              Rule, with the consent of the learned Counsel<\/p>\n
    for the parties made returnable forthwith and heard.\n<\/p>\n
    2)        This petition takes exception to the order<\/p>\n
    dated 22\/3\/2011 passed by the learned Member of the<\/p>\n
    Industrial   Court,   Yavatmal   whereby      the       revision<\/p>\n
    application filed by the respondent herein came to be<\/p>\n
    allowed and the respondent was directed to be<\/p>\n
    reinstated till the decision in the Complaint (ULP) filed<\/p>\n
    by her.\n<\/p>\n
    3)        The respondent herein is the wife of one<\/p>\n
    Pradip Sadashiv Gaikwad, who was initially appointed<\/p>\n
    in the Construction Department of the Municipal<\/p>\n
    Council on the post of Coolie and lastly working in the<\/p>\n
    Health Department of the Municipal Council.                    The<\/p>\n
    husband of the respondent died on 20\/7\/2005 while so<\/p>\n

    working.    As per recommendations of the Committee,<\/p>\n
    known as Lad Committee, the respondent herein was<\/p>\n
    appointed on the post which fell vacant on the death<\/p>\n
    of her husband. The respondent accordingly joined in<\/p>\n
    the post of Sweeper\/Coolie in the Health Department<\/p>\n
    of the Municipal Council on 4\/11\/2009. Thereafter on<\/p>\n
    19\/12\/2009, the service of the respondent came to be<\/p>\n
    terminated on the ground that the respondent was not<\/p>\n
    entitled    to   such    appointment            as       per         the<\/p>\n
    recommendations of the Lad Committee as the said<\/p>\n
    recommendations would not be applicable to a person<\/p>\n
    working in the Construction Department.                            This<\/p>\n
    triggered off the respondent in filing Complaint (ULP)<\/p>\n
    No. 2\/2010 challenging the said termination dated<\/p>\n
    19\/12\/2009.\n<\/p>\n
    4)         In the said complaint, respondent                filed an<\/p>\n
    application for interim relief under Section 30(2) of the<\/p>\n
    Maharashtra      Recognition       of   Trade       Unions          and<\/p>\n
    Prevention of Unfair Labour Practices Act, 1971, which<\/p>\n

    came to be rejected by order dated 6\/7\/2010 passed<\/p>\n
    by the learned Judge of the Labour Court.                       The<\/p>\n
    respondent thereafter preferred revision application<\/p>\n
    being Revision (ULP) No.17\/2010 before the Industrial<\/p>\n
    Court, Yavatmal, which    came to be allowed and the<\/p>\n
    Revisional Court directed the petitioner Municipal<\/p>\n
    Council to allow the respondent to work on the post on<\/p>\n
    which she was appointed.           This resulted in the<\/p>\n
    petitioner   Municipal   Council   filing     Writ       Petition<\/p>\n
    No. 410\/2011 in this Court. This Court by order dated<\/p>\n
    15\/2\/2011 set aside the said order passed by the<\/p>\n
    Industrial Court and remanded the matter back to the<\/p>\n
    Industrial Court for a de novo consideration.\n<\/p>\n
    5)       On remand,      the Industrial     Court        by the<\/p>\n
    impugned order dated 22\/3\/2011 decided the interim<\/p>\n
    relief application in favour of the respondent and<\/p>\n
    directed that the respondent should be allowed to work<\/p>\n
    in the post in which she was appointed by order dated<\/p>\n
    3\/11\/2009 till the decision in the main complaint. As<\/p>\n

    indicated above, it is this order, which is impugned in<\/p>\n
    the present petition.\n<\/p>\n
    6)          The   facts        inter       alia     disclose            that       the<\/p>\n
    respondent herein being the wife of an ex-employee of<\/p>\n
    the Municipal Council was accommodated on the basis<\/p>\n
    of   the    recommendations
\n                       ig                      of     the      Lad      Committee,<\/p>\n
    however, after her appointment on 3\/11\/2009, her<\/p>\n
    services came to be terminated on the ground that<\/p>\n
    recommendations of the Lad Committee could not be<\/p>\n
    made       applicable     to     the       post     of        Coolie        in     the<\/p>\n
    Construction Department of the Municipal Council and<\/p>\n
    would be applicable only to the post of Sweeper in the<\/p>\n
    Health Department of the Municipal Council.\n<\/p>\n
    7)          Though submissions in support of and against<\/p>\n
    the impugned order have been advanced, namely, that<\/p>\n
    it is the contention of the learned Counsel for the<\/p>\n
    petitioners that the relief in the nature of final relief<\/p>\n
    could not be granted at the interim stage whereas it is<\/p>\n

    the   submission   of   the   learned      Counsel          for      the<\/p>\n
    respondent that in the facts and circumstances of the<\/p>\n
    case, the interim relief was justified, in my view,<\/p>\n
    considering the nature of the controversy involved,<\/p>\n
    which is limited to the fact as to whether the<\/p>\n
    recommendations of the Lad Committee would be<\/p>\n
    applicable and, therefore, the respondent could be<\/p>\n
    given the benefit of the same,        it would be just and<\/p>\n
    proper to direct the Labour Court, Yavatmal to hear<\/p>\n
    and    decide   Complaint         (ULP)    No.        2\/2010           as<\/p>\n
    expeditiously as possible and latest by 31st December<\/p>\n
    2011. Since there is an interim order operating in the<\/p>\n
    above petition, which was granted on 2\/5\/2011, the<\/p>\n
    same would operate pending consideration of the said<\/p>\n
    Complaint (ULP) No.2\/2010.           The reinstatement or<\/p>\n
    otherwise of the respondent would be contingent upon<\/p>\n
    the decision of the said Complaint (ULP) No.2\/2010.\n<\/p>\n
    Both the learned Counsel for the parties state that<\/p>\n
    their clients would cooperate in the early disposal of<\/p>\n
    the said complaint. The parties to appear before the<\/p>\n
