No.18780\/2010-V\n              ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n         Dated this the 8th day of December, 2010\n\n                    J U D G M E N T\n<\/pre>\n<p>    The    petitioner    herein   is    aggrieved    by<\/p>\n<p>confiscation of vehicle, of which he is the registered<\/p>\n<p>owner, under the Kerala Protection of River Banks and<\/p>\n<p>Regulation of Removal of Sand Act, 2001.<\/p>\n<p>    2.   Ext.P4 is the order passed by the District<\/p>\n<p>Collector.  Mainly it is contended that the seizure was<\/p>\n<p>illegal.  The vehicle was not carrying any sand at the<\/p>\n<p>relevant time.  It is further pointed out that the copy<\/p>\n<p>of the seizure mahazar and the copy of FIR have not<\/p>\n<p>been served to the driver of the vehicle or to the<\/p>\n<p>petitioner and no independent witnesses have signed the<\/p>\n<p>mahazar also.  It is also his case that he has taken<\/p>\n<p>photographs and video and there are witnesses to prove<\/p>\n<p>his case.  Earlier, he approached this Court by filing<\/p>\n<p>W.P.(C).No.11696\/2010 and this Court by Ext.P3 Judgment<\/p>\n<p>dated 05\/04\/2010 directed the District Collector to<\/p>\n<p>pass final orders and, accordingly, Ext.P4 order has<\/p>\n<p>been passed.\n<\/p>\n<p>W.P.(C). No.18780\/2010<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>     3.      The learned counsel for the petitioner relied<\/p>\n<p>upon the decisions of this Court in       <a href=\"\/doc\/272915\/\">Moosakoya v. State<\/p>\n<p>of Kerala<\/a> [2008 (1) KLT 538 (DB)], <a href=\"\/doc\/63167\/\">Subramanian v. State<\/p>\n<p>of Kerala<\/a> [2009 (1) KLT 77] and that of the Full Bench<\/p>\n<p>in <a href=\"\/doc\/112271\/\">Shan C.T v. State of Kerala and others<\/a> [2010 (3) KHC<\/p>\n<p>333].\n<\/p>\n<\/p>\n<p>     4.      Rule 27 of the Protection of River Banks and<\/p>\n<p>Regulation of Removal of Sand Rules, 2001 (Kerala)<\/p>\n<p>concerns procedure for confiscation of vehicles which<\/p>\n<p>reads as follows:-\n<\/p>\n<\/p>\n<blockquote><p>             &#8220;(1) The Police or Revenue officials shall<\/p>\n<p>                   seize the vehicle used for transporting<\/p>\n<p>                   sand in violation of the provisions of<\/p>\n<p>                   the Act and these Rules.<\/p><\/blockquote>\n<p>             (2) In the case of seizure of vehicle under<\/p>\n<p>                   sub-section  (1),  a  mahazar  shall  be<\/p>\n<p>                   prepared in the presence of two witnesses<\/p>\n<p>                   regarding the vehicle and one copy of the<\/p>\n<p>                   same  shall   be  given  to  the   person<\/p>\n<p>                   possessing the vehicle at the time of<\/p>\n<p>W.P.(C). No.18780\/2010<br \/>\n<span class=\"hidden_text\">                               -:3:-<\/span><\/p>\n<p>                   seizure and one copy to the District<\/p>\n<p>                   Collector.\n<\/p>\n<p>\n             (3) The vehicle may be returned if the owner<\/p>\n<p>                   of the vehicle or the possessor remits an<\/p>\n<p>                   amount  towards    River Management   Fund<\/p>\n<p>                   equal to the price fixed by the District<\/p>\n<p>                   Collector with fine within seven days of<\/p>\n<p>                   seizure.&#8221;\n<\/p>\n<p>\nGoing by the same, a copy of the mahazar should be<\/p>\n<p>given to the person possessing the vehicle at the time<\/p>\n<p>of   seizure.         Here,  the    perusal of   the  records<\/p>\n<p>maintained by the police does not show that a copy of<\/p>\n<p>the mahazar was given to the driver who was driving the<\/p>\n<p>vehicle at that point of time.         It is also the case of<\/p>\n<p>the petitioner that in the absence of mahazar he was<\/p>\n<p>not in a position to know what is the offence he has<\/p>\n<p>committed.\n<\/p>\n<\/p>\n<p>     5.      In Shan C.T.&#8217;s case [2010 (3) KHC 333] it was<\/p>\n<p>held in paragraph (13) as follows:-<\/p>\n<p>W.P.(C). No.18780\/2010<br \/>\n<span class=\"hidden_text\">                               -:4:-<\/span><\/p>\n<p>                   &#8220;&#8230;&#8230;&#8230;&#8230;It is also made clear that to<\/p>\n<p>             avoid any controversy and the allegations of<\/p>\n<p>             undue delay on the part of either party to the<\/p>\n<p>             proceedings, the competent authority shall put<\/p>\n<p>             the owner on notice within a period of three<\/p>\n<p>             days of the date of seizure and the owner or<\/p>\n<p>             any other person interested in the vehicle<\/p>\n<p>             shall file his objections to the confiscation<\/p>\n<p>             within a week thereafter.&#8221;\n<\/p>\n<\/p>\n<p>     6.      Here,    we  are  mainly   concerned  with  the<\/p>\n<p>question whether the non compliance of Rule 27 of the<\/p>\n<p>Rules as well as the procedure for giving a copy to the<\/p>\n<p>concerned,        invalidate   the   seizure  itself.      In<\/p>\n<p>Subramanian&#8217;s case [2009 (1) KLT 77] in paragraph (54)<\/p>\n<p>it was held that:-\n<\/p>\n<\/p>\n<blockquote><p>                   &#8220;&#8230;&#8230;&#8230;&#8230;It requires to be mentioned<\/p>\n<p>             in this context that the provisions in R.27(2)<\/p>\n<p>             are mandatory.     On seizure of a vehicle, a<\/p>\n<p>             mahazar is to be drawn, in the presence of two<\/p>\n<p>             witnesses and a copy of the same is to be<\/p>\n<p>             straight    away   supplied   to   the  persons<\/p>\n<p>W.P.(C). No.18780\/2010<br \/>\n<span class=\"hidden_text\">                               -:5:-<\/span><\/p>\n<p>             possessing the vehicle and a copy will have to<\/p>\n<p>             be sent to the District Collector.   I have no<\/p>\n<p>             doubt    that  a violation  of  the  procedure<\/p>\n<p>             contemplated under R.27(2) would definitely<\/p>\n<p>             give rise to an attack against the seizure<\/p>\n<p>             itself, as being illegal and this court would<\/p>\n<p>             be    certainly justified   in  upholding  the<\/p>\n<p>             contention raised by any person, who alleges<\/p>\n<p>             the    haphazard manner  in  which R.27(2)  is<\/p>\n<p>             violated in several cases.&#8221;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>Therefore, the said aspect will have to be verified<\/p>\n<p>with the records maintained by the police and any other<\/p>\n<p>relevant records.\n<\/p>\n<\/p>\n<p>     7.      Apart from the same, the learned counsel for<\/p>\n<p>the petitioner submitted that he will be able to<\/p>\n<p>substantiate his arguments that the vehicle did not<\/p>\n<p>contain any sand at the time of seizure by producing<\/p>\n<p>videos     and    witnesses.    Evidently, in  the  enquiry<\/p>\n<p>already conducted, those aspects were not put forth by<\/p>\n<p>the petitioner.         But, since the confiscation of the<\/p>\n<p>vehicle causes adverse consequences, it is only proper<\/p>\n<p>W.P.(C). No.18780\/2010<br \/>\n<span class=\"hidden_text\">                                -:6:-<\/span><\/p>\n<p>that     an   opportunity    is   given  to  the  petitioner.<\/p>\n<p>Therefore, Ext.P4 will stand quashed on the above<\/p>\n<p>grounds.\n<\/p>\n<\/p>\n<p>     8.      There will be a direction to the District<\/p>\n<p>Collector to reconsider the matter in accordance with<\/p>\n<p>the above findings.        The petitioner will be allowed to<\/p>\n<p>produce witnesses or other evidences in support of the<\/p>\n<p>plea.       The alleged violation of Rule 27(2) of the<\/p>\n<p>Protection of River Banks and Regulation of Removal of<\/p>\n<p>Sand     Rules,     2001   (Kerala)   will  be  examined and<\/p>\n<p>appropriate final order will be passed within a period<\/p>\n<p>of one month from the date of receipt of a copy of this<\/p>\n<p>Judgment.       The dictum laid down by this Court in the<\/p>\n<p>Judgments       relied    on  by    the  petitioner and  its<\/p>\n<p>implication on the facts of this case will also be gone<\/p>\n<p>into.\n<\/p>\n<\/p>\n<p>     9.      The     learned  counsel   for   the  petitioner<\/p>\n<p>submitted that in the light of the Full Bench decision<\/p>\n<p>in Shan C.T&#8217;s case [2010 (3) KHC 333], the petitioner<\/p>\n<p>is entitled for release of the vehicle on payment of<\/p>\n<p>30% of the value of the vehicle.             If he files an<\/p>\n<p>W.P.(C). No.18780\/2010<br \/>\n<span class=\"hidden_text\">                               -:7:-<\/span><\/p>\n<p>application for interim custody of the vehicle, that<\/p>\n<p>also     will     be  considered    in accordance with  the<\/p>\n<p>directions       of   the Full  Bench  as  expeditiously as<\/p>\n<p>possible.       The writ petition is disposed of as above.<\/p>\n<p>No costs.\n<\/p>\n<\/p>\n<p>                           (T.R.
