Respondent-landlord  filed<br \/>\neviction-petition against  the appellant under Section 10(2)\n<\/p>\n<p>(i) of\tthe Tamil  Nadu Buildings  (Lease and  Rent Control)<br \/>\nAct, 1960  (the Act) on the ground that the tenant committed<br \/>\nwillful default\t in the payment of rent. The application was<br \/>\nallowed by  the Rent  Controller. The appellate court upheld<br \/>\nthe  findings\tof  the\t Rent  Controller.  The\t High  Court<br \/>\ndismissed the revision petition filed by the appellant.\n<\/p>\n<p>     The respondent  purchased the  premises in\t dispute  on<br \/>\nMarch 30,  1977. It  is not  disputed that  at that time the<br \/>\nappellant was  occupying the  said premises as a tenant on a<br \/>\nmonthly rent  of Rs.60\/-.  The respondent  filed a  suit for<br \/>\ndeclaration and\t injunction against  the appellant  alleging<br \/>\nthat after the purchase of the property by him the appellant<br \/>\nsurrendered the\t possession of the premises to him but later<br \/>\non tress-passed\t into the  property. The  appellant, in\t the<br \/>\nsuit, contended that he was a tenant in the property and had<br \/>\nnever surrendered  possession of the building to anyone. The<br \/>\nsuit was  dismissed. The  appeal  filed\t by  the  respondent<br \/>\nagainst the said order was also dismissed.\n<\/p>\n<p>     The respondent served a notice dated August 12, 1981 on<br \/>\nthe appellant  demanding arrears of rent for the period from<br \/>\nMarch 30, 1977 to August 12, 1981. Section 10(2) (i) and the<br \/>\nproviso thereunder which are relevant are as under:\n<\/p>\n<blockquote><p>     &#8220;10. Eviction of  tenants.-(1) A  tenant<br \/>\n     shall  not\t  be   evicted\t whether   in<br \/>\n     execution\tof   a\tdecree\tor  otherwise<br \/>\n     except in accordance with the provisions<br \/>\n     of this section or sections 14 to 16 :<br \/>\n     Provided that  nothing contained  in the<br \/>\n     said sections  shall apply\t to a  tenant<br \/>\n     whose landlord is the Government:<br \/>\n     Provided further  that where  the tenant<br \/>\n     denies the\t title\tof  the\t landlord  or<br \/>\n     claims right  of permanent\t tenancy, the<br \/>\n     Controller\t shall\t decide\t whether  the<br \/>\n     denial or\tclaim is  bona fide and if he<br \/>\n     records a\tfinding to  that effect,  the<br \/>\n     landlord shall  be entitled  to sue  for<br \/>\n     eviction of  the tenant in a civil Court<br \/>\n     and the  Court may\t pass  a  decree  for<br \/>\n     eviction on any of the grounds mentioned<br \/>\n     in the  said  sections,  notwithstanding<br \/>\n     that the  Court finds  that such  denial<br \/>\n     does not involve forfeiture of the lease<br \/>\n     or that the claim is unfounded.<br \/>\n     (2)  A landlord  who seek&#8217;s to evict his<br \/>\n     tenant shall apply to the Controller for<br \/>\n     a\tdirection  in  that  behalf.  If  the<br \/>\n     Controller, after\tgiving the  tenant  a<br \/>\n     reasonable opportunity  of showing cause<br \/>\n     against the application, is satisfied-\n<\/p><\/blockquote>\n<blockquote><p>\t  (i) that the tenant has not paid or<br \/>\n     tendered the  rent due by him in respect<br \/>\n     of the  building,\twithin\tfifteen\t days<br \/>\n     after the\texpiry of  the time  fixed in<br \/>\n     the  agreement   of  tenancy   with  his<br \/>\n     landlord or  in the  absence of any such<br \/>\n     agreement, by  the last day of the month<br \/>\n     next following  that for  which the rent<br \/>\n     is payable, or<br \/>\n     &#8230;&#8230;&#8230;&#8230;.\n<\/p><\/blockquote>\n<blockquote><p>     Provided that  in any case falling under<br \/>\n     clause  (i)   if\tthe   Controller   is<br \/>\n     satisfied that  the tenant&#8217;s  default to<br \/>\n     pay or  tender rent  was not  wilful, he<br \/>\n     may, notwithstanding  anything contained<br \/>\n     in\t section   11,\tgive   the  tenant  a<br \/>\n     reasonable time,  not exceeding  fifteen<br \/>\n     days, to  pay or  tender the rent due by<br \/>\n     him to  the landlord  upto the  date  of<br \/>\n     such  payment  or\ttender\tand  on\t such<br \/>\n     payment or tender, the application shall<br \/>\n     be rejected.\n<\/p><\/blockquote>\n<blockquote><p>     [Explanation.-For the  purpose  of\t this<br \/>\n     sub-section, default  to pay  or  tender<br \/>\n     rent shall\t be construed  as wilful,  if<br \/>\n     the default by the tenant in the payment<br \/>\n     or tender\tof rent\t continues after  the<br \/>\n     issue  of\ttwo  months&#8217;  notice  by  the<br \/>\n     landlord claiming the rent.]&#8221;\n<\/p><\/blockquote>\n<p>It is  not disputed  that in  October,\t1981  the  appellant<br \/>\ndeposited  all\t the  arrears\tof  rent   before  the\tRent<br \/>\nController.\n<\/p>\n<p>     The only contention raised before us by learned counsel<br \/>\nfor the appellant is that the default in the payment of rent<br \/>\nby the\tappellant, if any, was not wilful and as such he was<br \/>\nentitled to  the benefit of the proviso to Section 10(2) (i)<br \/>\nof the Act. According to him the Rent Controller should have<br \/>\ngiven time  not exceeding  15 days to pay or tender the rent<br \/>\ndue by him to the landlord. It is further contended that the<br \/>\nappellant had  in fact\tdeposited the rent immediately after<br \/>\nthe ejectment-application  was filed  by the  respondent. We<br \/>\nsee force  in the contention of the learned counsel. Despite<br \/>\nthe fact  that the  appellant was  tenant of the property in<br \/>\ndispute under  the earlier owner, the respondent dragged the<br \/>\nappellant to  the civil court on the allegations that he was<br \/>\na tress-passer.\t The civil  court decided the controversy in<br \/>\nfavour of the appellant and held that he was a tenant in the<br \/>\nproperty purchased by the respondent. In reply to the notice<br \/>\ndated August 12, 1981 the appellant stated that he could not<br \/>\npay the\t rent because  the respondent  never accepted him as<br \/>\nhis  tenant   and  refused  to\taccept\tthe  rent  till\t the<br \/>\nproceedings were finally decided by the civil courts. In the<br \/>\nreply it was further stated that the non-payment of rent was<br \/>\nnot due to any fault on the part of the appellant and he was<br \/>\nprepared to  pay the same in easy instalments. We are of the<br \/>\nview that the courts below have not taken into consideration<br \/>\nthese facts  in the  right perspective.\t Keeping in view the<br \/>\npeculiar facts\tand circumstances of this case, we hold that<br \/>\nthe default  in the  payment of\t rent on  the  part  of\t the<br \/>\nappellant was  not  wilful.  Admittedly\t the  appellant\t had<br \/>\ndeposited the  rent in\tthe court  of  the  Rent  Controller<br \/>\nwithin one month of the institution of the application.\n<\/p>\n<p>     We allow the appeal and set aside the impugned judgment<br \/>\nof the courts below and dismiss the application filed by the<br \/>\nrespondent before the Rent Controller.
