Heard learned counsel for the petitioner and<\/p>\n<p>                    the State.\n<\/p>\n<p>                            2. The contempt application has been filed<\/p>\n<p>                    asserting non-compliance of the orders of this Court<\/p>\n<p>                    dated 23.11.2009 passed in C.W.J.C.No. 15995 of<\/p>\n<p>                    2009, Annexure-A, whereunder this Court asked the<\/p>\n<p>                    Director,    Medical   Services,   Employees   State<\/p>\n<p>                    Insurance Scheme to consider the case of the<\/p>\n<p>                    petitioner for payment of subsistence allowance. Such<\/p>\n<p>                    prayer has been refused by the Director, Medical<br \/>\n<span class=\"hidden_text\">                  -2-<\/span><\/p>\n<p>Services under orders dated 19.03.2010 which is<\/p>\n<p>contained in Annexure-C to the review application<\/p>\n<p>filed for review of the order dated 23.11.2009 on the<\/p>\n<p>ground that petitioner having not reported his<\/p>\n<p>attendance at the place of his headquarter is not<\/p>\n<p>entitled for payment of subsistence allowance in the<\/p>\n<p>light of proviso to sub-rule (iii) (1) of Rule 10 of the<\/p>\n<p>Bihar Government Servants (Classification, Control &amp;<\/p>\n<p>Appeal) Rules, 2005 (hereinafter referred to as the<\/p>\n<p>&#8220;Rules) which inter alia require the government<\/p>\n<p>servant under suspension to mark his attendance at<\/p>\n<p>the place of his headquarter.\n<\/p>\n<p>        3. It is submitted on behalf of the petitioner<\/p>\n<p>that   request   of    the   petitioner   for   payment   of<\/p>\n<p>subsistence allowance was refused under order dated<\/p>\n<p>19.03.2010 without appreciating the fact that his<\/p>\n<p>medical condition was such that he could not made<\/p>\n<p>himself available at the place of headquarter and had<\/p>\n<p>requested for change of the headquarter. In support of<\/p>\n<p>such plea reliance is placed on the prescription of the<\/p>\n<p>Out Patient Department of the Nalanda Medical<\/p>\n<p>College Hospital Unit Dr. Prof. A.K.Sinha-II dated<\/p>\n<p>08.01.2010. It is submitted on behalf of the petitioner<\/p>\n<p>that if the medical condition of the petitioner as is<\/p>\n<p>appearing from the prescription dated 08.01.2010<\/p>\n<p>was not acceptable to the Director, Medical Services<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>         he ought to have asked the petitioner to appear before<\/p>\n<p>         a medical board so as to confirm the findings<\/p>\n<p>         recorded in the prescription dated 08.01.2010. It is<\/p>\n<p>         also submitted on behalf of the petitioner that his<\/p>\n<p>         suspension has now been vacated and he has joined<\/p>\n<p>         his place of posting at Jamal Road, Patna.<\/p>\n<p>                 4.     Let    the   Director,   Medical   Services,<\/p>\n<p>         Employees State Insurance Scheme consider the<\/p>\n<p>         correctness or otherwise of the contents of the<\/p>\n<p>         medical prescription dated 08.01.2010 by asking the<\/p>\n<p>         medical officer who has issued such prescription<\/p>\n<p>         about the real state of health of the petitioner during<\/p>\n<p>         the relevant time and pass appropriate orders in<\/p>\n<p>         accordance with law. It goes without saying that if the<\/p>\n<p>         condition of the petitioner at the relevant time was<\/p>\n<p>         such that he could not have gone to Banjari, the<\/p>\n<p>         authorities will not insist on enforcing the proviso to<\/p>\n<p>         sub-rule (iii) (1) of Rule 10 but before coming to such<\/p>\n<p>         finding the actual state of health of the petitioner at<\/p>\n<p>         the relevant time must be ascertained.<\/p>\n<p>                 5.
