It is submitted by the iearned Counsel for\n\npetitioner that the eariier Committee of the respondent No.4\n\ni\n\n\n\n-- Society came to an end on 31-03-2009. Under Section\n20(9) of the Karnataka Co--Operative Societies Act (in short\n\n&#039;the Act&#039;), the Committee seized the existence,_:7a_nd\n\naccordingly notification was issued to conduct e_l:e&#039;ctioVn.s:,\n\nit was postponed in view of the Parliamentary. 0\u00bb\n\n3. Thereafter, respondent?&#039; issued n  _\n\nconduct elections and furthelr-.cai.enda&#039;r ofie)\/e.nts,&quot;was&quot;jalso&#039;0\n\npublished. As per the ,caiendvar----fV.&#039;).f&#039;--e&#039;\\:&#039;--e,nts &#039;06&#039;+0.6:2i009 was\nthe date fixed for filing&quot;*iiemii:ai;iene,&#039;ie,&#039;p:?,:4e6-2009 was the\n\ndate fixed for filing._nominaVtions_:&#039;th:&#039;ro,ug&#039;h\u00abiproposess. O9--06--\n\n2009 w,asMtlh&#039;ei wji&#039;th:drawaVi&quot;olf nominations and 13-06-\n2009  the Ld&#039;a&#039;te_&#039;l&quot;foVr\u00bb..:conducting elections. In the\n\nmeantime, t&#039;he_rei.w&#039;asA&#039;*.disturbance in the society and the\n\n imiefigi cpacmepto be&#039;Ioci&lt;&#039;ed on 9.06.2009.\n\ni&#039;--is*~e.a&quot;_j.resuit the Returning Officer has postponed\n\nthe \u00bbeliectio.n:s:&#039;,,inldefinitely and has issued an endorsement on\n\nll&quot;=~v.___VCi9--O6--Z2.Q_i39 as per Annexure--K stating that in view of\n\n0  &quot;&#039;~uAriforje&#039;seen incidents the elections couid not be conciuded\n\nand accordingly it was posipfoned. Now, for more than six\n\n \n\n\n\nmonths no progress has taken place. Hence, he preferred\nthe present writ petition seeking direction for respondents to\n\nconduct the elections.\n\n5. The iearned counsel for petitioner subn_\u00a7i&#039;tsf&quot;g:&#039;th&#039;a.t\n\nunder Section 28-A (5) of the Act the  \n\nbeen appointed to the Society and t:ii&#039;de--r.Sei:&#039;tioii&#039;  of\n\nthe Act as early as possible within   \n\nof endorsement new Committe_:e&quot;~.has to,b&#039;e_c&#039;on&#039;stituted in &#039;&#039;\n\naccordance with law. Iai.owever,~-- \u00b0sa_i_d period is expired\n\nand the respondent haste&#039;Aho_I_d\u00a7&#039;I&#039;\u00bblelelctiionis&#039; from the stage\n\nwhere  He_W&#039;h&#039;a&#039;s further relied on the\nJudgment-. of V the&#039;j_&quot;A_pe.2tl&quot;&#039;\u00bb..Court in the case of N.P\n\nPoNNuswAM&quot;rvsit\u00ab.  returning officer, Namakkal\n\n&quot;&#039;\u00ab--:ons-t_itiue_e.ty,. nNan&#039;1&#039;Val&#039;&lt;k&#039;aiV, Salem District &amp; others (AIR (39)\n\n&quot;sc&#039;e\u00bb\u00a7i),&#039;i&#039;li\u00bb.i}iiereiti the Apex Court held that after the\n\ncalendar _e\\2eh&#039;ri:s is published and elections was later\n\n%\u00b0*.,.,_&quot;obstructed; the further elections to be conducted from the\n\n&quot;stag:e&quot;&#039;where it was stopped.\n\ni\n\nE\n\n\n\n(1\n\n6. The iearned counsel for respondent No.4\nsubmits that he has no objections to hold elections and the\nlearned Government i3!eader also supports the submissions\n\nmade by the learned counsel for Society.\n\n7. I have heard the arguments advanc\u00e9&#039;d--\u00ab&#039;.ibvy:_&quot;tinVe&quot;\u00ab_\n\nparties.\n\n8. From the material pilA&quot;aced_ll&#039;JinLietiigtionp\n\ncaiendar of events was pubiishe-.d an&quot;dV._the_&quot;electio&#039;nswash\n\nscheduied to be conducted on aslper Annexure--\n\nD. When the Officer&#039;#a_ppoi.n\u00a7te&#039;d  proceed for\n\nconducting .electi&#039;on~s_V,4&quot;therewas obstruction from discharging\n\nhis duty. Hence he &#039;has.-- an endorsement on 19~O6-\n\n_ 2009\u00a2,.\u00a7&#039;Hei.has &quot;stateid that some persons have iocked the\n\n  izvhjelrey the elections have to be conducted and in\n\n ti1ie_~v.s_anje&quot;&#039;he was prevented from discharging of his\n\n&#039;_duties; b-.yMco&quot;nducting elections and hence election was\n\n, ..   postponed&#039;.\n\n&#039;&#039; &#039;9. Even the period of six months was over in view\n\n of&quot;iSection 28-B (3) of the Act&#039; which cleariy says that &#039;as\n\n\n\nearly as possible within a period of six months from the date\nof such endorsement, the respondents should have taken\n\nsteps to hold the elections&#039;. From the submissions \n\nthe respective counsel, it is clear that no further&quot;&quot;actVi_o&#039;n \n\nbeen taken by the respondents for  \n\nFurther, in view of the Judgment \n\ncounsel for petitioner, the Apex_ Cou&#039;i&quot;t_rh&#039;as helclrth\u00e9ait  \n\nprocess of elections is obstructe-d_&#039;%&#039;by eith&#039;erfo&#039;i&#039;: the parties,\nthen the Returning Officer hastt&#039;o\u00ab._V_co&#039;ri\u00abtinue the election\nprocess thereafter from tpheistwaae  stopped&#039;.
