Justice K.HEMA\n\n Dated :17\/06\/2010\n\n O R D E R\n                               K.HEMA, J\n                           -----------------------\n                       B.A No.3398 OF 2010\n                      --------------------------------\n                Dated this the 17th day of June 2010\n\n                                 ORDER\n<\/pre>\n<p>         This petition is for bail.\n<\/p>\n<p>      2. The alleged offence is under Section 420 r\/w 34 IPC.<\/p>\n<p>According to prosecution, petitioner(A1) along with others in<\/p>\n<p>furtherance of their common intention cheated de facto<\/p>\n<p>complainant and others by inducing them to pay money, by<\/p>\n<p>making false representation that the institute run by the<\/p>\n<p>petitioner and others is under a Central Government department<\/p>\n<p>under the Ministry of Human Resources etc. promising to give job.<\/p>\n<p>But, money was not repaid and job was not arranged.<\/p>\n<p>      3. Petitioner was arrested on 10\/04\/2010. He is in custody<\/p>\n<p>for the past 68 days.      Taking into consideration the stage of<\/p>\n<p>investigation, Learned Public Prosecutor submitted that he has no<\/p>\n<p>objection in granting bail to petitioner.\n<\/p>\n<p>      4. On hearing both sides , I am satisfied that bail can be<\/p>\n<p>granted to petitioner. Hence the following order is passed:<\/p>\n<blockquote><p>           Petitioner shall be released on bail on executing<\/p>\n<p>     bond for Rs.50,000\/- (Rupees fifty thousand only) each<\/p>\n<p>     with two solvent sureties each for the like sum to the<\/p>\n<p>     satisfaction of the court concerned, on the following<\/p>\n<p>     conditions:\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">B.A No.3398 OF 2010                  2<\/span><\/p>\n<blockquote><p>           (i)   Petitioner shall report before the Investigating<\/p>\n<p>                 Officer on every Monday and Thursday<\/p>\n<p>                 between 10 A.M and 1 P.M.\n<\/p><\/blockquote>\n<blockquote><p>          (ii) Petitioner shall not influence or intimidate any<\/p>\n<p>                 witness or tamper with any evidence.<\/p>\n<\/blockquote>\n<blockquote><p>           (iii) Petitioner shall not leave the limits of the police<\/p>\n<p>                 station, within which the crime is registered,<\/p>\n<p>                 without      prior   permission    of    learned<\/p>\n<p>                 Magistrate.\n<\/p><\/blockquote>\n<blockquote><p>          (iv) In case petitioner is involved in any similar<\/p>\n<p>          case, his bail is liable to be cancelled.<\/p>\n<\/blockquote>\n<blockquote><p>                      Petition is allowed.<\/p><\/blockquote>\n<blockquote><p>                                                     K.HEMA<br \/>\n                                                      JUDGE<\/p>\n<p>vdv<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court C.Jayan vs The State Of Kerala Represented By on 17 June, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3398 of 2010() 1.
