Justice S.SIRI JAGAN\n\n Dated :02\/08\/2010\n\n O R D E R\n                         S.SIRIJAGAN, J.\n                   ------------------------------------------\n                   WP (C) No. 22070 of 2010\n                   ---------------------------------------\n             Dated this the 2nd day of August, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>                           &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>      The petitioner is a student who completed the B.Tech<\/p>\n<p>Engineering Degree course after getting admission in the<\/p>\n<p>quota fixed for lateral entry students who passed Diploma<\/p>\n<p>courses in Engineering. Petitioner completed the course<\/p>\n<p>and obtained degree also.                   But when the petitioner<\/p>\n<p>approached the first respondent University for an<\/p>\n<p>eligibility certificate, the University has not granted the<\/p>\n<p>same, on the ground that there is doubt regarding the<\/p>\n<p>validity of the admission of the petitioner for the course<\/p>\n<p>itself. The contention of the petitioner is that the issue is<\/p>\n<p>clearly covered on Exhibit P12 decision of the division<\/p>\n<p>bench of      this Court           in     WP(C)No.11446\/2009        and<\/p>\n<p>connected cases.          Therefore the petitioner seeks the<\/p>\n<p>following reliefs:-\n<\/p>\n<p>    i.    &#8220;Issue a writ of certiorari or any other appropriate writ,<br \/>\n          direction or order calling for the records leading     to<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><br \/>\nWP (C) No. 22070 of 2010<\/p>\n<p>          Exhibit P9 and quashing the same.\n<\/p>\n<p>    ii.   Issue a writ of mandamus or any other appropriate writ,<br \/>\n          direction or order directing respondents 1 and 2 to issue<br \/>\n          Eligibility Certificate to the petitioner for his B.Tech<br \/>\n          Engineering     Degree    Course   in  Electronics    and<br \/>\n          Communication Engineering.\n<\/p>\n<p>    Iii.  Declare that the admission given to the petitioner under<br \/>\n          the Lateral Entry System in accordance with Exhibit P4<br \/>\n          Regulations for B.Tech Engineering Degree Course in<br \/>\n          Electronics and Communication Engineering in the<br \/>\n          Matha College of Technology, Manakkappadi in the year<br \/>\n          2005 is legal, regular and valid&#8221;.\n<\/p>\n<\/p>\n<p>     2. The learned standing counsel for the University<\/p>\n<p>does not dispute the applicability of Exhibit P12 judgment<\/p>\n<p>to the petitioner&#8217;s case. His only              contention is that,<\/p>\n<p>Exhibit P12 judgment has been taken in appeal before the<\/p>\n<p>Supreme Court and is pending. Even assuming that the<\/p>\n<p>appeal is pending and there is a stay, the ratio of Exhibit<\/p>\n<p>P12 decision has to be followed by single Judges of this<\/p>\n<p>Court.
