Venkatarama Reddi, J.\n<\/p>\n<p>\tThe petitioner is a Trade-Union of workmen which is seeking<br \/>\nto enforce the claim of its members employed in 223 depots of Food<br \/>\nCorporation of India (&#8216;FCI&#8217; for short) under the Direct Payment<br \/>\nSystem (hereinafter referred to as &#8216;DPS&#8217;) for payment of wages at par<br \/>\nwith departmental workmen of FCI.  It is contended that the direct<br \/>\npayment system having been given a go-bye for good and direct<br \/>\nrelationship of employer and employee having been established<br \/>\nbetween the labour force governed by DPS and the Management, the<br \/>\nRespondent-Corporation is under an obligation to accord the same<br \/>\ntreatment to them as is being given to the departmentalised\/absorbed<br \/>\nworkmen.  It is submitted that the nature,  type of work and the<br \/>\nmodalities of carrying out the handling work by the DPS workers and<br \/>\nthe departmental workers  in the various depots of FCI is the same and<br \/>\ntherefore denial of equal wages and other service benefits to the DPS<br \/>\nworkers is arbitrary,  discriminatory and violative of Articles 14 and<br \/>\n21 of the Constitution.\t In short, this petition under Article 32 is based<br \/>\non the plea of equal pay for equal work.   A writ to direct the<br \/>\nRespondent-Corporation to grant same wages, allowances, status and<br \/>\nother benefits to the handling workers employed on DPS in 223<br \/>\ndepots as are available to departmentalised handling workers.  Certain<br \/>\nother ancillary reliefs are sought for.\t A comparative chart showing<br \/>\nthe wages and other fringe benefits available to these two categories<br \/>\nof workers has been given in Exhibit P-8.  In the course of the<br \/>\narguments, the learned senior counsel appearing for the petitioner has<br \/>\nendeavoured  to develop her argument founded on equal pay for equal<br \/>\nwork by seeking support from various decisions of this Court.  Much<br \/>\nreliance has also been placed on the Award dated 1.4.1991 of the<br \/>\nNational Industrial Tribunal, Bombay,  rendered in the context of<br \/>\nsimilar relief claimed by DPS workmen of 55 depots.\n<\/p>\n<p>In the Counter-affidavit filed on behalf of the first respondent, it<br \/>\nis not disputed that the nature of work done by the DPS workers and<br \/>\nthe departmental workers is substantially the same.  But, it is<br \/>\ncontended that the quantum of work done by the handling Mazdoor<br \/>\nunder DPS is not identical to the turnover of work of departmental<br \/>\nlabour.\t In this context, it is pointed out in paragraph 5 that the work<br \/>\nload varies from depot to depot and even within the same depot there<br \/>\nare variations in working pattern in the light of such factors as volume<br \/>\nof procurement, off-take of food grains from the godowns etc.  The<br \/>\nseasonal character of food handling operation in various depots has<br \/>\nalso been stressed.  While asserting that in view of the large variations<br \/>\nin the working pattern and work load, the contract labour system is<br \/>\nbetter suited to the needs of FCI,  it is pointed out that on account of<br \/>\nthe agitation launched by the Workers union, the Management had no<br \/>\nalternative but to agree  for abolition of contract labour system and<br \/>\nintroducing DPS or &#8216;no work no pay&#8217; system in lieu of contract<br \/>\nlabour.\t Reference has been made to various settlements arrived at<br \/>\nbetween FCI Management and FCI workers union in this connection.<br \/>\nThe initiative in this regard was taken pursuant to the understanding<br \/>\nreached for the first time on 23.5.1973, according to which the<br \/>\ndepartmental labour system as well as the direct payment system<br \/>\ncould be maintained depending on the local requirements.  It is stated<br \/>\nthat except at Ghevra depot, nowhere departmental labour as well as<br \/>\nDPS labour is engaged simultaneously in the same depot\/godown.\tIt<br \/>\nis pointed out that as against 223 depots mentioned in the writ<br \/>\npetition, 215 depots are governed by DPS and 7 depots in A.P. State<br \/>\nare actually functioning under no work no pay system.  It is claimed<br \/>\nthat each depot is and is being treated as separate establishment and is<br \/>\nbeing run by the respective labour systems viz., departmental, DPS,<br \/>\nno work no pay.\t Only in Ghevra depot, the dual labour system is<br \/>\nexisting.  It is reiterated that DPS system of labour has been<br \/>\nintroduced in various depots pursuant to mutual understanding<br \/>\nbetween the Management and labour unions and their terms and<br \/>\nconditions are\tregulated as per  mutual negotiations and settlements.<br \/>\nGiving the details of mode of payment in paragraph 9, it is stated as<br \/>\nfollows :-\n<\/p>\n<p>&#8220;Under this system the payment is made to the<br \/>\nLabourers on the basis of above schedule of rates<br \/>\nagreed between FCI Management and the<br \/>\nPetitioner Union.  These workers are piece-rated<br \/>\nworkers and whatever the work done by them on<br \/>\nthe basis of Schedule of Rates, the payment is<br \/>\nreleased to them subject to minimum guaranteed<br \/>\nwages which is at present Rs.107\/- of Handling<br \/>\nLabour per day.\t The Schedule of Rates and<br \/>\nMinimum Guaranteed wages are revised after<br \/>\nevery 2 years on the basis of the increase in the All<br \/>\nIndia Consumer Price Index, as per settlement<br \/>\nsigned between FCI Management and Petitioner<br \/>\nUnion.&#8221;\n<\/p>\n<p>It is then pointed out that the FCI workers union has already raised an<br \/>\nindustrial dispute before the Regional Labour Commissioner (Central)<br \/>\nNew Delhi, wherein the issue of parity of wages has been focussed.<br \/>\nMoreover, it is stated that individual DPS labourers of about 46 depots<br \/>\nhave filed petitions in Delhi High Court seeking the same relief.  As<br \/>\nregards the award of National Industrial Tribunal, Bombay, pertaining<br \/>\nto 55 DPS depots, it is stated that the award was challenged in the<br \/>\nDelhi High Court both by the Workers union and the Management<br \/>\nand the writ petitions were disposed of by the High Court on 1.8.1995<br \/>\nin terms of the settlement dated 1.11.1994.  Therefore, the said award<br \/>\ndoes not hold the field.\n<\/p>\n<p>On the above grounds, which were reiterated in the course of<br \/>\narguments by the learned senior counsel appearing for the 1st<br \/>\nrespondent, it is contended that the principle of equal pay for equal<br \/>\nwork has no application here.  It is stressed, the need and legitimacy<br \/>\nof direct payment system has been recognised by all concerned and<br \/>\nthe system itself has come into vogue as a result of negotiations and<br \/>\nagreements between the Union of Workmen and the Management.<br \/>\nHaving regard to the pleadings of the parties and the factual<br \/>\ncontroversy involved, we are of the view that it would not be<br \/>\nappropriate for this Court to record its conclusions on merits.\t In order<br \/>\nto give effect to the principle of equal pay for equal work, which is no<br \/>\ndoubt a constitutional obligation implicit in Article 14, we have to<br \/>\nenter into the factual arena and embark on an investigation of disputed<br \/>\nfacts such as the work load and the working pattern in various depots<br \/>\nof the Food Corporation of India.  The mere fact that the qualitative<br \/>\nnature of work performed by DPS workers and the departmental<br \/>\nworkers is the same, is not conclusive.\t Other aspects highlighted in<br \/>\nthe counter-affidavit having a bearing on the volume and duration of<br \/>\nwork in the depots have to be gone into.   Incidentally, the<br \/>\njustification and expediency of continuing the Direct Payment System<br \/>\nwhich has been recognized by various settlements has to be looked<br \/>\ninto. A comparative study of the working pattern in various depots,<br \/>\nthe overall job requirements and the overall effect it will have on the<br \/>\nbody of workmen as a whole and the Management, are all matters that<br \/>\nmay be relevant to consider. It is not a case of mere application of a<br \/>\nlegal principle to the admitted or undeniable facts.  But, it depends on<br \/>\nconcrete facts brought out in evidence.\t When the same issue is\t being<br \/>\nagitated by the petitioner-union by raising an industrial dispute, it is<br \/>\nall the more inappropriate for this Court to make an adjudication on<br \/>\nmerits in a writ petition filed under Article 32.      The award of the<br \/>\nNational Industrial Tribunal on which reliance was placed  virtually<br \/>\nstands superseded by the settlement arrived at between the parties<br \/>\nculminating in the disposal of the writ petition challenging the said<br \/>\naward in terms of such settlement.\n<\/p>\n<p>We, therefore, decline to grant any relief under Article 32 of the<br \/>\nConstitution.  We leave it to the petitioner to agitate the issue before<br \/>\nappropriate Forum.  The writ petition is therefore dismissed.  The<br \/>\ndismissal of this petition shall not be construed as an expression of<br \/>\nany view on the merits of the respective contentions.\n<\/p>\n<p>\t\t\t\t\t\t..J.\n<\/p>\n<p>\t\t\t\t\t\t(S.
