For the remaining RTI application be transferred to the PIO<br \/>\nconcerned.&#8221;\n<\/p>\n<p>Ground of the Second Appeal:\n<\/p>\n<p>Reply was not provided by the PIO.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant : Mr. Harish Kumar;\n<\/p>\n<p>Respondent : Mr. Vijay Bhardwaj, Public Information Officer &amp; SDM (Civil Lines); Mr. Manoj<br \/>\n              Kumar, Sub-Registrar-I, Old Court Complex, Kashmere Gate, Delhi;\n<\/p>\n<p>      The RTI application had been made to SDM-IV(HQ) on 23\/06\/2010. SDM-IV(HQ) Mr.<br \/>\nShyam Sunder transferred the RTI application on 30\/06\/2010 to PIO District North. It appears that<br \/>\nPIO District (North) Mr. Raj Kumar took no action on this matter and forgot all about this application.<br \/>\nHowever, PIO &amp; ADM(North) transferred the RTI application on 07\/01\/2011 by a letter no. RTI\/ID<br \/>\nNo\/2010\/RTI\/REV\/35 to SDM(Civil Lines).\n<\/p>\n<p>From the papers before the Commission it appears that the FAA&#8217;s order on 26\/11\/2010 was also<br \/>\ntreated in complete contempt by PIO District North. It is apparent that no significant information has<br \/>\nbeen provided to the Appellant. The Commission directs PIO Mr. Vijay Bhardwaj to ensure that<br \/>\ninformation relating to Point-A &amp; B about the letter given to SDM(Sadar Bazar) on 03\/06\/2010 and<br \/>\nthe action taken on it is sent to the Appellant before 30 March 2011. The Commission also directs Mr.<br \/>\nManoj Kumar Sub-Registrar-I information on the same matter on the letter received on 03\/06\/2010 at<br \/>\nSub-Registrar-I Kashmere Gate office before 30 March 2011. Both the Respondents will provide the<br \/>\nphotocopies of the letter and the progress of the action taken on it in the following format:\n<\/p>\n<blockquote><p>         Date on which Name and designation of                 Action        Date on which forwarded to<br \/>\n         letter received The officer receiving it.             taken             Next officer\/office.\n<\/p><\/blockquote>\n<blockquote><p>        *there will be as many rows as the number of officers who handled the letter.\n<\/p><\/blockquote>\n<p>The certified copy of the sale deed has been provided to the Appellant before the Commission.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      Both the Respondents Mr. Vijay Bhardwaj and Mr. Manoj Kumar are directed to<br \/>\nprovide the complete information as directed above to the Appellant before 30 March<br \/>\n2011.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO District North within 30 days as required by the law.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                                    Page 2 of 3<\/span><\/p>\n<p> From the facts before the Commission it appears that the PIO District North is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within 30<br \/>\ndays, as per the requirement of the RTI Act. It appears that the PIO&#8217;s actions attract the penal<br \/>\nprovisions of Section 20 (1). A showcause notice is being issued to him, and he is directed give his<br \/>\nreasons to the Commission to show cause why penalty should not be levied on him.\n<\/p>\n<p>The PIO District North will present himself before the Commission at the above address on<br \/>\n23 March 2011 at 03.00pm alongwith his written submissions showing cause why penalty should not<br \/>\nbe imposed on him as mandated under Section 20 (1). He will also bring the information sent to<br \/>\nthe appellant as per this decision and submit speed post receipt as proof of having sent the<br \/>\ninformation to the appellant.\n<\/p>\n<p>If there are other persons responsible for the delay in providing the information to the Appellant the<br \/>\nPIO is directed to inform such persons of the show cause hearing and direct them to appear before<br \/>\nthe Commission with him.\n<\/p>\n<p>This decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                    Shailesh Gandhi<br \/>\n                                                                                          Information Commissioner<br \/>\n                                                                                                     14 March 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
