Mr.Manoj Bhandari, for the the petitioner.<\/p>\n
     Heard learned counsel for the petitioner.<\/p>\n
     The petitioner is aggrieved against the transfer order<\/p>\n
dated 26th Dec, 2009      by which he has been transferred<\/p>\n
from Ganganagar office to Nawa City in Kuchaman City.<\/p>\n
     The   contention    of   the   learned   counsel   for   the<\/p>\n
petitioner is that all it has been done only because of the<\/p>\n
malafides which is clear from the voluminous documentary<\/p>\n
evidence which is placed on record by the petitioner. The<\/p>\n
petitioner was not supplied with certain documents in spite<\/p>\n
of the several representations. Even the petitioner lodged a<\/p>\n
criminal complaint      wherein documents were summoned<\/p>\n
and against which order, a revision petition was filed and<\/p>\n
that revision petition was also dismissed.       The petitioner<\/p>\n
then was harassed while giving some absolutely wrong<\/p>\n
objections and copy of these communications have been<\/p>\n
placed on record by the petitioner. It is submitted that while<\/p>\n
working at particular place, the petitioner has developed a
\n                               2<\/span><\/p>\n
team and there is financial limit within which he has to<\/p>\n
maintain the expenses so as to benefit the LIC and because<\/p>\n
of the transfer he will have to develop a new team for which<\/p>\n
he may have to incur huge expenses and if petitioner will<\/p>\n
not be able to maintain the expenses limit then even his<\/p>\n
services can be terminated.       It is also submitted that<\/p>\n
petitioner’s agents have also been threatened so they may<\/p>\n
detach from the petitioner.    The petitioner has placed on<\/p>\n
record copy of one of the complaint submitted by one<\/p>\n
Shyam Lal which was submitted to the Central Vigilance<\/p>\n
Commissioner     alleging certain serious allegations against<\/p>\n
the Branch Managers and Assistant Administrative Officer.<\/p>\n
In view of the above, according to learned counsel for the<\/p>\n
petitioner, the order dated 26.12.2009 is passed absolutely<\/p>\n
malafiedly and that limit is to the extent that ultimately, the<\/p>\n
petitioner’s services may be terminated.<\/p>\n
     Learned counsel for the petitioner relied upon the<\/p>\n
judgment of the Hon’ble Supreme Court delivered in the<\/p>\n
case of Arvind Dattatraya Dhande Vs. State of Maharashtra<\/p>\n
& Ors reported in (1997) 6 SCC 169 wherein the Hon’ble<\/p>\n
Supreme Court set aside the transfer order and passed the<\/p>\n
stricture against the action of the State Government with<\/p>\n
direction to the Chief Secretary of the State to take<\/p>\n
appropriate action against the person responsible.
\n                               3<\/span><\/p>\n
     Learned counsel for the petitioner also relied upon<\/p>\n
the judgment of this court delivered in the case of Narpat<\/p>\n
Singh Rajpurohit Vs. State of Rajasthan reported in 1991<\/p>\n
WLR (Vol.1) 136 in support of his contention that the<\/p>\n
transfer order can be quashed when a case of malafide is<\/p>\n
made out.\n<\/p>\n
     I considered the submissions of learned counsel for<\/p>\n
the petitioner and perused the facts of the case. It appears<\/p>\n
that petitioner had no good relations with his employer and<\/p>\n
it ultimately resulted into lodging of criminal cases wherein<\/p>\n
certain orders were passed and, thereafter, the revision<\/p>\n
petition was filed.   From the order passed by the criminal<\/p>\n
court on 24th June, 2006 it appears that criminal complaint<\/p>\n
was lodged under Sections 409, 420, 425, 467 and 468 IPC.<\/p>\n
It is stated by learned counsel for the petitioner after taking<\/p>\n
instruction from the petitioner that said complaint is<\/p>\n
pending in the court below.\n<\/p>\n
     It will be appropriate to consider the judgments relied<\/p>\n
upon by learned counsel for the petitioner delivered in the<\/p>\n
cases of (i) Arvind Dattatraya Dhande (supra). In the said<\/p>\n
case, the Hon’ble Supreme Court after considering the facts<\/p>\n
of the case observed that ln view of the unimpeachable and<\/p>\n
eloquent testimony of the performance of the duties, it will<\/p>\n
be obvious that the transfer is not in public interest but is a
\n                                 4<\/span><\/p>\n
case of victimisation of a honest officer at the behest of the<\/p>\n
aggrieved complainants carrying on the business in liquor<\/p>\n
and toddy. Here in this case, the criminal complaints are<\/p>\n
pending, which have been lodged by the petitioner as stated<\/p>\n
by learned counsel for the petitioner. There are serious<\/p>\n
allegations and counter allegations and at this stage, it<\/p>\n
cannot be said that the petitioner is being victimized by<\/p>\n
issuing   this   transfer   order   dated   26.12.2009.    Simply<\/p>\n
because one employee has raised a complaint against the<\/p>\n
employer or has lodged several complaints against the<\/p>\n
employer    or    has initiated criminal cases against          the<\/p>\n
employer itself cannot be made to become any sealed<\/p>\n
against any order of transfer of an employee. It is true that<\/p>\n
malafides   can    be   gathered    from    the   facts   and   the<\/p>\n
surrounding circumstances, but in this case, I do not find<\/p>\n
that any case of malafide has been made out because the<\/p>\n
petitioner may have developed an impression that because<\/p>\n
of this reason of his lodging criminal complaints he has been<\/p>\n
transferred. So far as the contention of learned counsel for<\/p>\n
the petitioner that petitioner will have to develop a new<\/p>\n
team of his agents to achieve the target          by keeping the<\/p>\n
limit of expenses is concerned, that is the duty of the<\/p>\n
petitioner if so is provided by the guidelines.<\/p>\n
     At this stage, learned counsel for the petitioner
\n                                 5<\/span><\/p>\n
vehemently submitted that for Development Officer of the<\/p>\n
LIC, Special Rules have been framed under Rule 17 of the<\/p>\n
LIC of India Development Officers (Revision of Certain<\/p>\n
Terms and Conditions of Service) Rules, 2009.                In these<\/p>\n
Rules, there is no provision providing for transfer of<\/p>\n
Development Officer and, therefore, the general rule under<\/p>\n
the LIC of India (Staff) Regulations, 1960 providing power<\/p>\n
of transfer cannot be invoked for transfer of Development<\/p>\n
Officer.    Learned   counsel       for   the   petitioner    further<\/p>\n
submitted that in these rules, various provisions have been<\/p>\n
made including providing for termination of services of<\/p>\n
Development Officer in certain cases as provided under Rule<\/p>\n
8 of the Rules of 2009 as well as providing rules providing<\/p>\n
table of expense limit.\n<\/p>\n
     According to learned counsel for the petitioner after<\/p>\n
coming into force of the Rules of 2009, the general Rules of<\/p>\n
1960 cannot be invoked.\n<\/p>\n
     The Rules of 2009 very specifically provides “revision<\/p>\n
of certain terms and conditions of service”. These rules are<\/p>\n
not exhaustive rules and these Rules of 2009 are only<\/p>\n
making revision of certain terms and condition of service of<\/p>\n
Development Officer. In the Rules of 2009 no provision for<\/p>\n
transfer by the employer is there and that power is under<\/p>\n
the Rules of 1960 then Rules of 2009 are not in conflict of
\n                                           6<\/span><\/p>\n
            Rules of 1960. Otherwise also, the Rules of 2009 is not in<\/p>\n
            conflict with the general rules because the Rules of 2009<\/p>\n
            are framed for the purpose covered under the rules and are<\/p>\n
            not taking away the powers given in the General Rules once<\/p>\n
            the subjects which are not covered under Rules of 2009. In<\/p>\n
            view of the above reasons so far as power of employer to<\/p>\n
            transfer an employee specifically given in Rules of 1960<\/p>\n
            shall remain intact.\n<\/p>\n
                 In view of the above, the writ petition of the petitioner<\/p>\n
            is dismissed.\n<\/p>\n
