WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This application  has been filed to recall the judgment<br \/>\ngiving various\tdirections; and to substitute in their place<br \/>\nthe directions\tsought for  in\tthe  prayer  clause  of\t the<br \/>\napplication.\n<\/p>\n<p>     As regards\t the first  prayer to recall the order dated<br \/>\nSeptember 2,   1994  with regard  to the  grant of the caste<br \/>\ncertificates, We do not think that it is advisable to recall<br \/>\nthe order  for the  reason that\t this court  had deliberated<br \/>\nupon  the   issue     and  entrusted   the  power  to  issue<br \/>\ncertificates of\t social status to a higher officer,  namely,<br \/>\nsub-Divisional officer,\t who is\t expected to  objectively go<br \/>\ninto the question and grant or refuse to grant social status<br \/>\ncertificates. Accordingly, we reject prayer (a).\n<\/p>\n<p>     As regards\t prayer (b)  read with\tdirection No.(iv) of<br \/>\nthe order of this court, we too appreciate the inconvenience<br \/>\ncaused due to vast area of the State. Therefore,  instead of<br \/>\none  committee\tof  three  officers,  there  will  be  three<br \/>\nscheduled Tribe Caste scrutiny committees comprising of five<br \/>\nmembers with  quorum  of  three\t members,  as  suggested  in<br \/>\nparagraph 4  of the directions, to take a decision. At Pune,<br \/>\nNasik and  Nagpur, six\tcaste scrutiny\tcommittees for SCs.,<br \/>\nDenotified Tribes,  Nomadic Tribes,  other Backward  Classes<br \/>\nand the\t special Backward  category in\texistence at Mumbai,<br \/>\nPune, Nasik,  Aurangabad, Amravati and Nagpur would continue<br \/>\nto scrutinise  the certificates\t issued\t by  the  respective<br \/>\nofficers and  take decision  in that behalf. In this regard,<br \/>\nit is  also suggested  by Shri\tDholakia  ,  learned  senior<br \/>\ncounsel for  the applicant  that in case any certificate has<br \/>\nbeen  wrongfully   refused  by\t the   certificate   issuing<br \/>\nauthority, the aforestated committees also would go into the<br \/>\nquestion and  decide in\t that behalf,  whether\trefusal\t was<br \/>\nwrongful and in case it finds that the\trefusal was wrongful<br \/>\nand in case it finds that the refusal was wrongful, they are<br \/>\nat liberty to direct the authority to grant the certificate.\n<\/p>\n<p>     With regard  to prayer (c) also, we feel that the Caste<br \/>\nScrutiny Committees for social welfare, Cultural Affairs and<br \/>\nsports\t Department   should\t  comprise   of\t  Additional<br \/>\nCommissioner (Revenue)\t-Chairman of  the concerned  Revenue<br \/>\nDivision;  Divisional  social  Welfare\tofficer-Member;\t and<br \/>\nResearch officer  as a\tWelfare officer-Member; and Research<br \/>\nofficer as a Welfare officer-Member-Secretary to function in<br \/>\nthat behalf.\n<\/p>\n<p>     With regard  to prayer  (d), along\t with the  vigilance<br \/>\ncell, one  Research  Officer\/Tribal  Development  or  social<br \/>\nWelfare officer\t would be  associated in  finding the social<br \/>\nstatus of eligibility of the officers.\n<\/p>\n<p>     The Application is accordingly ordered.
