Justice ANTONY DOMINIC\n\n Dated :01\/12\/2007\n\n O R D E R\n                       ANTONY DOMINIC, J\n\n                              -------------------\n\n                         W.P.(C).34155\/2007\n\n                              --------------------\n\n           Dated this  the  1st day of December, 2007\n\n\n                              JUDGMENT\n<\/pre>\n<p>              Assessment orders under   the Building Tax Act<\/p>\n<p>is   under   challenge.     Exts.P2   to  P16       are   the   assessment<\/p>\n<p>orders.         Referring     to   the   Statement   filed,     the   learned<\/p>\n<p>Government   Pleader   submits   that   though   there   are   22<\/p>\n<p>apartments,   during   the   course   of   the   enquiry   held     with<\/p>\n<p>notice   to   the   parties,   nothing   was   made   available   to   the<\/p>\n<p>Assessing   Officer   to   indicate   that   in   respect   of   each   of<\/p>\n<p>these   apartments,   the   owners   had   made     individual<\/p>\n<p>contribution for meeting  the  cost of construction of these<\/p>\n<p>apartments.  It was also stated that  the documents having<\/p>\n<p>title   to  the   flats   were   executed   as  late     as   in   August  and<\/p>\n<p>September,   2006,     and   that   flats   are   still   in   the   name   of<\/p>\n<p>the first   petitioner who had constructed the flats.   In the<\/p>\n<p>light   of   this,     prima-facie,   I   do   not   find   any   reason   to<\/p>\n<p>interfere in this writ petition.\n<\/p>\n<\/p>\n<p>2.     I also notice that the petitioners have   not availed of<\/p>\n<p>the  statutory   remedies   where  he   can   produce   documents<\/p>\n<p>W.P.(C).34155\/2007<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>and prove their contentions, correctness of which is to be<\/p>\n<p>decided  based on the evidence that is to be  produced.<\/p>\n<p>3.
