RAVINDRAN, J.\n              - - - - - - - - - - - - - -- - - - - - - - - - - -\n              Contempt Case(Civil) No. 563 OF 2010\n              - - - - - - - - - - - -- - - - - - - - - - - - - -\n               Dated this the 17th day of June, 2010\n\n                               JUDGMENT\n<\/pre>\n<p>      The petitioner is presently working as a Medical Officer in<\/p>\n<p>the   Government        Homoeo        Dispensary        at    Nagaroor   in<\/p>\n<p>Thiruvananthapuram District.          He    applied for general transfer<\/p>\n<p>during the current year. A preliminary transfer order was passed<\/p>\n<p>on 20.03.2010 proposing to transfer him to the Government<\/p>\n<p>Homoeo         Dispensary           at        Chadayamangalam            in<\/p>\n<p>Thiruvananthapuram District itself.              The petitioner had no<\/p>\n<p>objection to the said order of transfer.            However, the second<\/p>\n<p>respondent who had submitted a request for transfer to that<\/p>\n<p>station filed WP(C) No.10839 of 2010 in this Court. The said writ<\/p>\n<p>petition was disposed of by this Court with a direction to the<\/p>\n<p>Director of Homoeopathy to consider his request.                Pursuant to<\/p>\n<p>the said direction the Director of Homoeopathy passed an order<\/p>\n<p>of transfer dated 21.04.2010 transferring the second respondent<\/p>\n<p>to   Government Homoeo Dispensary, Chadayamangalam. The<\/p>\n<p>proposal to transfer the petitioner was shelved. The petitioner<\/p>\n<p>COC No. 563 OF 2010<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>thereupon filed WP(C) No.11837 of 2010 in this Court. The said<\/p>\n<p>writ petition was presented on 27.04.2010 during the vacation<\/p>\n<p>and it came up for admission before me that day itself. On that<\/p>\n<p>writ petition, I passed Annexure A2 order to the effect that if the<\/p>\n<p>second respondent has not taken charge at Chadayamangalam,<\/p>\n<p>the order transferring him shall stand stayed for a period of two<\/p>\n<p>months.\n<\/p>\n<p>      2. This Contempt Case is filed contending that though the<\/p>\n<p>interim order was communicated to the Director of Homoeopathy<\/p>\n<p>and to the local authority which is in charge of the Homoeo<\/p>\n<p>Dispensary, in violation of the said order, records have been<\/p>\n<p>manipulated to make it appear that the second respondent<\/p>\n<p>assumed charge on 27.04.2010 itself at Chadayamangalam. It<\/p>\n<p>is contended that on 27.04.2010 the Homoeo Dispensary at<\/p>\n<p>Chadayamangalam did not function in view of the &#8216;Harthal&#8217; called<\/p>\n<p>by certain political parties and therefore the statement that the<\/p>\n<p>second respondent assumed charge on 27.04.2010 cannot be<\/p>\n<p>believed or accepted upon.\n<\/p>\n<p>      3.   The second respondent has filed a counter affidavit<\/p>\n<p>COC No. 563 OF 2010<br \/>\n<span class=\"hidden_text\">                              -:3:-<\/span><\/p>\n<p>stating that pursuant to the order transferring him to<\/p>\n<p>Chadayamangalam he was relieved from Government Homoeo<\/p>\n<p>Dispensary, Vakkam in the forenoon of 24.07.2010 and that<\/p>\n<p>charge was handed over to the Pahrmacist and the report was<\/p>\n<p>countersigned    by  the   District  Medical   Officer(Homoeo),<\/p>\n<p>Thiruvananthapuram). It is also submitted that he took charge<\/p>\n<p>at    Chadayamangalam      after    relieving  the    incumbent<\/p>\n<p>Dr.G.Muraleedharan who was transferred to the Government<\/p>\n<p>Homoeo Dispensary at Melukavu in Kottayam District.<\/p>\n<p>     4. The learned Government Pleader appearing for the first<\/p>\n<p>respondent submitted with reference to the attendance register<\/p>\n<p>maintained during the period from January to May, 2010 (both<\/p>\n<p>months inclusive) that, the second respondent assumed charge<\/p>\n<p>at Chadayamangalam after relieving       Dr.G.Muraleedharan on<\/p>\n<p>27.04.2010 and that    Dr.G.Muraleedharan has not signed the<\/p>\n<p>attendance register after 27.04.2010.       The original of the<\/p>\n<p>attendance register was also made available to me.       I have<\/p>\n<p>perused the same.\n<\/p>\n<p>     5. I have considered the rival submissions made at the Bar.<\/p>\n<p>COC No. 563 OF 2010<br \/>\n<span class=\"hidden_text\">                               -:4:-<\/span><\/p>\n<p>I have also gone through the materials on record and the original<\/p>\n<p>of the attendance register produced before me. The materials on<\/p>\n<p>record disclose that the second respondent had joined duty at<\/p>\n<p>Chadayamangalam in a proper manner after being relieved from<\/p>\n<p>Vakkam.       The second respondent also took charge at<\/p>\n<p>Chadayamangalam after relieving Dr.G.Muraleedharan who was<\/p>\n<p>under orders of transfer to the Government Homoeo Dispensary<\/p>\n<p>at Melukavu in Kottayam District. In such circumstances it cannot<\/p>\n<p>be said that the respondents have willfully violated the directions<\/p>\n<p>of this Court. In such circumstances I find no ground to proceed<\/p>\n<p>further with this Contempt Case.    It is accordingly closed.<\/p>\n<p>                                         P.N.
