Imam Qoraishi, daughter of Mahbub\n                  Qoraishi, resident of Mohalla- Beta Gali, Brahampura, P.S.-\n                  Brahampura, District- Muzaffarpur.\n                                                         ...........Opposite Party\n                                             -----------\n<\/pre>\n<p>3.   04.11.2011             This revision application has been preferred under<\/p>\n<p>                     Section 19(4) of the Family Courts Act against the order<\/p>\n<p>                     dated 29.04.2009 passed by the learned Principal Judge,<\/p>\n<p>                     Family    Court,   Muzaffarpur     in    Maintenance   Case<\/p>\n<p>                     No.114\/05 by which the petitioner has been directed to<\/p>\n<p>                     pay a sum of Rs.1500\/-per month to his wife, opposite<\/p>\n<p>                     party for her maintenance.\n<\/p>\n<p>                            The   opposite   party    filed   Maintenance   Case<\/p>\n<p>                     No.114\/05 claiming to be the wife of the petitioner. After<\/p>\n<p>                     few years of marriage, the petitioner, his sister and<\/p>\n<p>                     brothers started torturing her physically and mentally and<\/p>\n<p>                     demanded Rs.5000\/- which was fulfilled by the father of<\/p>\n<p>                     the opposite party, but they again started demanding<\/p>\n<p>                     Rs.20000\/- which could not be fulfilled. Thereafter, she<\/p>\n<p>                     has been deserted and has not been maintained by her<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>husband, who is a fruit vendor and his monthly income is<\/p>\n<p>more than Rs.4000\/-, besides it he has also agricultural<\/p>\n<p>land and from it annual income is Rs.50,000\/-.<\/p>\n<p>      Earlier, a petition was also filed for maintenance,<\/p>\n<p>which was compromised and a Panchnama was prepared<\/p>\n<p>on 6.10.2004 and on the same day, the compromise<\/p>\n<p>petition was also filed in maintenance case no.405\/01 and<\/p>\n<p>the case under Section 498A I.P.C. and Section 125<\/p>\n<p>Cr.P.C. were disposed of in view of the compromise, but<\/p>\n<p>after the compromise, the petitioner again started to<\/p>\n<p>neglect his wife and her children and finally he refused to<\/p>\n<p>maintain them.\n<\/p>\n<p>      In spite of appearance and participation in<\/p>\n<p>reconciliation process, no show-cause has been filed by<\/p>\n<p>the petitioner. After taking evidence on behalf of both the<\/p>\n<p>parties, the impugned order has been passed directing the<\/p>\n<p>petitioner to pay a sum of Rs.1500\/-per month for the<\/p>\n<p>maintenance of his wife and his two minor daughters, who<\/p>\n<p>are living with her.\n<\/p>\n<p>      The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is not able to pay the amount of<\/p>\n<p>maintenance. He is a salesman of fruit on a Thela and he is<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>              not in a position to pay Rs.1500\/-per month and he is<\/p>\n<p>              ready to pay Rs.800\/-per month.\n<\/p>\n<p>                    From perusal of the impugned order, it appears that<\/p>\n<p>              it is an admitted fact that the petitioner is the husband of<\/p>\n<p>              the opposite party and father of her two minor daughters,<\/p>\n<p>              who are living with the opposite party. The petitioner has<\/p>\n<p>              refused to maintain his wife and two minor daughters,<\/p>\n<p>              although he has sufficient means to maintain them.<\/p>\n<p>              Considering the evidence adduced on behalf of both the<\/p>\n<p>              parties, the learned Principal Judge has directed to pay a<\/p>\n<p>              sum of Rs.1500\/-per month only for the maintenance of<\/p>\n<p>              his wife and two minor daughters. The amount of<\/p>\n<p>              maintenance is itself meagre.\n<\/p>\n<p>                    Considering the facts and circumstances stated<\/p>\n<p>              above, I do not find any ground to interfere with the<\/p>\n<p>              impugned order. This petition is dismissed.<\/p>\n<pre>V.K.
