Justice ANTONY DOMINIC\n\n Dated :28\/05\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                 W.P.(C) NO.16449 OF 2010 (E)\n              --------------------------------------------------\n             Dated this the 28th day of May, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner submits that he has been advised for being<\/p>\n<p>appointed as Police Constable. Vide Ext.P1 he is to undergo<\/p>\n<p>training under the 5th respondent which is to commence on<\/p>\n<p>29.5.2010. According to the petitioner, on the ground that he was<\/p>\n<p>an accused in C.C.No.1162\/2009 on the file of the Additional First<\/p>\n<p>Class Magistrate Court-II, Kanjirapally he is not likely to be<\/p>\n<p>admitted for training. It is further submitted that by judgment in<\/p>\n<p>Crl.M.C.No.907\/2010        dated 29th March, 2010, this court has<\/p>\n<p>already quashed the proceedings in the aforesaid criminal case<\/p>\n<p>and therefore the reason of pendency of criminal case is totally<\/p>\n<p>without any basis. It is contended that he is entitled to be<\/p>\n<p>admitted for training.\n<\/p>\n<p>      If as stated by the petitioner, the criminal case has been<\/p>\n<p>quashed by the judgment of this court and he is not involved in<\/p>\n<p>any other case, there is no reason why the petitioner shall not be<\/p>\n<p>admitted for training.\n<\/p>\n<p>WPC.No.16449 \/2010<br \/>\n<span class=\"hidden_text\">                                  :2 :<\/span><\/p>\n<p>      In view of this, I dispose of this writ petition directing that it<\/p>\n<p>will be open to the petitioner to produce a copy of the judgment<\/p>\n<p>before the 5th respondent, in which event it will be open to the 5th<\/p>\n<p>respondent to verify the matter and if he satisfied that apart from<\/p>\n<p>the crime case mentioned above, there is no other disqualifying<\/p>\n<p>matter, it is directed that the petitioner will be admitted for<\/p>\n<p>training.\n<\/p>\n<p>      Petitioner shall produce a copy of the judgment along with a<\/p>\n<p>copy of the writ petition before the 5th respondent for compliance.<\/p>\n<p>                                            (ANTONY DOMINIC)<br \/>\n                                                    JUDGE<br \/>\nvi\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Mohammed Rafeek vs The State Of Kerala And Others on 28 May, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 16449 of 2010(E) 1.
