This is an appeal against the judgment of the<\/p>\n<p>   learned   Addl.Sessions   Judge   (F.T.),    Jalore,   dated<\/p>\n<p>   26.3.2003, whereby all the five accused appellants<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>Aasin Khan, Shakur Khan, Teke Khan, Smt.Bhima and<\/p>\n<p>Amare Khan were convicted under various offences of<\/p>\n<p>the Indian Penal Code as under:\n<\/p>\n<p>(1) ACCUSED APPELLANT AASIN KHAN:\n<\/p>\n<p>U\/Sec.148 IPC:     One year&#8217;s R.I. alongwith a fine of<br \/>\n                   Rs.500\/- &amp; in default, to further<br \/>\n                   undergo six months&#8217; S.I.\n<\/p>\n<p>U\/Sec.302 IPC:     Life imprisonment alongwith a fine<br \/>\n                   of Rs.1000\/- &amp; in default, to further<br \/>\n                   undergo one year&#8217;s S.I.\n<\/p>\n<p>U\/Sec.324 IPC:     One year&#8217;s R.I. alongwith a fine of<br \/>\n                   Rs.500\/- &amp; in default, to further<br \/>\n                   undergo six months&#8217; S.I.\n<\/p>\n<p>U\/s.323\/149 IPC:   Six months&#8217; R.I. alongwith a fine of<br \/>\n                   Rs.100\/- &amp; in default, to further<br \/>\n                   undergo one month&#8217;s S.I.\n<\/p>\n<p>(2) ACCUSED APPELLANT SHAKUR KHAN:\n<\/p>\n<p>U\/Sec.148 IPC:     One year&#8217;s R.I. alongwith a fine of<br \/>\n                   Rs.500\/- &amp; in default, to further<br \/>\n                   undergo six months&#8217; S.I.\n<\/p>\n<p>U\/s.302\/149 IPC:   Life imprisonment alongwith a fine<br \/>\n                   of Rs.1000\/- &amp; in default, to further<br \/>\n                   undergo one year&#8217;s S.I.\n<\/p>\n<p><span class=\"hidden_text\">                           3<\/span><\/p>\n<p>U\/s.324\/149 IPC:   One year&#8217;s R.I. alongwith a fine of<br \/>\n                   Rs.500\/- &amp; in default, to further<br \/>\n                   undergo six months&#8217; S.I.\n<\/p>\n<p>U\/Sec.323 IPC:     Six months&#8217; R.I. alongwith a fine of<br \/>\n                   Rs.100\/- &amp; in default, to further<br \/>\n                   undergo one month&#8217;s S.I.\n<\/p>\n<p>(3) ACCUSED APPELLANT TEKE KHAN:\n<\/p>\n<p>U\/Sec.148 IPC:     One year&#8217;s R.I. alongwith a fine of<br \/>\n                   Rs.500\/- &amp; in default, to further<br \/>\n                   undergo six months&#8217; S.I.\n<\/p>\n<p>U\/s.302\/149 IPC:   Life imprisonment alongwith a fine<br \/>\n                   of Rs.1000\/- &amp; in default, to further<br \/>\n                   undergo one year&#8217;s S.I.\n<\/p>\n<p>U\/s.324\/149 IPC:   One year&#8217;s R.I. alongwith a fine of<br \/>\n                   Rs.500\/- &amp; in default, to further<br \/>\n                   undergo six months&#8217; S.I.\n<\/p>\n<p>U\/Sec.323 IPC:     Six months&#8217; R.I. alongwith a fine of<br \/>\n                   Rs.100\/- &amp; in default, to further<br \/>\n                   undergo one month&#8217;s S.I.\n<\/p>\n<p>(4) ACCUSED APPELLANT SMT.BHIMA:\n<\/p>\n<p>U\/Sec.148 IPC:     One year&#8217;s R.I. alongwith a fine of<br \/>\n                   Rs.500\/- &amp; in default, to further<br \/>\n                   undergo six months&#8217; S.I.\n<\/p>\n<p>U\/s.302\/149 IPC:   Life imprisonment alongwith a fine<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>                    of Rs.1000\/- &amp; in default, to further<br \/>\n                    undergo one year&#8217;s S.I.\n<\/p>\n<p>U\/s.324\/149 IPC:    One year&#8217;s R.I. alongwith a fine of<br \/>\n                    Rs.500\/- &amp; in default, to further<br \/>\n                    undergo six months&#8217; S.I.\n<\/p>\n<p>U\/Sec.323 IPC:      Six months&#8217; R.I. alongwith a fine of<br \/>\n                    Rs.100\/- &amp; in default, to further<br \/>\n                    undergo one month&#8217;s S.I.\n<\/p>\n<p>(5) ACCUSED APPELLANT AMARE KHAN:\n<\/p>\n<p>U\/Sec.148 IPC:      One year&#8217;s R.I. alongwith a fine of<br \/>\n                    Rs.500\/- &amp; in default, to further<br \/>\n                    undergo six months&#8217; S.I.\n<\/p>\n<p>U\/s.302\/149 IPC:    Life imprisonment alongwith a fine<br \/>\n                    of Rs.1000\/- &amp; in default, to further<br \/>\n                    undergo one year&#8217;s S.I.\n<\/p>\n<p>U\/s.324\/149 IPC:    One year&#8217;s R.I. alongwith a fine of<br \/>\n                    Rs.500\/- &amp; in default, to further<br \/>\n                    undergo six months&#8217; S.I.\n<\/p>\n<p>U\/Sec.323 IPC:      Six months&#8217; R.I. alongwith a fine of<br \/>\n                    Rs.100\/- &amp; in default, to further<br \/>\n                    undergo one month&#8217;s S.I.\n<\/p>\n<\/p>\n<p>2.   Brief facts leading to this appeal are that Sikandar<\/p>\n<p>Khan (PW 11) lodged a written report Ex.P.32 at Police<\/p>\n<p>Station, Bagra, Distt. Jalore on 5.7.2002 alleging<br \/>\n<span class=\"hidden_text\">                             5<\/span><\/p>\n<p>therein that when he alongwith his family members<\/p>\n<p>were sitting in their khatedari well, accused Shakur<\/p>\n<p>Khan, Aasin Khan, Amare Khan, Shere Khan, their<\/p>\n<p>mother and two other ladies, came in their field and<\/p>\n<p>accused Aasin Khan inflicted head blow on his father Ali<\/p>\n<p>Khan with axe, Shakur Khan inflicted injury on the<\/p>\n<p>hand of his mother Indra with iron rod and Amare Khan<\/p>\n<p>and other ladies inflicted injuries on his wife and<\/p>\n<p>daughter and Sheru Khan inflicted blows with kicks &amp;<\/p>\n<p>lathi. Upon seeing his father died, he rushed to the<\/p>\n<p>police station. Upon this report, the police registered a<\/p>\n<p>case and after investigation, all the accused were<\/p>\n<p>challaned for the offences u\/ss.147, 148, 302, 324 and<\/p>\n<p>323\/149 IPC before the Court of learned Judicial<\/p>\n<p>Magistrate, who committed the case to the court of<\/p>\n<p>Sessions. Learned trial Judge heard the arguments on<\/p>\n<p>charge and framed charges for the offences u\/ss.148,<\/p>\n<p>302 or in alternative 302\/149, 324 or in alternative<\/p>\n<p>324\/149 and 323 or in alternative 323\/149 IPC. All the<\/p>\n<p>accused appellants pleaded not guilty and claimed trial.<br \/>\n<span class=\"hidden_text\">                                 6<\/span><\/p>\n<p>The    prosecution   examined             21   witnesses.     The<\/p>\n<p>statements of the accused were recorded u\/s.313<\/p>\n<p>CrPC. They produced 5 witnesses in their defence.<\/p>\n<p>After hearing the arguments, the learned trial Judge<\/p>\n<p>convicted the accused appellants as above, against<\/p>\n<p>which this appeal has been preferred. During pendency<\/p>\n<p>of the appeal, accused Teke Khan died and proceedings<\/p>\n<p>against him were consequently abated vide order<\/p>\n<p>dt.18.5.06.\n<\/p>\n<\/p>\n<p>3.    Learned   counsel   for       the    appellants   has   not<\/p>\n<p>disputed the incident but his sole argument is that in<\/p>\n<p>this case, it was the complainant party, which first<\/p>\n<p>entered into the field of accused and in exercise of<\/p>\n<p>right of private defence, accused Aasin Khan is said to<\/p>\n<p>have inflicted axe blow on the head of deceased Ali<\/p>\n<p>Khan, where he died. According to him, there is no role<\/p>\n<p>of other accused appellants, except giving kicks and<\/p>\n<p>inflicting lathi blows. He further submits that there was<\/p>\n<p>no question of formation of unlawful assembly so as to<br \/>\n<span class=\"hidden_text\">                            7<\/span><\/p>\n<p>convict them for the offence u\/s.148 IPC or any other<\/p>\n<p>section of the Indian Penal Code with the aid of Section<\/p>\n<p>149 IPC.\n<\/p>\n<\/p>\n<p>4.   Per   contra,   learned   Public   Prosecutor   has<\/p>\n<p>supported the judgment of the learned trial Court and<\/p>\n<p>has urged to dismiss this appeal.\n<\/p>\n<\/p>\n<p>5.   We have re-appreciated the evidence on record. It<\/p>\n<p>is an admitted position that the incident took place in<\/p>\n<p>the field of accused party and the site plan proved by<\/p>\n<p>the prosecution is Ex.P.2 in which mark `X&#8217; is shown to<\/p>\n<p>be place of incident being situated in Khasra No.61 &amp;<\/p>\n<p>the field of complainant party has been marked at<\/p>\n<p>place `C&#8217; being Khasra No.53. The fields marked `A&#8217;,<\/p>\n<p>`B&#8217; &amp; `D&#8217; are of neighbourers. The portion marked `E<\/p>\n<p>to F&#8217; and `G to H&#8217; is the sign of cultivating the field<\/p>\n<p>from the tractor. The description of the site plan has<\/p>\n<p>been given in Crime Details Form marked Ex.P.1 in<\/p>\n<p>which it has been stated that mark `X&#8217; being Khasra<br \/>\n<span class=\"hidden_text\">                            8<\/span><\/p>\n<p>No.61 has come in the share of accused appellant Teke<\/p>\n<p>Khan, who has now died, in partition. It is also<\/p>\n<p>admitted position that cross cases were registered vide<\/p>\n<p>Ex.D.1 but the police has given the Final Report in the<\/p>\n<p>matter. When from the site plan Ex.P.1, the field<\/p>\n<p>Khasra No.61 is in the share of accused appellant Teke<\/p>\n<p>Khan, then the presence of rest of the accused<\/p>\n<p>appellants, who are family members of Teke Khan<\/p>\n<p>cannot be said to be unlawful so as to bring the case<\/p>\n<p>under the category of formation of unlawful assembly.<\/p>\n<p>It is true that axe blow has been inflicted by accused<\/p>\n<p>appellant Aasin Khan and these two blows on the scalp<\/p>\n<p>and chest of deceased Ali Khan, as per the version of<\/p>\n<p>Dr.Vallabh Bhandari (PW 15), who conducted the post<\/p>\n<p>mortem report vide Ex.P.34, were the cause of death.<\/p>\n<p>A separate report has also been given to this effect<\/p>\n<p>which is Ex.P.35. The same is the statement of<\/p>\n<p>Dr.R.C.Chouhan, who was the member of the Medical<\/p>\n<p>Board, which conducted the post mortem. When the<\/p>\n<p>cause of death is axe blows, then it is to be seen as to<br \/>\n<span class=\"hidden_text\">                              9<\/span><\/p>\n<p>who is the author of these blows. In this regard,<\/p>\n<p>Sikandar Khan (PW 11), who is the son of deceased,<\/p>\n<p>has said that the disputed field was jointly cultivated<\/p>\n<p>by them. When his father went to the accused as to<\/p>\n<p>why they were cultivating the joint field, then accused<\/p>\n<p>Aasin Khan came on the spot and told that how they<\/p>\n<p>were demanding their share and thereupon, he inflicted<\/p>\n<p>axe blows on the head of his father and rest of the<\/p>\n<p>accused, who were having lathis in their hands and<\/p>\n<p>Smt.Bhima, who was having no weapon in her hand,<\/p>\n<p>inflicted blows. When his wife and mother came to<\/p>\n<p>intervene, accused Aasin Khan also inflicted axe blows<\/p>\n<p>on them. Accused Shakur Khan inflicted lathi blow on<\/p>\n<p>his wife. On hearing the cries, he went on the spot and<\/p>\n<p>seeing the incident, he left for the police station.<\/p>\n<p>6.   Smt.Indra (PW 12), wife of deceased, is also an<\/p>\n<p>injured   witness.   While    stating   about   the    joint<\/p>\n<p>possession of his husband and accused party over the<\/p>\n<p>field, she has deposed that accused Aasin Khan came<br \/>\n<span class=\"hidden_text\">                             10<\/span><\/p>\n<p>with tractor and started cultivation. When her husband<\/p>\n<p>intervened, he inflicted axe blow on her husband. Rest<\/p>\n<p>of the accused also inflicted lathi blows. When she<\/p>\n<p>alongwith her daughter in law went to interfere,<\/p>\n<p>accused Aasin Khan inflicted axe blow on her.<\/p>\n<p>7.   Smt.Sukhi (PW 13) is also an injured witness. She<\/p>\n<p>has also stated the same version.\n<\/p>\n<\/p>\n<p>8.   Ms.Apiya (PW 14) is also eye witness of the<\/p>\n<p>incident. Her statement is also on the same line.<\/p>\n<p>9.   If the evidence of these four witnesses is looked<\/p>\n<p>into in the light of the statement of the investigating<\/p>\n<p>officer Mahendra Singh (PW 21), it is clear from the<\/p>\n<p>last line of his cross examination that as per his<\/p>\n<p>investigation, he found that except accused Aasin Khan<\/p>\n<p>and Shakur Khan, rest of the accused inflicted blows<\/p>\n<p>with fists and slaps only and, therefore, lathis could not<\/p>\n<p>be recovered. Though the recovery of lathi has been<br \/>\n<span class=\"hidden_text\">                                11<\/span><\/p>\n<p>shown from Shakur Khan vide Ex.P.12 but the cause of<\/p>\n<p>death, as per the post mortem report Ex.P.34 &amp;<\/p>\n<p>Ex.P.35, is the injuries on chest and head, which are<\/p>\n<p>shown in the injury report, Ex.P.18, which have been<\/p>\n<p>caused by sharp edged weapon. Ofcourse lathi cannot<\/p>\n<p>be said to be a sharp edged weapon, therefore, it<\/p>\n<p>cannot be said that these injuries were caused by<\/p>\n<p>Shakur Khan by lathi on the person of deceased Ali<\/p>\n<p>Khan. These injuries are the result of axe blows, which<\/p>\n<p>was in the hands of accused Aasin Khan and the same<\/p>\n<p>has also been recovered from him.\n<\/p>\n<\/p>\n<p>10. From the above evidence, it can safely be arrived<\/p>\n<p>at the conclusion that the author of the injuries on the<\/p>\n<p>chest and head    on the person of deceased Ali Khan<\/p>\n<p>was accused appellant Aasin Khan for which he can be<\/p>\n<p>conclusively   held   liable        for   committing   culpable<\/p>\n<p>homicide. Since unlawful assembly has not been<\/p>\n<p>established and accused were sitting in their field as<\/p>\n<p>per the site plan Ex.P.1 and dispute arose with regard<br \/>\n<span class=\"hidden_text\">                             12<\/span><\/p>\n<p>to cultivation of the field by tractor, the only conclusion<\/p>\n<p>which can be arrived-at is that all the accused acted in<\/p>\n<p>exercise of right of private defence including the<\/p>\n<p>accused appellant Aasin Khan. When a person acts in<\/p>\n<p>exercise of right of private defence &amp; exceeds his right<\/p>\n<p>by causing death of another, then it is a case of<\/p>\n<p>culpable homicide not amounting to murder punishable<\/p>\n<p>under Section 304 part I IPC, being a case of<\/p>\n<p>Exception-2 defined under Section 300 IPC. Therefore,<\/p>\n<p>in our view, the act of the accused appellant Aasin<\/p>\n<p>Khan is covered under Section 304 part I IPC. So far as<\/p>\n<p>rest of the accused are concerned, they have inflicted<\/p>\n<p>injuries with slaps and fists and accused Shakur Khan<\/p>\n<p>by lathi, which is alleged to have been recovered from<\/p>\n<p>him. Smt.Indra (PW 12) &amp; Smt.Sukhi (PW 13) are the<\/p>\n<p>injured witnesses and their injuries are simple in<\/p>\n<p>nature, caused by blunt weapon as per their injury<\/p>\n<p>reports Ex.P.16 and Ex.P.17 respectively. Therefore,<\/p>\n<p>the act of the rest of the three accused falls under<\/p>\n<p>Section 323 IPC and they can be held liable for that<br \/>\n<span class=\"hidden_text\">                             13<\/span><\/p>\n<p>offence only.\n<\/p>\n<\/p>\n<p>11. Consequently, while allowing this appeal in part,<\/p>\n<p>we alter the judgment dt.26.3.2003 passed by the<\/p>\n<p>Additional Sessions Judge (F.T.), Jalore as under:<\/p>\n<p>(i)    Accused appellant Aasin Khan is convicted only for<\/p>\n<p>the offence under Section 304 part I IPC instead of<\/p>\n<p>Section 302 IPC and is sentenced to the period already<\/p>\n<p>undergone, which is about seven years, with a fine of<\/p>\n<p>Rs.1000\/- &amp; in default, to further undergo one year&#8217;s<\/p>\n<p>S.I. However, he is acquitted for the rest of the<\/p>\n<p>offences i.e. under Sections 148, 324 and 323\/149 IPC.<\/p>\n<p>He is in jail, he be released forthwith, if not required in<\/p>\n<p>any other case, on depositing of fine.<\/p>\n<p>(ii)   Accused appellants Shakur Khan, Smt.Bhima and<\/p>\n<p>Amare Khan are convicted for the offence u\/s.323 IPC<\/p>\n<p>only and they are sentenced to the period already<\/p>\n<p>undergone, which is about five months, with a fine of<br \/>\n<span class=\"hidden_text\">                            14<\/span><\/p>\n<p>Rs.100\/- &amp; in default, to further undergo one month&#8217;s<\/p>\n<p>S.I. However, they are acquitted for the rest of the<\/p>\n<p>offences i.e. u\/ss.148, 302\/149 and 324\/149 IPC.<\/p>\n<p>(DEO NARAYAN THANVI), J.
