the petitioner has about 27<br \/>\n\tyears of unblemished continuous service to his credit and thus, on<br \/>\n\tcompletion of 9 years of continuous service, the petitioner was<br \/>\n\tentitled for first higher payscale and the second higher payscale<br \/>\n\twould be due 15 years thereafter. Upon submissions of the<br \/>\n\trepresentation by the petitioner to receive second higher payscale<br \/>\n\tin terms of the Government Resolution, the claim of the petitioner<br \/>\n\tis rejected arbitrarily by the impugned order dated 09.12.2011 which<br \/>\n\tdeserves to be quashed and set aside.\n<\/p>\n<p>\tOn<br \/>\n\tperusal of the overall service record of the petitioner, it appears<br \/>\n\tthat the petitioner had filed Appeal No.451\/2002 for claiming higher<br \/>\n\tpayscale and after discussion at length, the Tribunal had concluded<br \/>\n\tthat the petitioner was entitled to claim first higher payscale with<br \/>\n\teffect from 17.07.1997.  In view of the overall service record, the<br \/>\n\tabove order passed by the Tribunal on 02.07.2004 in the above appeal<br \/>\n\tremains final and thus, 15 years of service is necessary for<br \/>\n\tclaiming second higher payscale by the petitioner.  In the facts of<br \/>\n\tthe case, after granting of first higher payscale as held by the<br \/>\n\tTribunal with effect from 1997, the petitioner would be completing<br \/>\n\t15 years of service in the year 2012 and as per the Government<br \/>\n\tResolution dated 16.08.1994, he would entitled only for the second<br \/>\n\thigher payscale in the year 2012 and therefore, the decision of the<br \/>\n\trespondent authority impugned in this petition cannot be said to be<br \/>\n\tin any manner illegal or arbitrary warranting interference by this<br \/>\n\tCourt in exercise of powers under Article 226 of the Constitution of<br \/>\n\tIndia.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above, this application stands rejected with no order as<br \/>\n\tto costs.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>(Anant<br \/>\nS.
