1.\t\tRule
\nwas issued on 25.04.2011 returnable on 29.04.2011.  A certificate
\ndated 28.04.2011 was produced under the signature of Dr.S.Napoleon
\nSingh, wherein it is mentioned that:-\n<\/p>\n
“…..  Again he
\nwas referred to Civil Hospital Ahmedabad, psychiatric Dept. for
\nfollow up on 27\/04\/2011 and he was examined by Dr.M.N.Parikh (P
\nPsychiatric, H.O.U., Unit-I)<\/p>\n
On examination:\n<\/p>\n
Patient
\n\tpays fluctuating attention to the examiner.\n<\/p>\n
Is
\n\tmute.\n<\/p>\n
Occasionally
\n\tfollows verbal commands.\n<\/p>\n
Patient
\n\tdoes not answer relevantly, even with gestures.\n<\/p>\n
He was advised
\nantipsychiatric medicines for 15 days and advised follow up after 15
\ndays.\n<\/p>\n
This certificate is
\nissued on the basis of available case papers at central jail
\ndispensary.”\n<\/p>\n
2.\t\tOn
\n29.04.2011, the Court asked Dr.S.Napoleon Singh to explain to the
\nCourt the meaning of the remarks made in the certificate, viz.
\n“patient was found conscious and not fully oriented”.
\nThe matter was then adjourned to 04.05.2011 so as to find out whether
\nthe release of the convict will cause any burden to the family.\n<\/p>\n
2.1\t\tOn
\n04.05.2011, the matter was adjourned to 11.05.2011.  Along with
\ncommunication dated 01.\/03.05.2011, a statement of the convict was
\nproduced.  The Court, prima facie, found the conclusions mentioned by
\nthe Doctor on the basis of the record, liable to be verified and
\ntherefore, on 11.05.2011, the jail authorities were directed to
\nproduce the convict before the Court.\n<\/p>\n
3.\t\tToday,
\nthe convict is present before the Court.  The Court put various
\nquestion to him and he replied the same in detail.  To the utmost
\nsurprise of the Court, none of the observations made by Dr.M.N.Parikh
\nis noticed in the behaviour of the convict.  This Court, in
\ninteraction with the convict and taking into consideration his
\nresponse to the queries made by the Court, deemed it proper to
\ndiscuss the matter with Doctor as well as Jail Officer.\n<\/p>\n
3.1\t\tDr.S.Napoleon
\nSingh along with Senior Jailor Shri Vankar remained present before
\nthe Court.  The matter was taken up in chamber.\n<\/p>\n
3.2\t\tDr.S.Napoleon
\nSingh talked to the patient-convict on various points and then stated
\nthat, ‘he is of the opinion that the observations made by
\nDr.M.N.Parikh are not found to be present in the convict’.  But them
\nhe stated that,  ‘this may be because of medication’.\n<\/p>\n
3.3\t\tSenior
\nJailor Mr.Vankar also talked to the convict.  He stated that it is
\ntrue that the convict does not talk to other inmates in jail, but the
\nconvict does talk to him, may be because the other inmates brand him
\nas a ‘mental case’, by which he may getting disturbed.\n<\/p>\n
3.4\t\tThe
\nconvict stated that when he was at Jamnagar jail, he was not having
\nany problem which are faced by him in Ahmedabad Jail.  Besides
\neverything, he is able to convey to this Court that while he was in
\nJamnagar jail, it was convenient for his father and minor son, who is
\naged 11 years to visit him.  He stated that when he was arrested on
\n02.07.2003, at that time, his son was hardly 3 years old.  He stated
\nthat it is very inconvenient for his father and son to visit him in
\nAhmedabad jail.  He also conveyed to this Court that this not only
\ntroubles them but to him as well.  He is also able to remember and
\nconvey to this Court that, once when his father and minor child were
\ncoming to visit him in jail, while crossing the railway lines, his
\nfather had fallen on the railway track and his life was saved by one
\nArmy Personnel and when they narrated this incident to the convict,
\nhe had sleepless night.\n<\/p>\n
4.\t\tAll
\nthis narration is suggestive of the fact that the observations made
\nby Dr.M.N.Parikh, Psychiatric are not present in the conduct of the
\nconvict.  While this Court is not to record any finding about the
\nstate of health of the convict, the Court will definitely like to
\nrefer the case to the Civil Surgeon for being examined by a team of
\nexperts.  But, that exercise should be undertaken not at Ahmedabad,
\nbut at some other station.\n<\/p>\n
5.\t\tTaking
\ninto consideration the fact that the convict was comfortable in
\nJamnagar jail, his presence at Jamnagar will be causing less trouble
\nto the family, in turn it will give some psychological respite to the
\nconvict, it is ordered that the convict be transferred from Ahmedabad
\nCentral Jail to Jamnagar Jail, on his return from temporary bail
\nwhich is granted by this very order.\n<\/p>\n
6.\t\tTaking
\ninto consideration the facts of the case and taking into
\nconsideration the fact that in the year 2006, he was granted furlough
\nand he had reported in time, but when he was granted furlough in the
\nyear 2008, he absconded for 787 days, for which he has given an
\nexplanation that, ‘as his wife had expired, his parents being aged,
\nthere was nobody to take care of his child and therefore, he was
\nresiding at his own place’, the Court is of the opinion that he can
\nbe granted temporary bail.\n<\/p>\n
7.\t\tAccordingly
\nthe application is allowed.  The applicant-convict is ordered to
\nbe released on temporary bail for a period of 45 days from the
\ndate of his release, on his executing a personal bond of Rs.5,000\/-
\n(Rupees Five Thousand Only) to the satisfaction of the Jail
\nauthorities.\n<\/p>\n
\t\tIn
\nview of the fact of his absconding, the convict shall mark his
\npresence at the ‘Bhatiya’ Police Chowki on every Monday between 08.00
\nam to 12.00 pm.<\/p>\n
8.\t\tThe
\napplicant shall surrender to the Jail authorities on expiry of the
\ntemporary bail period.\n<\/p>\n
9.\t\tRule is made
\nabsolute.\n<\/p>\n
\t\tTaking
\ninto consideration the aforesaid facts, Registry is directed to
\nnotify the Criminal Appeal for final hearing in the week commencing
\nfrom 20.06.2011.\n<\/p>\n
