Case No.10\/2003 by the learned<br \/>\n\tSpecial Judge and Additional Sessions Judge (N.D.P.S.), Surat, by<br \/>\n\twhich the applicants (original accused nos.2,3,4 and 5) came to be<br \/>\n\tconvicted for the offences under Section 22 of the Narcotics and<br \/>\n\tPsychotropic Substances Act and sentenced to suffer rigorous<br \/>\n\timprisonment for 20 years and fine of Rs.2 lakhs each and in default<br \/>\n\tof payment of fine, to further suffer rigorous imprisonment for one<br \/>\n\tyear.\n<\/p>\n<p>The<br \/>\n\treasons as to why the Appeal could not be filed in time are detailed<br \/>\n\tin paragraphs 2, 3 and 4 of the Application. It is stated in the<br \/>\n\tapplication that the applicants belong to very poor family and they<br \/>\n\tare the only bread-earner and because of their long incarceration in<br \/>\n\tthe jail their families had gone hand to mouth and were badly<br \/>\n\tfinancially broken and, therefore, they could not arrange for money<br \/>\n\tfor filing the appeal in the high court in time. Beside this, they<br \/>\n\twere also not aware about the limitation for filing the appeal and<br \/>\n\tthey were ignorant about the law. Thereafter, they could manage the<br \/>\n\tfunds and contacted the advocate to file the appeal. In the said<br \/>\n\tprocess, considerable time has been consumed. It is, therefore,<br \/>\n\tprayed to condone the delay.\n<\/p>\n<p>Having<br \/>\n\theard Mr.Jaspalsingh Sodhi, learned advocate for the applicants,<br \/>\n\tMr.L.B.Dabhi, learned APP for the respondent   State of Gujarat<br \/>\n\tand upon perusal of the averments made in the Application, which<br \/>\n\thave remained uncontroverted and the celebrated principles governing<br \/>\n\tthe discretionary exercise of power conferred under Section 5 of the<br \/>\n\tAct, so also the reported decisions of the Hon&#8217;ble Supreme Court<br \/>\n\tconstruing Section 5 of the Act liberally, we are of the considered<br \/>\n\topinion that the applicants have aptly, elaborately and sufficiently<br \/>\n\texplained the delay caused in filing the above numbered Criminal<br \/>\n\tAppeal. There was no negligence or inaction on the part of the<br \/>\n\tapplicants in prosecuting the Appeal. The explanation offered by the<br \/>\n\tapplicants for condonation of delay is not only plausible, but<br \/>\n\tacceptable.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, according to us, this application deserves to<br \/>\n\tbe allowed by condoning the delay as prayed for.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application succeeds and accordingly it<br \/>\n\tis allowed. The delay of 28 days caused in filing the above-numbered<br \/>\n\tCriminal Appeal is condoned.
