No.8346\/2010-P\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n            Dated this the 19th day of March, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    The petitioner herein is conducting textile business in<\/p>\n<p>a building in Survey No.818\/4A of Alappuzha Village which<\/p>\n<p>was acquired for construction of Theatre Complex at the<\/p>\n<p>instance of the second respondent.     The proceedings were<\/p>\n<p>pending for a considerable number of years and with regard<\/p>\n<p>to the eviction of the occupants a meeting was held in the<\/p>\n<p>Collectorate, which is evidenced from Ext.P5 minutes.   The<\/p>\n<p>petitioner contends that there was decision in the meeting<\/p>\n<p>whereby the understanding was that the second respondent<\/p>\n<p>will facilitate the liability to provide accommodation to<\/p>\n<p>the persons like the petitioner for payment of security<\/p>\n<p>deposit etc. and the second respondent is not complying<\/p>\n<p>with the same.\n<\/p>\n<p>    2.   The   second  respondent   has  filed  a   counter<\/p>\n<p>affidavit in the matter.   It is pointed out that in the<\/p>\n<p>meeting it was decided that the occupants shall find out<\/p>\n<p>alternate shops of equal size for their shifting and that<\/p>\n<p>the KSFDC shall pay refundable security deposit to the<\/p>\n<p>Landlords  and shall  rehabilitate   them in  the  shopping<\/p>\n<p>complex to be built up in the property.        It was also<\/p>\n<p>specifically  agreed  that  the   occupants  including  the<\/p>\n<p>W.P.(C). No.8346\/2010<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>petitioner      shall  vacate  the   premises on  or   before<\/p>\n<p>12\/03\/2010,      failing  which  they  shall be  evicted  on<\/p>\n<p>15\/03\/2010.       It is further pointed out in paragraph (14)<\/p>\n<p>that the Landlord is not entitled to stipulate for the<\/p>\n<p>payment of any amount exceeding one month&#8217;s rent by way of<\/p>\n<p>advance.     In view of this dispute and in view of the fact<\/p>\n<p>that the petitioner has already filed a representation as<\/p>\n<p>per Ext.P6 before the District Collector, there will be a<\/p>\n<p>direction to the District Collector to take a decision on<\/p>\n<p>Ext.P6 and other aspects of the matter after hearing the<\/p>\n<p>petitioner and the second respondent within a period of ten<\/p>\n<p>days.    Eviction, if any, will be effected in terms of the<\/p>\n<p>decision to be taken by the District Collector.<\/p>\n<p>     The writ petition is disposed of as above.
