      Leave granted.\n<\/p>\n
2.    These   are   the   appeals   against   the   orders   dated <\/p>\n
02.03.2007   and   19.03.2007   of   the   Division   Bench   of   the  <\/p>\n
Rajasthan High Court, Jaipur, in D.B. Civil Writ Petition No. <\/p>\n
2677 of 2005.\n<\/p>\n
3.    The   facts   briefly   are   that   on   the   basis   of   a   news <\/p>\n
published in the Rajasthan Patrika on 04.04.2005 regarding <\/p>\n
the manufacture  and sale of synthetic milk in the districts <\/p>\n
                                       2<\/span><\/p>\n
of Alwar and Bharatpur in the State of Rajasthan, the High <\/p>\n
Court  suo motu  entertained the D.B. Civil Writ Petition No. <\/p>\n
2677 of 2005 on 06.04.2005 and directed the Collectors of <\/p>\n
Alwar   and   Bharatpur   Districts   to   appear   in   person   before <\/p>\n
the   Court.     The   Collector,   Alwar,   filed   his   reply   before   the <\/p>\n
High Court stating inter alia that the very next day after the <\/p>\n
news item was published, the Chief Medical Health Officer, <\/p>\n
Alwar,   had   initiated   action   and   an   inspection   team   had <\/p>\n
taken samples of the product and the samples were sent for <\/p>\n
testing   in   the   laboratory.     On   02.03.2007,   the   High   Court <\/p>\n
found  that  Chief Medical Health  Officers and Deputy Chief <\/p>\n
Medical Health Officers had been vested with the powers of <\/p>\n
the  Food  Inspector, though  they did not  have  the  requisite <\/p>\n
training   to   function   as   Food   Inspectors.     The   High   Court <\/p>\n
also observed in the order dated 02.03.2007 that the Chief <\/p>\n
Medical Health Officer\/ Deputy Chief Medical Health Officer <\/p>\n
has to discharge duties of his post and has to remain at the <\/p>\n
Head Quarters and he may not effectively perform the duties <\/p>\n
of   the   post   of   Food   Inspector.     The   High   Court   was   of   the  <\/p>\n
view   that   the   State   Government   should   appoint   sufficient <\/p>\n
number   of   Food   Inspectors   without   which   the   menace   of <\/p>\n

food   adulteration   could   not   be   checked.       The   High   Court <\/p>\n
posted   the   matter   to   19.03.2007   and   directed   that   the <\/p>\n
Principal Secretary, Medical and Health Department should <\/p>\n
be personally present on that day.\n<\/p>\n
4.    On 19.03.2007, the High Court found that there were <\/p>\n
34   posts   of   Food   Inspectors   and   all   of   them   were   lying <\/p>\n
vacant and that a requisition had already been sent to the <\/p>\n
Rajasthan   Public   Service   Commission   to   fill   up   the   posts,  <\/p>\n
but   the   Finance   Department   had   not   sanctioned   the   posts <\/p>\n
on   the   ground   that   these   were   non-plan   posts.     The   High <\/p>\n
Court in the impugned order dated 19.03.2007 directed the <\/p>\n
Medical Health Department of the Government of Rajasthan <\/p>\n
to initiate the process of regular appointment against the 34 <\/p>\n
posts of the Food Inspectors and also directed the Finance <\/p>\n
Department   not   to   stall   the   process   of   appointment   on <\/p>\n
technical  grounds.    The  High   Court  further   directed in  the <\/p>\n
order   dated   19.03.2007   that   till   regular   appointment   is <\/p>\n
made,   Sanitary   Inspectors   and   others   who   possess   the <\/p>\n
requisite   qualifications   may   be   given   appointment   to   the <\/p>\n
posts   of   Food   Inspector   so   that   the   provisions   of   the <\/p>\n

Prevention   of   Food   Adulteration   Act   and   the   Rules   are <\/p>\n
properly implemented.\n<\/p>\n
5.    Dr.   Manish   Singhvi,   learned   Additional   Advocate <\/p>\n
General   appearing   for   the   State   of   Rajasthan,   submitted <\/p>\n
that   Section   9   of   the   Prevention   of   Food   Adulteration   Act, <\/p>\n
1954, vests power in the State Government to appoint such <\/p>\n
persons  as   it  thinks   fit,  having   prescribed  qualifications   to <\/p>\n
be   Food   Inspectors,   and   it   is   within   the   prerogative   of   the <\/p>\n
Government   to   determine   the   number   of   Food   Inspectors <\/p>\n
required to be appointed and therefore the High Court could <\/p>\n
not   have   issued   a  mandamus  to   the   State   Government   to <\/p>\n
make   appointment   of   as   many   as  34   Food   Inspectors.    He <\/p>\n
further   submitted   that   Rule   8   of   the   Prevention   of   Food <\/p>\n
Adulteration   Rules,   1955,   prescribes   the   qualifications   for <\/p>\n
the   purpose   of   appointment   of   Food   Inspectors   under <\/p>\n
Section 9 of the Act and it provides that the Medical Officer <\/p>\n
in-charge   of   health   administration  of  a  local   area   could  be <\/p>\n
appointed   as   Food   Inspector.     He   submitted   that   the   High <\/p>\n
Court,   therefore,   could   not   have   held   that   the   Medical <\/p>\n
Officers cannot be continued as Food Inspectors.\n<\/p>\n
                                       5<\/span><\/p>\n
6.    Section   9   of   the   Prevention   of   Food   Adulteration   Act, <\/p>\n
1954   (for   short   `the   Act’)   and   Rule   8   of   the   Prevention   of <\/p>\n
Food   Adulteration   Rules,   1955   (for   short   `the   Rules’)   are <\/p>\n
extracted hereinbelow:\n<\/p>\n
        “Section   9   of   The   Prevention   of   Food <\/p>\n
        Adulteration Act, 1954:\n<\/p><\/blockquote>\n
<\/blockquote>\n
        9.   Food   Inspectors              :-   (1)   The   Central <\/p>\n
        Government   or   the   State   Government   may,   by <\/p>\n
        notification   in   the   official   Gazette,   appoint   such <\/p>\n
        persons   as   it   thinks   fit,   having   the   prescribed <\/p>\n
        qualifications to be food inspectors for such local <\/p>\n
        areas as may be assigned to them by the Central <\/p>\n
        Government   or   the   State   Government,   as   the <\/p>\n
        case may be :\n<\/p><\/blockquote>\n
\n
        Provided   that   no   person   who   has   any   financial <\/p>\n
        interest in the manufacture, import or sale of any <\/p>\n
        article   of   food   shall   be   appointed   to   be   a   food <\/p>\n
        inspector under this section.\n<\/p><\/blockquote>\n
\n
        (2) Every food inspector  shall be deemed to be a <\/p>\n
        public-servant   within   the   meaning   of   section   21 <\/p>\n
        of   the   Indian   Penal   Code   (45   of   1860)   and   shall <\/p>\n
        be officially subordinate to such authority as the <\/p>\n
        Government   appointing   him,  may  specify  in   this <\/p>\n
        hehalf.\n<\/p><\/blockquote>\n
\n        Rule 8 of The Prevention of Food Adulteration <\/p>\n
        Rules, 1955:\n<\/p><\/blockquote>\n
<\/blockquote>\n
        8.   Qualification   of   food   inspector  :-   A   person <\/p>\n
        shall   not   be   qualified   for   appointment   as   food <\/p>\n
        inspector unless he:-<\/p><\/blockquote>\n
        (a)   is   a   medical   officer   in-charge   of   health <\/p>\n
        administration of local area ; or<\/p>\n
                                 6<\/span><\/p>\n
(b) is a graduate in medicine and has received at <\/p>\n
least one month’s training in food inspection and <\/p>\n
sampling   work   approved   for   the   purpose   by   the <\/p>\n
Central Government or a State Government; or <\/p>\n
(c) is a graduate in Science with Chemistry as one <\/p>\n
of the subjects or is a graduate in Agriculture or <\/p>\n
Public   Health   or   Pharmacy   or   in   Veterinary <\/p>\n
Science   or   a   graduate   in   Food   Technology   or <\/p>\n
Dairy Technology or is a diploma holder in Food <\/p>\n
Technology or Dairy Technology from a University <\/p>\n
or   Institution   established  in   India  by  law   or   has <\/p>\n
equivalent   qualifications   recognised   and   notified <\/p>\n
by   the   Central   Government   for   the   purpose   and <\/p>\n
has   received   three   months’   satisfactory   training <\/p>\n
in   food   inspection   and   sampling   work   under   a <\/p>\n
Food   (Health)   Authority   or   in   an   institution <\/p>\n
approved   for   the   purpose   by   the   Central <\/p>\n
Government:\n<\/p>\n
Provided that the training in food inspection and <\/p>\n
sampling          work         obtained         prior         to         the <\/p>\n
commencement of 1[Rule 3 of the<\/p>\n
Prevention   of   Food   Adulteration   (Fourth <\/p>\n
Amendment)   Rules,   1976],   in   any   of   the <\/p>\n
laboratories under the control of :-\n<\/p>\n
(i) a public analyst appointed under the Act, or<\/p>\n
(ii) a fellow of the Royal Institute of Chemistry of <\/p>\n
Great Britain (Branch E); or<\/p>\n
(iii) any Director, Central Food Laboratory ; or <\/p>\n
the   training   obtained   under   a   Food   (Health) <\/p>\n
Authority,   prior   to   the   commencement   of   the <\/p>\n
Prevention   of   Food   Adulteration   (Amendment) <\/p>\n
Rules 1980, shall be considered to be equivalent <\/p>\n
for   the   purpose   of   the   requisite   training   under <\/p>\n
these rules :\n<\/p>\n
                                    7<\/span><\/p>\n
       Provided further that a person who is a qualified <\/p>\n
       Sanitary Inspector having experience as such for <\/p>\n
       a   minimum   period   of   one   year   and   has   received <\/p>\n
       at   least   three   months   training   in   whole   or   in <\/p>\n
       parts in food inspection and sampling work, may <\/p>\n
       be   eligible   for   appointment   as   food   inspector, <\/p>\n
       upto the period ending on the 31st March, 1985 <\/p>\n
       and   may   continue   as   such   if   so   appointed   even <\/p>\n
       though   he   does   not   fulfill   the   qualifications   laid <\/p>\n
       down in clauses (a) to (c)].\n<\/p><\/blockquote>\n
\n
       Provided   also   that   nothing   in   this   rule   shall   be <\/p>\n
       construed to disqualify any person who is a food <\/p>\n
       inspector   on   the   commencement   of   the <\/p>\n
       Prevention of the Food Adulteration (Amendment) <\/p>\n
       Rules   1980   from   continuing   as   such   after   such <\/p>\n
       commencement.”\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
7.    Sub-section  (1) of Section  9 of the  Act states that  the <\/p>\n
Central   Government   or   the   State   Government   may,   by <\/p>\n
notification in the official Gazette, appoint such persons as <\/p>\n
it thinks fit, having the prescribed qualifications to be Food <\/p>\n
Inspectors for such local areas as may be assigned to them <\/p>\n
by the Central Government or the State Government, as the <\/p>\n
case   may   be.     Rule   8   of   the   Rules   prescribes   the <\/p>\n
qualifications  of  Food  Inspectors and  it states in  clause  (a) <\/p>\n
that   a medical  officer  in-charge of  health  administration  of <\/p>\n
local area is qualified for appointment as Food Inspector.  In <\/p>\n
clauses (b) & (c) a graduate in medicine who has received at  <\/p>\n
                                       8<\/span><\/p>\n
least one months’ training in food inspection and sampling <\/p>\n
work   and   a   graduate   in   Science   with   Chemistry   as   one   of  <\/p>\n
the subjects or a graduate in Agriculture or Public Health or <\/p>\n
Pharmacy   of   in   Veterinary   Science   or   a   graduate   in   Food <\/p>\n
Technology   or   Dairy   Technology   or   a   Diploma   Holder   in <\/p>\n
Food   Technology   or   Dairy   Technology   from   a   University   or <\/p>\n
Institution established in India by law or having equivalent <\/p>\n
qualification   and   has   received   three   months   satisfactory <\/p>\n
training   in   food   inspection   and   sampling   work   is   also <\/p>\n
qualified   to   be   a   Food   Inspector.     The   State   Government <\/p>\n
could therefore appoint a medical officer in-charge of health <\/p>\n
administration   of   a   local   area   as   a   Food   Inspector.     If   the <\/p>\n
High Court found that the medical officers were not trained <\/p>\n
in   food   inspection   and   sampling   work,   it   could   also   direct <\/p>\n
that   the   medical   officers   are   given   the   required   training   to <\/p>\n
function   as   Food   Inspector,   but   the   High   Court   could   not  <\/p>\n
have issued a  mandamus  compelling the State Government <\/p>\n
to   replace   the   Medical   Officers   by   Sanitary   Inspectors   or <\/p>\n
other   regular   recruits   as   Food   Inspectors.     This   Court   has <\/p>\n
held in Divisional Manager, Aravali Golf Club and Another vs. <\/p>\n
                                         9<\/span><\/p>\n
Chander Hass and Another  [(2008) 1 SCC 683] at page 688 <\/p>\n
in para 15:\n<\/p>\n
           “The   court   cannot   direct   the   creation   of <\/p>\n
           posts.     Creation   and   sanction   of   posts   is   a <\/p>\n
           prerogative   of   the   executive   or   legislative <\/p>\n
           authorities and the court cannot arrogate to <\/p>\n
           itself   this   purely   executive   or   legislative <\/p>\n
           function, and direct creation of posts in any <\/p>\n
           organization.     This   Court   has   time   and <\/p>\n
           again pointed out that the creation of a post <\/p>\n
           is an executive or legislative function and it <\/p>\n
           involves economic factors.  Hence the courts <\/p>\n
           cannot   take   upon   themselves   the   power   of <\/p>\n
           creation of a post.”\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
8.     We   therefore   set   aside   the   direction   in   the   impugned <\/p>\n
order   directing   appointment   of   Food   Inspectors   against   34 <\/p>\n
posts   and   directing   appointment   of   Sanitary   Inspectors   as <\/p>\n
Food   Inspectors   in   the   meanwhile   and   allow   the   appeals.\n<\/p>\n
There shall be no order as to costs.\n<\/p>\n
